Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD AUGUST 12, 2010

CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Mr. Mayur Shah with the Ramakrishna Institute offered the invocation.

PLEDGE OF ALLEGIANCE

Girl Scout Troop 678 led the assembly in the salute to the flag.

ROLL CALL

The following Members of the City Council were in attendance:

Councilman Bruce Barrows
Councilwoman Carol Chen
Councilman Jim Edwards
Mayor Pro Tem Laura Lee
Mayor Joseph Cho, Ph.D.

PRESENTATIONS

A proclamation was presented to Vivek Kasarabada member of Boy Scout Troop 394 in recognition of his achieving the rank of Eagle Scout.

PUBLIC COMMENTS AND SUGGESTIONS

The Mayor invited those wishing to speak during public comments and suggestions.

Carl Simon spoke regarding an accident which claimed the life of his wife, Jill. He suggested the Council consider adopting a Resolution or Ordinance mandating the use of bollards to prevent such accidents in the future.

CONSENSUS: It was the consensus of the City Council to direct staff to bring Mr. Simon’s suggestions to the Planning Commission for their review, and report back to the City Council as appropriate.

CONSENT CALENDAR

Approval of Register of Demands

MOTION: It was moved by Councilman Barrows and seconded by Councilman Edwards to approve the Register of Demands dated August 12, 2010, Checks 118165 through 118539, in the total amount of $9,860,502.00. The motion carried unanimously.

CONSENT CALENDAR ITEMS REMOVED

Approval of Treasurer's Report for the period ending June 30, 2010

In response to an inquiry from Councilwoman Chen, Administrative Services Director Denise Manoogian provided information regarding the status of Rose Float donation refunds.

MOTION: It was moved by Councilwoman Chen and seconded by Councilman Barrows to approve the Treasurer's Report for the period ending June 30, 2010. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved Councilman Barrows and seconded by Councilman Edwards to approve the Minutes of the Regular Meeting of July 22, 2010, as corrected. The motion carried unanimously.

PUBLIC HEARINGS

Consideration to waive reading of and adopt AN URGENCY ORDINANCE OF THE CITY OF CERRITOS EXTENDING URGENCY ORDINANCE NO. 950 WHICH ESTABLISHED A MORATORIUM TO PROHIBIT MEDICAL MARIJUANA DISPENSARIES IN ALL ZONES AND PROHIBIT THE ISSUANCE OF BUSINESS LICENSES, BUILDING PERMITS, AND OTHER LAND USE ENTITLEMENTS THEREFOR.

Title was read to the foregoing item, the public hearing opened, and brief staff report presented. Ryan Carey, Management Analyst, provided the report.

Interested parties were invited to present testimony.

Ram Kakkar, resident, noted that he agreed with the recommendations in the staff report and his opposition to these types of dispensaries in the community.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards to waive reading of and adopt Ordinance No. 955 as an urgency ordinance entitled
AN URGENCY ORDINANCE OF THE CITY OF CERRITOS EXTENDING URGENCY ORDINANCE NO. 950 WHICH ESTABLISHED A MORATORIUM TO PROHIBIT MEDICAL MARIJUANA DISPENSARIES IN ALL ZONES AND PROHIBIT THE ISSUANCE OF BUSINESS LICENSES, BUILDING PERMITS, AND OTHER LAND USE ENTITLEMENTS THEREFOR. The motion carried by the following vote:

AYES: Councilmembers – Chen, Edwards, Lee, Cho, Barrows
NOES: Councilmembers – None
ABSENT: Councilmembers – None
ABSTAIN: Councilmembers – None

A development proposal by Lingle Design Group, Inc., 158 West Main Street, Lena, Illinois, 61048 on behalf of the property owner, Cerritos Best Plaza, LLC., to demolish an existing restaurant building and construct a new restaurant building for Buffalo Wild Wings at 11255 183rd Street, Cerritos, California, 90703. The subject property is zoned CR-Regional Commercial and is located in the Los Cerritos Redevelopment Project Area (APN 7034-015-014).

Title was read to the foregoing item, the public hearing opened, and brief staff report presented. Senior Planner, Sandy Cisneros presented a staff report and PowerPoint Presentation entitled, “Buffalo Wild Wings Restaurant, Precise Plan 2010-11.”

Interested parties were invited to present testimony.

Edward Keegan, representing Lingle Design Group, introduced himself and another representative, Dennis Fletcher, Regional Director of Real Estate, and responded to various inquiries from the City Council. He outlined the current approval-process timeline.

Paul Bellenbaum, resident, mentioned his working relationships with various restaurants.

MOTION: It was moved by Councilwoman Chen and seconded by Councilman Barrows that the City Council:

A. Receive and file Cerritos Redevelopment Agency Conformity Report 2010-4.

B. Receive, certify and approve the Mitigated Negative Declaration, making the findings set forth in Cerritos Planning Commission Resolution No. 2010-25.

C. Approve Precise Plan 2010-11, making the findings set forth in the Cerritos Planning Commission Resolution No. PC 2010-26.

The motion carried unanimously.

PUBLIC WORKS ACTIVITIES

Consideration and approval of a water division program to make available emergency water supply storage kits for residents.

Water Superintendent Charles Emig provided a brief staff report.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards to authorize the commencement of a water division program to make available emergency water supply storage kits for residents, businesses, and civic organizations. The motion carried unanimously.

NEW AND OLD BUSINESS

Designation of Voting Delegate and Alternate(s) for the League of California Cities Annual Conference to be held September 15-17, 2010.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Chen to designate Councilman Barrows as the voting delegate and Mayor Cho and Councilman Edwards as first and second alternates, respectively, to the League of California Cities Annual Conference Business meeting to be held September 15-17, 2010.

The motion carried unanimously.

Review of 2011 City Council/Redevelopment Agency meeting dates and possible rescheduling of dates conflicting with holidays and/or other events.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Barrows to modify the 2011 City Council meeting calendar as follows:

Monday, May 9, 2011 in lieu of Thursday, May 12, 2011
Monday, September 19, 2011 in lieu of Thursday, September 22, 2011
Monday, October 24, 2011 in lieu of Thursday, October 27, 2011
Monday, November 14, 2011 in lieu of Thursday, November 10, 2011

The motion carried unanimously.

Consideration and award of Bid No. 1102-11, Printing of the Cerritos Center for the Performing Arts 2010-2011 on stage programs.

MOTION: It was moved by Councilman Edwards and seconded by Mayor Pro Tem Lee to award Bid No. 1102-11 to Diversified Printers, Inc. for the Printing of the Cerritos Center for the Performing Arts 2010-2011 On Stage Programs in the amount of $33,862.27.

The motion carried unanimously.

REPORT ON LEGISLATION

City Manager Art Gallucci, noted that staff is heavily monitoring proposed legislation that is currently moving through the Assembly and Senate in Sacramento. He also introduced Assistant City Engineer, Kanna Vancheswaran who provided a demonstration to the Council of the photovoltaic technology materials currently being installed at the Cerritos Corporate yard.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilman Barrows suggested a modification to the City Ordinance relating to Art in Public Places funds. The new policy would involve a minimum amount “threshold” in order to meet the quality and goals of the City.

CONSENSUS: It was the consensus of the City Council to direct staff to amend the Ordinance language to specifically address minimum threshold amounts for sculpture pieces paid by developers, present the language to the Fine Arts and Historical commission for review, and present recommendation back to the City Council.

Councilman Barrows referenced media reports regarding local government pay scales. He mentioned the Cerritos’ City Manager’s long-time policy of only taking the same “Cost of living” increases as other City employees and that the Council had also recently taken a ten percent (10%) reduction in their stipends.

Councilwoman Chen reported on her attendance at the Korean War Veterans recognition day; Republic of Korea Navy performance; Blind Start of America 2010 Dragon Boat race for the visually impaired; LA County Supervisor Don Knabe's meeting recognizing the 1st CEB and the City of Cerritos; Chief Sky Knight pilot Wes Pearson's retirement; and the Loveland Sculpture Invitational. Congratulated Councilman Barrows on his appointment as the Vice-President of the League of California Cities Los Angeles Division, and asked that the meeting be closed in memory of Wendy Rice, daughter of former Cerritos Water Superintendent Joe Holdren.

Councilman Edwards reported on his attendance at various events as follows: Teen Volunteer recognition dinner, Soccer awards at the Sports Complex, Sky Knight program pilot Wes Pearson's retirement, Los Angeles County Supervisor’s Meeting, and the Loveland Sculpture Show.

Mayor Pro Tem Lee reported on her recent trip to China and the World Expo.

Mayor Cho reported on his attendance at various events as follows: Eagle Scout Court of Honor for Boy Scout Troop 72; City employee family night; ribbon cutting at Forever 21; retirement luncheon for City Engineer Rash Syed; and the Robert Canada Friendship Pow Wow in Hawaiian Gardens. Congratulated Councilman Barrows on his recent appointment, completed 130 miles in the month of July with the Cerritos Seniors Get Moving program, completed the San Francisco Half-Marathon, attended the Republic of Korea Navy honor band performance, and encouraged attendance at the Citywide pride program at the Cerritos Sheraton.

The meeting adjourned at 8:37 p.m. in memory of Jill LaMar Simon and Wendy Rice.
