Cerritos City Council Meeting Minutes

MINUTES OF A SPECIAL MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD OCTOBER 25, 2010

CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Mr. Mayur Shah with the Rama Krishina Institute offered the invocation.

PLEDGE OF ALLEGIANCE

Girl Scout Troop 4113 led the assembly in the salute to the flag.

ROLL CALL

The following Members of the City Council were in attendance:

Councilman Bruce Barrows
Councilwoman Carol Chen
Councilman Jim Edwards
Mayor Pro Tem Laura Lee
Mayor Joseph Cho, Ph.D.

PRESENTATIONS

The City Council presented Samone Keo-Mulvihill and Tom Mulvihill, owners of Thai Issan Restaurant, with a Proclamation selecting their business as part of the Business Recognition Program.

PUBLIC COMMENTS AND SUGGESTIONS

The Mayor invited those wishing to speak during public comments and suggestions.

Chris Tierheimer thanked the Councilmembers for their presentations to the 1st CEB Marines and invited them to the "packing party."

Phillip Law, representing the Southern California Association of Governments (SCAG), gave a PowerPoint Presentation which outlined the "Pacific Electric Right-of-Way/West Santa Ana Branch Corridor Alternatives Analysis."

CONSENT CALENDAR

Approval of Register of Demands

MOTION: It was moved by Councilmember Chen and seconded by Councilmember Edwards to approve the Register of Demands dated October 25, 2010, Checks 120136 through 120423 in the total amount of $1,784,224.16. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved by Councilmember Chen and seconded by Councilmember Edwards to approve the Minutes of the Regular Meeting of October 14, 2010. The motion carried unanimously.

PUBLIC HEARINGS

A request by applicant Arisara Wiangsaeng of Bamboo Health Spa for approval of a Conditional Use Permit to operate a massage establishment. The subject property is located at 11452 South Street, Cerritos, California, 90703, is zoned Regional Commercial (CR), and is located in the Los Cerritos Redevelopment Project Area (APN 7039 021-050). (This item was continued from the City Council meeting of October 14, 2010.)

*Pursuant to Section 15301 of the California Environmental Quality Act (CEQA), this project is categorically exempt.

Title was read to the foregoing item and a brief staff report was presented by Senior Planner Sandy Cisneros. A PowerPoint Presentation was displayed.

The Mayor opened the public hearing. Interested parties were invited to present testimony.

Tom Mulvihill, Fountain Plaza business owner, spoke in support of this business and requested Council and Agency to approve this item.

Richard Turner spoke in support of the business owner and recommended approval of this item.

Arisara Wiangsaeng submitted a written card in support of the approval of this item.

The Mayor closed public comments and the public hearing.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilmember Edwards that the City Council receive and file the Agency Conformity Report 2010-7 and approve Conditional Use Permit 2010-6, as amended, making the findings set forth in the Cerritos Planning Commission No. PC 2010-36, with the following modifications to the Conditions of Approval:

Condition 60: Valid State-Certified Massage Therapist License and Identification Card Required. The application/business owner shall ensure that no person, whether full-time or part-time, or temporary or fill-in help, shall perform or administer massage therapy in the premises, unless such person has a valid State-Certified Massage Therapist license and identification card issued by the California Massage Therapy Council. The applicant shall submit to the City a copy of a valid California Department of Motor Vehicles driver's license or identification card and a copy of the valid State-Certified Massage Therapist Identification card for each massage therapist that is employed by the massage establishment, within 5 days of the date of hire.

The motion carried unanimously.

CONSENSUS: There was City Council consensus to include the above Condition of Approval language that requires all massage therapists be certified on all future massage establishment projects that come before the Council.

NEW AND OLD BUSINESS

Consideration of a report on a photo backdrop for the Cerritos City Council Chambers.

A brief staff report was presented by staff member Annie Hylton.

Councilmembers provided their input as to the alternatives for the photo backdrop suggested by staff.

Ken Cha, resident, suggested the backdrop material consist of a certain type of fabric, as to reduce glare, and to ensure that there is complete coverage of the background. He expressed interest in Option B.

Ram Kakkar, resident, expressed support for Option B, with the inclusion of the national flag, and for a "sliding" backdrop.

MOTION: It was moved by Councilmember Barrows and seconded by Mayor Pro Tem Lee to receive the input suggested by the Council, incorporate these suggestions into recommendations, and bring this report back for Council's final consideration. The motion carried unanimously.

Designation of Voting Delegate and Alternate(s) for the National League of Cities 2010 Congress of Cities Annual Business Meeting, December 4, 2010

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Barrows to designate Councilman Edwards as the voting delegate to the National League of Cities Conference Business Meeting to be held December 4, 2010. The motion carried unanimously.

Consideration of a request of the La Palma-Cerritos Branch of the American Association of University Women (AAUW) regarding its February 15, 2011 City Council Candidate Forum.

MOTION: It was moved by Councilmember Chen and seconded by Councilmember Edwards to authorize the La Palma-Cerritos Branch of the American Association of University Women (AAUW) to use the Council Chambers on Tuesday, February 15, 2011 from 7:00 p.m. to 9:00 p.m. for the purpose of holding a forum for Cerritos City Council candidates in the upcoming March 8, 2011 General Municipal Election, with the City absorbing the costs associated with cable casting the event. The motion carried unanimously.

A request by the property owner, Kent Browning/Obispo Properties, LLC, P.O. Box 367, Artesia, California, 90701, for a time extension to Precise Plan 68-8(B)(2009) amendment which was approved to construct an addition to an existing one-story, industrial building located at 16717 Norwalk Boulevard, Cerritos, California, 90703. The subject property is located in the Los Coyotes Redevelopment Project Area (APN 7011-001-020).

MOTION: It was moved by Councilmember Chen and seconded by Councilmember Edwards that the City Council approve a one (1) year time extension for Precise Plan 68-8(B)(2009) Amendment, which will expire September 26, 2011. The motion carried unanimously.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilmember Barrows offered comments on the following items: the City's Photo Enforcement program, employee pay scale benchmark reports, and the current labor negotiations process.

CONSENSUS: There was Council consensus to direct staff to bring back a report related to the installation of "countdown" pedestrian heads on traffic light signals.

CONSENSUS: There was Council consensus to direct staff to bring back a report related to the benchmark employee pay scales.

The City Manager affirmed that staff will be bringing back a report on the City's labor negotiations process as soon as possible.

CONSENSUS: There was Council consensus to direct staff to continue with their labor negotiation process and return to Council with an agenda report, as soon as appropriate, for potential action.

Councilmember Chen offered comments on the following items: City Halloween Festival on October 31st and Library Events.

Councilmember Edwards offered comments on the following items: Cerritos Community Prayer Breakfast and the dedication of the Angelic Duet Public Art Piece.

Mayor Pro Tem Lee offered comments on the following items: Angelic Duet Public Art Piece Dedication.

Mayor Cho offered comments on the following items: various ribbon-cutting and grand opening activities, a press conference for the YES on 22 campaign, the Angelic Duet Public Art Piece Dedication, Long Beach marathon, and parking tickets issued by Los Angeles County.

CONSENSUS: There was Council consensus to bring back a report related to the issuing of parking tickets by Los Angeles County at Cerritos Regional Park.

ADJOURNMENT

The meeting adjourned at 8:36 p.m. in memory of State Senator Jenny Oropeza.
