Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD MARCH 8, 2012

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

Mahesh R. Bhatt, Gayatri Consciousness Center, provided the invocation.

3. PLEDGE OF ALLEGIANCE

Camp Fire USA, Long Beach Area Council, Wa Di Ta Ka Club and Horizon Club led the assembly in the salute to the flag.

4. ROLL CALL

The following Members of the City Council were in attendance:

Councilmember Bruce Barrows
Councilmember Joseph Cho, Ph.D.
Councilmember Mark Pulido
Mayor Pro Tem Jim Edwards
Mayor Carol Chen

5. PRESENTATIONS

Proclamations/Presentations were made as follows: Camp Fire USA, Long Beach Area Council (proclamation and presented cake to Council), Vighnesh Iyer (Distinguished Finalist, 17th Annual Prudential Spirit of Community Awards), and American Red Cross (American Red Cross Awareness Month).

6. Consideration of Appointments to Vacancies on Various Commissions, Boards and Committees

A staff report was provided by Vida Barone, City Clerk.

There were no members of the public who elected to make comments during this item.

Councilmember Cho nominated Samuel Chu to complete the unexpired term on the Property Preservation Commission.

MOTION: It was moved by Councilmember Cho and seconded by Councilmember Pulido to appoint Samuel Chu to complete the unexpired term on the Property Preservation Commission.

The motion carried unanimously.

7. PUBLIC COMMENTS AND SUGGESTIONS

Jay Gray spoke in opposition of the City's position on the Redevelopment Agency.

Chris Fuentes, resident, expressed concerns regarding the recent direction given by the Council relative to the Sculpture Garden.

CONSENT CALENDAR

8A. Approval of Register of Demands

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Edwards to approve the Register of Demands dated March 8, 2012, Checks 131966 through 132244, in the total amount of $5,101,677.09. The motion carried unanimously.

9. Approval of Treasurer's Report for the period ending January 31, 2012

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Edwards to approve the Treasurer's Report for the period ending January 31, 2012. The motion carried unanimously.

10A. Approval of Minutes

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Edwards to approve the Minutes of the Regular Meeting of February 27, 2012. The motion carried unanimously.

11A. Consideration to waive reading of and introduce AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 22.30, OPEN SPACE (OS), OF THE CERRITOS MUNICIPAL CODE BY ADDING MUSEUMS AS A PERMITTED USE.

Consideration to waive reading of and adopt A RESOLUTION OF THE CERRITOS CITY COUNCIL AMENDING THE CERRITOS GENERAL PLAN BY CHANGING THE LAND USE DESIGNATION OF APPROXIMATELY ±1.98 ACRES OF LAND, LOCATED AT 12616 E. 183RD STREET, CERRITOS, CALIFORNIA 90703 (APN 7030-002-902), FROM OFFICE PROFESSIONAL COMMERCIAL TO PUBLIC AND QUASI PUBLIC.

*Pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA), this project is exempt from CEQA review.

A report was given by Ryan Carey, Management Analyst. A PowerPoint Presentation was displayed.

Mayor Chen opened the public hearing and public testimony.

Chris Fuentes, resident, expressed concerns regarding the City spending additional funds to continue litigation against the dissolution of Redevelopment Agencies in California.

Mayor Chen closed public testimony and the public hearing.

MOTION: It was moved by Mayor Pro Tem Edwards and seconded by Councilmember Cho to:

1. Approve Development Code Amendment 2012-1, making the findings set forth in the Cerritos Planning Commission Resolution No. PC 2012-6; and

2. Waive reading of and introduce an ordinance amending the Cerritos Municipal Code by amending Chapter 22.30, Open Space (OS), as set forth in Development Code Amendment 2012-1, captioned:

AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 22.30, OPEN SPACE (OS), OF THE CERRITOS MUNICIPAL CODE BY ADDING MUSEUMS AS A PERMITTED USE; and

3. Approve General Plan Amendment 2012-1, making the findings set forth in the Cerritos Planning Commission Resolution No. PC 2012-7; and

4. Waive reading of and adopt Resolution No. 2012-11 amending the Cerritos General Plan, as set forth in General Plan Amendment 2012-1, captioned:

A RESOLUTION OF THE CERRITOS CITY COUNCIL AMENDING THE CERRITOS GENERAL PLAN BY CHANGING THE LAND USE DESIGNATION OF APPROXIMATELY ±1.98 ACRES OF LAND, LOCATED AT 12616 E. 183RD STREET, CERRITOS, CALIFORNIA 90703 (APN 7030-002-902), FROM OFFICE PROFESSIONAL COMMERCIAL TO PUBLIC AND QUASI PUBLIC, and

5. Approve Development Map Amendment 2012-1, making the findings set forth in the Cerritos Planning Commission Resolution No. PC 2012-8;

6. Waive reading of and introduce an ordinance amending the Cerritos Development Map, as set forth in Development Map Amendment 2012-1, captioned:

Mayor Chen opened the public hearing and public testimony.

Ken Cha, resident, expressed concerns regarding congested traffic in the area surrounding the subject property site.

Chris Fuentes, resident, expressed concerns regarding traffic and economic impacts of the project.

Mayor Chen closed public testimony and the public hearing.

MOTION: It was moved by Mayor Chen and seconded by Mayor Pro Tem Edwards to:

1. Certify and approve the Mitigated Negative Declaration for Development Code Amendment 2012-2, General Plan Amendment 2012-2, and Development Map Amendment 2012-2, which was completed in accordance with the California Environmental Quality Act; and

2. Direct staff to file a Notice of Determination in accordance with Section 3.5 of the Environmental Impact Report Guidelines of the City of Cerritos; and

3. Approve Development Code Amendment 2012-2, making the findings set forth in the Cerritos Planning Commission Resolution No. PC 2012-10; and

4. Waive reading of and introduce an ordinance amending the Cerritos Municipal Code by adding Chapter 22.39, Area Development Plan Fifteen (ADP-15), as set forth in Development Code Amendment 2012-2, captioned:

AN ORDINANCE OF THE CITY OF CERRITOS AMENDING THE CERRITOS MUNICIPAL CODE BY ADDING CHAPTER 22.39, AREA DEVELOPMENT PLAN FIFTEEN (ADP-15), TO ESTABLISH SPECIFIC DEVELOPMENT STANDARDS FOR A VACANT PARCEL LOCATED AT 17501 STUDEBAKER ROAD, CERRITOS, CALIFORNIA 90703 (APN 7034-016-910); and

The motion carried unanimously.

12. Report on Pending Legislation

Art Gallucci, City Manager, provided information on the status of the City's Redevelopment litigation proceedings.

13. City Council Communications/Committee Reports/Report on Meetings

Reports were provided by Councilmembers Cho, Barrows, and Pulido,
Mayor Pro Tem Edwards, and Mayor Chen.

14. ADJOURNMENT

The meeting adjourned at 8:30 p.m. in memory of Patrick Simbol and Myrtle Frantz.
