Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE CERRITOS CITY COUNCIL AND THE SUCCESSOR AGENCY TO THE CERRITOS REDEVELOPMENT AGENCY HELD ON SEPTEMBER 26, 2013

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

The invocation was provided by Rajan Zed, Universal Society of Hinduism.

3. PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was led by Boy Scout Troop 1005.

4. ROLL CALL

The following members of the City Council/Successor Agency were in attendance:

MOTION: It was moved by Ray and seconded by Pulido to approve the appointment of Frank Arevalo to the Board of Directors for the Friends of Arts Education at the Cerritos Center for the Performing Arts.
The motion carried (5 – 0) as follows:

Ralph Westfall, resident, spoke regarding the Cerritos Center for the Performing Arts.

MOTION: It was moved by Pulido and seconded by Ray to approve the Register of Demands dated September 26, 2013 in the total amount of $1,301,193.41.
The motion carried (5 – 0) as follows:

ABSTAIN: None

7B. City of Cerritos dated September 26, 2013. (SUCCESSOR AGENCY)

MOTION: It was moved by Pulido and seconded by Ray to approve the Register of Demands dated September 26, 2013 in the total amount of $209,239.25.
The motion carried (5 – 0) as follows:

8. Approval of Minutes

MOTION: It was moved by Pulido and seconded by Ray to approve the City Council/Successor Agency Regular Meeting Minutes of September 12, 2013.
The motion carried (5 – 0) as follows:

9. PUBLIC HEARINGS

9A. REVIEW AND CONSIDERATION OF THE 2013-2021 HOUSING ELEMENT UPDATE OF THE CERRITOS GENERAL PLAN AND NEGATIVE DECLARATION.

NEGATIVE DECLARATION*

*A NEGATIVE DECLARATION WAS PREPARED FOR THE 2013-2021 HOUSING ELEMENT, PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA).

A staff report was given by Ryan Carey, Advanced Planning/Economic Development Manager.

The Mayor opened the item for public comments.

Ram Kakkar, resident, spoke regarding induction looping in reference to the housing element.

Seeing no other speakers, the Mayor closed public comments on this item.

MOTION: It was moved by Chen and seconded by Pulido to authorize the submittal of the 2013-2021 Draft Housing Element to the California Department of Housing and Community Development (HCD). The motion carried (5 – 0) as follows:

10. NEW AND OLD BUSINESS

10A. CONSIDERATION AND AWARD OF BID NO. 1163-14, PRINTING OF THE 2014 CERRITOS COMMUNITY CALENDAR (COUNCIL)

A staff report was given by Annie Hylton, City and Theater Marketing Manager.

The Mayor opened the item for public comments. Seeing none, the Mayor closed public comments on this item.

MOTION: It was moved by Ray and seconded by Pulido to award Bid No. 1163-14 to Anderson LA for the printing of the 2014 Cerritos Community Calendar in the amount of $21,600.47. The motion carried (5 – 0) as follows:

10B. CONSIDERATION AND ADOPTION OF THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE SUBMITTAL ("ROPS 13-14B") OF THE SUCCESSOR AGENCY TO THE CERRITOS REDEVELOPMENT AGENCY FOR THE PERIOD BEGINNING JANUARY 1, 2014 TO CONFORM WITH HEALTH AND SAFETY CODE SECTIONS 34167(h) AND 34169(g), IN COMPLIANCE WITH ASSEMBLY BILL 1X 26 AND ASSEMBLY BILL 1484. (SUCCESSOR AGENCY)

A staff report was given by Geri DeMasi, Budget Manager.

The Mayor opened the item for public comments. Seeing none, the Mayor closed public comments.

MOTION: It was moved by Ray and seconded by Chen to

1. Receive and file the report; and
2. Waive reading of and adopt Resolution No.CSA 2013-3, A RESOLUTION OF THE SUCCESSOR AGENCY TO THE CERRITOS REDEVELOPMENT AGENCY ADOPTING THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE SUBMITTAL ("ROPS 13-14B") FOR THE PERIOD BEGINNING JANUARY 1, 2014, IN COMPLIANCE WITH THE PROVISIONS OF AB 1X 26 AND AB 1484; and
3. Authorize staff to transmit the adopted ROPS 13-14B workbook to all appropriate regulatory and oversight agencies as required by AB 1X 26 and AB 1484; and
4. Authorize staff to implement all actions necessary to fulfill all notification and posting requirements as required by AB 1X 26 and AB 1484.
The motion carried (5 – 0) as follows:

10C. Consideration of a request from the La Palma-Cerritos branch of the American Association of University Women regarding its October 16, 2013 School Board candidate's forum. (COUNCIL)

A staff report was given by Brenda Cabrera, Assistant City Clerk.

The Mayor opened the item for public comments. Seeing none, the Mayor closed public comments for this item.

MOTION: It was moved by Pulido and seconded by Ray to:

1. Approve a request from the La Palma-Cerritos branch of the American Association of University Women for the use of the City Council Chambers on Wednesday, October 16, 2013 from 6:00 p.m. to 9:30 p.m. for the purpose of holding a candidates forum for ABC Unified School District Board candidates in the upcoming November election; and
2. For the City to cablecast the forum and waive the cablecast costs.
The motion carried (5 – 0) as follows:

ABSTAIN: None

12. City Council Communications/Committee Reports/Report on Meetings

Reports were provided by Mayor Pro Tem Pulido, Council Members Cho, Ray, Chen and Mayor Barrows.

CONSENSUS (Barrows): Directed staff to bring back information for City Council consideration at a later meeting regarding a moratorium on the sale of electronic vapor cigarettes in the city.

13. ADJOURNMENT

The meeting was adjourned at 9:01 p.m. in memory of Nellie Cardona.
