Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD MARCH 22, 2007

CALL TO ORDER

The Mayor called the meeting to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Mayor Pro Tem Edwards offered the invocation

PLEDGE OF ALLEGIANCE

Brownie Troop 49 led the assembly in the salute to the flag.

The City Clerk noted attendance of the following Members of the City Council:

PRESENTATIONS

Proclamations were presented to:  Brittany Chen for winning second place for Dancing in the Talent category for the Chinese Folk Dance "Crouching Tiger Hidden Dragon" at the International Modeling and Talent Association competition in Los Angeles, and to Aditya Rayasam for achieving the rank of Eagle Scout.

CONSIDERATION OF APPOINTMENTS TO VACANCIES ON VARIOUS COMMISSIONS, BOARDS AND COMMITTEES

MOTION:  It was moved by Councilman Barrows and seconded by Councilman Cho to confirm the following appointees:

The City Clerk then administered the oath to those appointed.

PUBLIC COMMENTS AND SUGGESTIONS

Paul Teuerle, Cerritos resident, referenced a Code Enforcement matter involving the placement of a basketball stand, and suggested that street sweeping signs include a caution for children at play and the speed limit.  Mr. Teuerle noted he was a Cerritos-Artesia Little League coach and indicated he was asking as a parent that the City reduce or eliminate the cost assessed to light fields at Cerritos Park East.

CONSENT CALENDAR ITEMS

Approval of Register of Demands

MOTION:  It was moved by Mayor Pro Tem Edwards and seconded by Councilman Barrows to approve the Register of Demands dated March 22, 2007, Checks 88993 through 89465, in the total amount of $12,933,113.69.  The motion carried unanimously.

Approval of Treasurer’s Report for the period ending January 31, 2007

MOTION:  It was moved by Mayor Pro Tem Edwards and seconded by Councilman Barrows to approve the Treasurer’s Report for the period ending January 31, 2007.  The motion carried unanimously.

Approval of Minutes

MOTION:  It was moved by Mayor Pro Tem Edwards and seconded by Councilman Barrows to approve the Minutes of the March 8, 2007 Regular City Council Meeting, the March 13, 2007 Special City Council Meeting, and the March 14, 2007 Joint Special Meeting of the City Council and Redevelopment Agency.  The motion carried unanimously.

PENDING LEGAL MATTERS

Resolution for consideration

Options and timeline for actions regarding the Los Coyotes Lighting and Landscaping District.

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS, PROPOSING THE CONTINUATION OF THE LOS COYOTES LIGHTING AND LANDSCAPING DISTRICT AND ORDERING THE CITY ENGINEER OR DESIGNEE TO PREPARE A REPORT, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND THE PROVISIONS OF ARTICLE XIII D OF THE CALIFORNIA CONSTITUTION.

Budget Administrator DeMasi reviewed the staff report dated March 22, 2007; the options with regard to the Los Coyotes Lighting and Landscaping District; and potential Proposition 218 ramifications.

RESOLUTION NO. 2007-6

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS, PROPOSING THE CONTINUATION OF THE LOS COYOTES LIGHTING AND LANDSCAPING DISTRICT AND ORDERING THE CITY ENGINEER OR DESIGNEE TO PREPARE A REPORT, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND THE PROVISIONS OF ARTICLE XIII D OF THE CALIFORNIA CONSTITUTION.

MOTION:  It was moved by Councilman Barrows and seconded by Councilman Cho to waive reading of and adopt Resolution No. 2007-6.  The motion carried, with Councilman Crawley dissenting.

Councilman Crawley indicated that he would prefer to have the assessment dropped from the property tax bill even though the assessment is a zero amount.

PUBLIC WORKS ACTIVITIES

A finding of the Cerritos Redevelopment Agency pursuant to California Health and Safety Code Section 33445 regarding the expenditure of Agency funds for the construction of public notice posting boards on City-owned property and described as the pubic right-of-way adjacent to the commercially zoned properties at 18802 Gridley Road, and at 13315 Artesia Boulevard, and consideration and award of contract for the construction of public notice posting boards, Bid No. 1046-07, Projects No. 44017 and 74017 (APN 7039-020-016, APN 7008-015-007).

In accordance with California Environmental Quality Act (CEQA) guidelines, this project has been deemed categorically exempt per Section 15302 "Replacement and Reconstruction".

Public Works Director Arbogast provided an overview of the staff report dated March 22, 2007, addressed the findings for expenditure of Agency funds, and responded to Council inquiries regarding the deteriorating condition of the existing posting boards and the increased posting area that would accommodate larger print type of posted documents.

MOTION:  It was moved by Mayor Pro Tem Edwards and seconded by Councilman Crawley to make the findings outlined in the staff report dated March 22, 2007 as follows:

1.         The proposed improvements are situated adjacent to the Los Cerritos and Los Coyotes Redevelopment Project Areas and will benefit said project areas, as well as the entire community in which the proposed notice posting boards will be constructed;

2.         There is no other source of funds reasonably available for financing the proposed improvements referred to herein; and

3.         The proposed improvements will assist in the elimination of blight by providing educational and informational infrastructure which will benefit the Los Cerritos and Los Coyotes Redevelopment Project Areas as well as the entire community, and are consistent with the Agency's five-year implementation plan;

and to award a contract for the construction of public notice posting boards, Bid No.

1046-07, Projects No. 44017 and 74017, in the amount of $67,422 to Green Giant Landscaping, and to reject all other bids.  The motion carried unanimously.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilman Barrows requested that consideration of the matter of a residential overlay zone within Development Area One (ADP-1) be placed on this meeting's agenda or placed on the next Council agenda.

City Attorney Steres discussed state law with regard to placing items on the agenda, observed that there is not an immediate need to take action on the overlay zone at this meeting, and recommended the matter be placed on a future agenda should the Council wish to consider the item.

MOTION:  It was moved by Councilman Barrows and seconded by Councilman Crawley to place the matter of discussion and consideration of a 45-day moratorium on a potential residential overlay zone in Development Area One (ADP-1) on the April 12, 2007 City Council agenda.  The motion carried unanimously.

Councilman Barrows asked that the fees for lighting of fields be brought back for Council review and a brief discussion ensued regarding prior review by the Parks and Recreation Commission.

CONSENSUS:  It was the consensus of the City Council that the matter of fees for lighting of fields be referred to the Parks and Recreation Commission for study and report back to the City Council.

Councilman Crawley reported on his attendance at the National League of Cities Conference in Washington, D.C., sessions attended, and speakers at open sessions; and the California Contract Cities Association meeting in Compton.  Mr. Crawley asked that Mr. Teuerle's request for signage during public comments be addressed and City Manager Gallucci indicated he would provide a memorandum to the Council.

Mayor Pro Tem Edwards also reported on his attendance at the National League of Cities Conference in Washington, D.C., congratulated Mr. Barrows' Commission and Committee appointees; and commented on the performance of the Air Force Musicians Association Falconaires at the Cerritos Center for the Performing Arts.

Councilman Cho reflected on his initial experiences as a Councilmember and commented on his attendance at several community events, including the Korean Senior Citizens Association Choir performance and the Youth Basketball Awards Ceremony.

Councilman Barrows referenced e-mails and blogs with regard to the Del Amo Boulevard bridge and staff responded that during the past 17 years there have been no fatalities associated with that bridge.  It was also noted that the railroad bridge is not within the corporate boundaries of the City.

Mayor Lee commented on her attendance at the March 19 Youth Basketball Awards Ceremony and commended the volunteer coaches and parents for their contributions.

There being no further business to come before the City Council, the meeting adjourned at 8:10 p.m.
