Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD MARCH 10, 2011

CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Councilman Jim Edwards offered the invocation.

PLEDGE OF ALLEGIANCE

Girl Scout Troop 6783 led the assembly in the salute to the flag.

ROLL CALL

The following Members of the City Council were in attendance:

PRESENTATIONS

Proclamations/Presentations were made as follows:

Recognition of outgoing Commission/Committee Members: Richard Gilliland, Jr., Maria Skiles, Mark Anthony Ruiz, Cindy Yen Chen, Chan-Yong Kim (sent representative), Pierre Barit, and Alan Wang.

In honor of their selection as part of City’s Business Recognition Program: Chick-fil-A.

In recognition of the 99th birthday of the Girl Scouts of America: Girl Scout Troop 6783.

In recognition of American Red Cross Awareness Month: Phil Wendel, Public Information Officer of the American Red Cross, Greater Long Beach Chapter.

In recognition of being named as a Hometown Hero by the Greater Long Beach Chapter of the American Red Cross: Dr. Stuart Finkelstein.

In recognition of completion of Los Angeles County Sheriff’s Department Explorer Academy and graduating as the Honor Recruit for Explorer Academy Class Number 85: Jazmine Epperson.

In honor of Safe Communities Month in the City of Cerritos: Captain Joe Gonzales, Cerritos Sheriff’s Station.

PUBLIC COMMENTS AND SUGGESTIONS

Cindy Yen Chen invited community members to the Cerritos College Spring Festival.

Randy Economy thanked the City and staff for their assistance with the traffic matter at Carmenita and Ashworth.

Marianne Guilliette expressed concerns regarding the closure of the Target Garden Centers and the vacancies at the Towne Center.

Paul Bellenbaum spoke regarding the election and the site of the former Black Angus restaurant.

Julietta Williams thanked City staff for scheduling the upcoming African American authors event.

Levi Javier expressed concerns regarding campaign tactics used in the recent election.

CONSENT CALENDAR

Approval of Register of Demands

MOTION: It was moved by Councilwoman Chen and seconded by Councilman Edwards to approve the Register of Demands dated March 10, 2011, Checks 123159 through 123548 in the total amount of $6,713,384.08. The motion carried unanimously.

Approval of Treasurer’s Report

MOTION: It was moved by Councilwoman Chen and seconded by Councilman Edwards to approve the Treasurer’s Report for the period ending January 31, 2011. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved by Councilwoman Chen and seconded by Councilman Edwards to approve the Minutes, as amended, of the Special Joint Meeting of February 22, 2011 and the Regular Meeting of February 24, 2011. The motion carried unanimously.

Ordinance for second reading and adoption. Reading of ordinance waived and ordinance adopted.

ORDINANCE NO. 958 – AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 22.40, SPECIFIC USES, OF TITLE 22 OF THE CITY OF CERRITOS MUNICIPAL CODE TO PROHIBIT THE ESTABLISHMENT AND OPERATION OF MEDICAL MARIJUANA DISPENSARIES IN ALL ZONES WITHIN THE CITY OF CERRITOS.

MOTION: It was moved by Councilwoman Chen and seconded by Councilman Edwards to waive reading of and adopt Ordinance No. 958 entitled AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 22.40, SPECIFIC USES, OF TITLE 22 OF THE CITY OF CERRITOS MUNICIPAL CODE TO PROHIBIT THE ESTABLISHMENT AND OPERATION OF MEDICAL MARIJUANA DISPENSARIES IN ALL ZONES WITHIN THE CITY OF CERRITOS. The motion passed unanimously.

ORDINANCE NO. 959 – AN ORDINANCE OF THE CITY OF CERRITOS ADDING CHAPTER 9.100 TO THE MUNICIPAL CODE DECLARING AS A PUBLIC NUISANCE THE ESTABLISHMENT, MAINTENANCE, OR OPERATION OF MEDICAL MARIJUANA DISPENSARIES WITHIN THE CITY OF CERRITOS.

MOTION: It was moved by and seconded by to waive reading of and adopt AN ORDINANCE OF THE CITY OF CERRITOS ADDING CHAPTER 9.100 TO THE MUNICIPAL CODE DECLARING AS A PUBLIC NUISANCE THE ESTABLISHMENT, MAINTENANCE, OR OPERATION OF MEDICAL MARIJUANA DISPENSARIES WITHIN THE CITY OF CERRITOS. The motion passed unanimously.

PUBLIC WORKS ACTIVITIES

Consideration and award of an ongoing contract for traffic engineering services in the City of Cerritos.

Kanna Vancheswaran, Assistant City Engineer, provided a report.

MOTION: It was moved by Councilman Barrows and seconded by Councilwoman Chen to 1) award an ongoing contract for traffic engineering services in the City of Cerritos to Hartzog & Crabill, Inc. under the terms as specified in the agreement, and 2) authorize the City Manager to execute said agreement on behalf of the City of Cerritos. The motion carried unanimously.

Consideration and award of an ongoing contract for civil engineering services in the City of Cerritos.

Kanna Vancheswaran, Assistant City Engineer, provided a report.

MOTION: It was moved by Councilman Barrows and seconded by Mayor Pro Tem Lee to 1) award an ongoing contract for civil engineering services in the City of Cerritos to Willdan Engineering under the terms as specified in the agreement, and 2) authorize the City Manager to execute said agreement on behalf of the City of Cerritos. The motion carried unanimously.

NEW AND OLD BUSINESS

A report on smart phone applications to report service requests to the City of Cerritos.

Annie Hylton, City and Theater Marketing Manager, provided a report. A PowerPoint Presentation was displayed.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Chen to direct staff to implement the smartphone application service GORequest-Lite offered by Government Outreach for an annual cost of $1,000. The motion carried unanimously.

Review and consideration of a professional services agreement with Kramer.Firm, Incorporated, for Wireless Telecommunication Permit (WTP) application technical review services, the full cost of which shall be reimbursed by WTP applicants.

Robert A. Lopez, Current Planning Manager, provided a report.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Barrows to authorize the City Manager to execute a professional services agreement on behalf of the City with Kramer.Firm, Incorporated, for wireless telecommunication permit application review services. The motion carried unanimously.

Consideration of amended lease agreement with the Los Angeles County Sanitation Districts (APN 7016-005-908)

Sherre Titus, Recreation Services Superintendent, provided a report. A PowerPoint Presentation was displayed.

MOTION: It was moved by Councilman Barrows and seconded by Councilwoman Chen to authorize the City Manager to approve the proposed Fourth Amendment to the Lease Agreement between the City of Cerritos and the Los Angeles County Sanitation Districts for property at the Cerritos Iron-Wood Nine Golf Course. The motion carried unanimously.

Consideration of approval of a license agreement with Southern California Edison at Cerritos Iron-Wood Nine Golf Course (APN 7016-005-908)

Sherre Titus, Recreation Services Superintendent, provided a report. A PowerPoint Presentation was displayed.

MOTION: It was moved by Councilman Barrows and seconded by Councilwoman Chen to direct the City Manager to sign the license agreement between the City of Cerritos and the Southern California Edison Company and authorize the appropriation of $35,131.24 for the first year of the agreement. The motion carried unanimously.

Consideration and review of additional text to be inscribed on the Cerritos Veterans Memorial located at the Northwest corner of Bloomfield Avenue and 183rd Street (APN 7025-028-906) to recognize Cerritos Servicemen and Servicewomen who gave the ultimate sacrifice

Kathleen Jung Matsumoto, Assistant City Manager, provided a report. A PowerPoint Presentation was displayed.

MOTION: It was moved by Councilman Edwards and seconded by Councilman Barrows to approve specific text to be inscribed on each podium of the Cerritos Veterans Memorial and approve an appropriation of $2,000 from the Art in Public Places Trust Fund for the inscription of the text and funding (as needed) for additional names to be placed on the Cerritos Veterans Memorial. The motion carried unanimously.

Consideration and review of potential artists for a lighted sculpture in the City of Cerritos that may be added as part of the Art in Public Places Program

Kathleen Jung Matsumoto, Assistant City Manager, provided a report. A PowerPoint Presentation was displayed.

Maria Skiles, Fine Arts and Historical Commissioner, expressed support for the selection of artist Cliff Garten for this project.

Julietta Williams, Fine Arts and Historical Commissioner, expressed support for the selection of artist Cliff Garten for this project.

MOTION: It was moved by Councilman Barrows and seconded by Councilman Edwards to enter into negotiations with artist Cliff Garten to create a site-specific lighted sculpture/art piece within the Sculpture Garden and approve an amount not to exceed $10,000, for conceptual renderings, from the Art in Public Places Trust Fund.

REPORT ON PENDING LEGISLATION

Mayor Cho noted the earlier special joint meeting of the City Council and Redevelopment Agency held to protect the City’s assets from the impacts of the proposed dissolution of Redevelopment Agencies.

City Manager Art Gallucci further reported on the impacts of the proposed dissolution of Redevelopment agencies in California.

CONSENSUS (Barrows): Direct staff to place the League of California Cities link (www.MyVoteCountsCA.org) on the City’s website, if allowable by the City’s policies.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilman Edwards made the following comments: General Municipal Election and thanked Mayor Pro Tem Lee for her service.

Councilwoman Chen made the following comments: Sanitation District proposed rate change, State Water inspection trip to Sacramento at the invitation of the Central Basin Municipal Water District, Frontier Youth Baseball Opening Event, Opening of the Lazy Dog Restaurant, World Affairs Council event on economic development, Cerritos Friends of the 1st CEB Adoption Committee Bowl-a-Thon, and congratulated the re-elected incumbents and Councilmember-elect.

Councilman Barrows made the following comments: League of Cities Los Angeles Division meeting, update on the 91/605 report, energy upgrade program, and the Orangeline Development Authority.

Mayor Pro Tem Lee made the following comments: congratulated the Councilmember-elect and re-elected incumbent Councilmembers, and thanked the staff and residents of the City of Cerritos for their participation in the recent election.

Mayor Cho made the following comments: thanked Mayor Pro Tem Lee for her service, thanked Cerritos residents for their participation in the recent election,
