MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD MAY 11, 2006



CALL TO ORDER

Mayor Paul Bowlen called the meeting to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Councilman Jim Edwards offered the invocation.

PLEDGE OF ALLEGIANCE

Councilman John Crawley led the assembly in the salute to the flag.

ROLL CALL

The City Clerk noted attendance of the following Members of the City Council:

PRESENTATIONS

Rich Chenin, Chairman of the Tournament of Roses Float Entries Committee, presented the City Council with a Participants Float Photo for participation in the 2006 Tournament of Roses Parade, at which the City's "Magical Music Machine" float was honored with the Animation Award for best animation and motion.

CONSIDERATION OF APPOINTMENTS TO VACANCIES ON VARIOUS COMMISSIONS, BOARDS AND COMMITTEES

Consideration of appointment to the Board of Directors for the Friends of the Cerritos Center for the Performing Arts.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Kappe to appoint Brian Hews to the Board of Directors for the Friends of the Cerritos Center for the Performing Arts to fill the unexpired term of Patric Rayburn ending March 31, 2007. The motion carried unanimously.

PUBLIC COMMENTS AND SUGGESTIONS

Merri Wheaton, Cerritos resident, offered a prayer.

Paul Bellenbaum, Cerritos resident, referenced the upcoming 75th anniversary of Holy Family Catholic Church and suggested City participation in the form of requesting a car donation from the auto square dealers.

It was suggested that Mr. Bellenbaum contact the auto dealers of the Cerritos Auto Square directly for assistance.

CONSENT CALENDAR ITEMS

Approval of Register of Demands

MOTION: It was moved by Councilman Crawley and seconded by Councilman Edwards to approve the Register of Demands dated May 11, 2006, Checks 80811 through 81168 in the total amount of $5,528,711.17. The motion carried unanimously.

Approval of Treasurer’s Report for the period ending March 31, 2006

MOTION: It was moved by Councilman Crawley and seconded by Councilman Edwards to approve the Treasurer's Report for the period ending March 31, 2006. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved by Councilman Crawley and seconded by Councilman Edwards to approve the Minutes of the April 27, 2006 Regular City Council Meeting. The motion carried unanimously.

PUBLIC HEARINGS

Consideration to waive reading of and introduce AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 22.22, SINGLE FAMILY RESIDENTIAL (RS) ZONES, OF THE CERRITOS MUNICIPAL CODE RELATING TO THE ADDITION OF CORRUGATED POLYCARBONATE AS AN APPROVED PATIO COVER MATERIAL.

Negative Declaration
Development Code Amendment 2006-5


Title was read to the foregoing item, the public hearing opened, and staff was called upon for a report.

Management Analyst Carey reviewed the contents of the staff report dated May 11, 2006 and the ordinance provisions of the proposed ordinance.

Those interested in addressing the City Council on this matter were invited to the podium. No one responded and the public hearing was closed.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards that the City Council:

A. Certify, receive and file the Negative Declaration prepared for Development Code Amendment 2006-5, which was completed in accordance with the California Environmental Quality Act; and

B. Direct staff to file a Notice of Determination in accordance with the California Environmental Quality Act and Section 3.5 of the Environmental Impact Report Guidelines of the City of Cerritos; as recommended in the staff report dated May 11, 2006. The motion carried unanimously.


ORDINANCE NO. 914

AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 22.22, SINGLE FAMILY RESIDENTIAL (RS) ZONES, OF THE CERRITOS MUNICIPAL CODE RELATING TO THE ADDITION OF CORRUGATED POLYCARBONATE AS AN APPROVED PATIO COVER MATERIAL.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards to waive reading of and introduce Ordinance No. 914. The motion carried by the following vote:

AYES: Councilmembers - Crawley, Edwards, Kappe, Lee, Bowlen
NOES: Councilmembers - None
ABSENT: Councilmembers - None
ABSTAIN: Councilmembers - None

Consideration to waive reading of and adopt A RESOLUTION OF THE CERRITOS CITY COUNCIL AUTHORIZING CONVEYANCE OF PROPERTY OWNED BY THE CITY OF CERRITOS TO THE CERRITOS REDEVELOPMENT AGENCY LOCATED AT THE SOUTHEAST CORNER OF 183RD STREET AND CARMENITA ROAD, CERRITOS, CALIFORNIA 90703 (ADJACENT TO APN 7023-007-903), MEASURING APPROXIMATELY ±0.05 ACRES TOTAL IN AREA, FOR USE IN CONNECTION WITH THE DEVELOPMENT OF AN 18-UNIT AFFORDABLE SENIOR HOUSING PROJECT.

Consideration to waive reading of and adopt A JOINT RESOLUTION OF THE CERRITOS CITY COUNCIL AND CERRITOS REDEVELOPMENT AGENCY APPROVING A REPORT PURSUANT TO CALIFORNIA HEALTH AND SAFETY CODE SECTION 33433 REGARDING THE EXECUTION OF A FIRST AMENDMENT TO THE DISPOSITION AND DEVELOPMENT AGREEMENT CONCERNING CONVEYANCE OF PROPERTY OWNED BY THE CERRITOS REDEVELOPMENT AGENCY LOCATED AT THE SOUTHEAST CORNER OF 183RD STREET AND CARMENITA ROAD, CERRITOS, CALIFORNIA 90703, TO THE OLSON COMPANY FOR THE PURPOSE OF DEVELOPING AN 18-UNIT AFFORDABLE SENIOR HOUSING PROJECT, AND AUTHORIZING EXECUTION OF SAID FIRST AMENDMENT.

One Mitigated Negative Declaration was prepared for the proposed 18-unit affordable senior housing development, inclusive of all related entitlements and amendments, and was approved and certified at a public hearing before the Cerritos City Council/Redevelopment Agency on November 14, 2002.

Title was read to the foregoing item, the public hearing opened, and staff called upon for a report.

Advance Planning/Redevelopment Manager Lopez reviewed the staff report dated May 11, 2006 and discussed the proposed conveyance particulars.

Interested parties were invited to present testimony.

Ben Besley, Olsen Company, 3020 Old Ranch Parkway, Suite 400, Seal Beach, commented on ongoing soil remediation activities on the site in accordance with the Disposition and Development Agreement.

No one else wished to address the City Council and the public hearing was closed.

RESOLUTION NO. 2006-10

A RESOLUTION OF THE CERRITOS CITY COUNCIL AUTHORIZING CONVEYANCE OF PROPERTY OWNED BY THE CITY OF CERRITOS TO THE CERRITOS REDEVELOPMENT AGENCY LOCATED AT THE SOUTHEAST CORNER OF 183RD STREET AND CARMENITA ROAD, CERRITOS, CALIFORNIA 90703 (ADJACENT TO APN 7023-007-903), MEASURING APPROXIMATELY ±0.05 ACRES TOTAL IN AREA, FOR USE IN CONNECTION WITH THE DEVELOPMENT OF AN 18-UNIT AFFORDABLE SENIOR HOUSING PROJECT.

MOTION: It was moved by Councilman Crawley and seconded by Councilman Edwards to waive reading of and adopt Resolution No. 2006-10; and directed that the amount conveyed be transferred into the trust fund for the Cerritos Center for the Performing Arts.
The motion carried unanimously.

RESOLUTION NO. 2006-11
RESOLUTION NO. CRA 2006-1

A JOINT RESOLUTION OF THE CERRITOS CITY COUNCIL AND CERRITOS REDEVELOPMENT AGENCY APPROVING A REPORT PURSUANT TO CALIFORNIA HEALTH AND SAFETY CODE SECTION 33433 REGARDING THE EXECUTION OF A FIRST AMENDMENT TO THE DISPOSITION AND DEVELOPMENT AGREEMENT CONCERNING CONVEYANCE OF PROPERTY OWNED BY THE CERRITOS REDEVELOPMENT AGENCY LOCATED AT THE SOUTHEAST CORNER OF 183RD STREET AND CARMENITA ROAD, CERRITOS, CALIFORNIA 90703, TO THE OLSON COMPANY FOR THE PURPOSE OF DEVELOPING AN 18-UNIT AFFORDABLE SENIOR HOUSING PROJECT, AND AUTHORIZING EXECUTION OF SAID FIRST AMENDMENT.

MOTION: It was moved by Councilman Crawley and seconded by Councilman Edwards to waive reading of and adopt Resolution No. 2006-11 and Resolution No. CRA 2006-1. The motion carried unanimously.

PENDING LEGAL MATTERS

Resolution for consideration

Consideration of revised assessment for Los Coyotes Lighting and Landscaping District.

Presentation of Engineer's Report.

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING THE ENGINEER'S REPORT REGARDING THE ANNUAL LEVY OF ASSESSMENTS WITHIN THE LOS COYOTES LIGHTING AND LANDSCAPING DISTRICT, DECLARING ITS INTENTION TO ORDER AND IMPLEMENT A REASSESSMENT BEGINNING JULY 1, 2006 AND SETTING A PUBLIC HEARING DATE OF JUNE 8, 2006.


MOTION: It was moved by Councilwoman Kappe and seconded by Mayor Pro Tem Lee to receive and file the Engineer's Report; and authorize staff to fulfill all actions needed to "remit back" assessments from reserves of the Los Coyotes Lighting and Landscaping Fund and other available revenues, resulting in a charge of $0 to the individual property owners. The motion carried unanimously.
 

RESOLUTION NO. 2006-12

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING THE ENGINEER'S REPORT REGARDING THE ANNUAL LEVY OF ASSESSMENTS WITHIN THE LOS COYOTES LIGHTING AND LANDSCAPING DISTRICT, DECLARING ITS INTENTION TO ORDER AND IMPLEMENT A REASSESSMENT BEGINNING JULY 1, 2006 AND SETTING A PUBLIC HEARING DATE OF JUNE 8, 2006.

MOTION: It was moved by Councilwoman Kappe and seconded by Mayor Pro Tem Lee to waive reading of and adopt Resolution No. 2006-12. The motion carried unanimously.

NEW AND OLD BUSINESS

Consideration of the status of pending legislation pertaining to cable television regulation at the state and federal levels.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Kappe to receive and file the staff report dated May 11, 2006 entitled Consideration of the status of pending legislation pertaining to cable television regulation at the state and federal levels; and authorize the City Manager to continue monitoring pending cable television regulation and take action to respond as appropriate. The motion carried unanimously.

REPORT ON PENDING LEGISLATION

City Manager Gallucci reported on pending cable television legislation.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS

The City Council commended staff on a successful City of Cerritos 50th Anniversary; on receiving the Regional Champion Award for housing from the Southern California Association of Governments; and on the State of City presentation at the Chamber of Commerce meeting.

ADJOURNMENT

There being no further business to come before the City Council, the meeting adjourned at 7:50 p.m.
