Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE CERRITOS CITY COUNCIL AND THE SUCCESSOR AGENCY TO THE CERRITOS REDEVELOPMENT AGENCY HELD ON SEPTEMBER 12, 2013

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

The invocation was provided by Dr. Bill Ebling, First Baptist Church of Fullerton.

3. PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was led by Councilmember Ray.

4. ROLL CALL

The following members of the City Council/Successor Agency were in attendance:

6. PUBLIC COMMENTS AND SUGGESTIONS

Matthew Gomez, representing the office of State Senator Ron Calderon, announced upcoming special events in the district.

Chris Foster invited the community to the Special Olympics Tip-a-Cop event.

John Kitos read into the record a community petition regarding the request to remove trees on the 18000 block of Bechard Avenue.

B. J. Singh expressed concerns regarding the statue of Gandhi in the community.

Hansa Patel expressed support for the statue of Gandhi in the community.

Ramesh Patel expressed support for the statue of Gandhi in the community.

Naresh Solanki expressed support for the statue of Gandhi in the community.

Deepak Jhaveri expressed support for the statue of Gandhi in the community.

Ram Kakkar expressed support for the statue of Gandhi in the community.

Ganesh Kahyanaraman expressed support for the statue of Gandhi in the community.

Brinda Gandhi, Artesia, expressed support for the statue of Gandhi in the community.

Hemanj Patel, Corona, expressed support for the statue of Gandhi in the community.

MOTION: It was moved by Chen and seconded by Pulido to approve the Register of Demands dated September 12, 2013 in the total amount of $4,841,080.40. The motion carried (5 – 0) as follows:

7A. City of Cerritos dated September 12, 2013. (SUCCESSOR AGENCY)

MOTION: It was moved by Chen and seconded by Pulido to approve the Register of Demands dated September 12, 2013 in the total amount of $71,936.00. The motion carried (5 – 0) as follows:

8. Approval of Treasurer's Report for the period ending July 31, 2013 (COUNCIL/SUCCESSOR AGENCY)

MOTION: It was moved by Chen and seconded by Pulido to approve the Treasurer's Reports for the period ending July 31, 2013. The motion carried (5 – 0) as follows:

9. Approval of Minutes

MOTION: It was moved by Chen and seconded by Pulido to approve the City Council/Successor Agency Regular Meeting Minutes of August 22, 2013. The motion carried (5 – 0) as follows:

10. NEW AND OLD BUSINESS

10A. Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING THE SUBMITTAL OF AN APPLICATION FOR A GRANT FROM THE LOS ANGELES COUNTY REGIONAL PARK AND OPEN SPACE DISTRICT FOR THE DEVELOPMENT OF BIKE PATHS IN THE CITY OF CERRITOS. (COUNCIL)

A staff report was given by Hal Arbogast, Director of Public Works.

The Mayor opened the item for public comments. Seeing none, the Mayor closed public comments.

MOTION: It was moved by Pulido and seconded by Chen to waive further reading of and adopt Resolution No. 2013-17, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING THE SUBMITTAL OF AN APPLICATION FOR A GRANT FROM THE LOS ANGELES COUNTY REGIONAL PARK AND OPEN SPACE DISTRICT FOR THE DEVELOPMENT OF BIKE PATHS IN THE CITY OF CERRITOS. The motion carried (5 – 0) as follows:

10B. Consideration and award of a contract for the design and construction support services for Supervisory Control and Data Acquisition (SCADA) system upgrade project. (COUNCIL)

A staff report was given by Vince Brar, Senior Assistant City Manager.

The Mayor opened the item for public comments.

Levi Javier commended the Council for finding multiple sources to provide the services referenced in this item and benefiting the residents by going out to bid for services.

Seeing no further members wishing to speak, the Mayor closed public comments on this item.

MOTION: It was moved by Pulido and seconded by Ray to:

1. Make a finding that staff has negotiated fair and reasonable terms for the design and construction support services for the SCADA system upgrade project; and
2. Award a contract for the design and construction support services for the SCADA system upgrade project to Malcolm Pirnie/Arcadis in an amount not to exceed $141,386; and
3. Authorize the City Manager to enter into a contract with Malcolm Pirnie/Arcadis. The motion carried (5 – 0) as follows:

10C. Consideration of a request from the Cerritos Regional Chamber of Commerce regarding its October 9, 2013 School Board candidate's forum. (COUNCIL)

A staff report was given by Vida Barone, City Clerk.

The Mayor opened the item for public comments. Seeing none, the Mayor closed public comments.

MOTION: It was moved by Ray and seconded by Pulido to:

1. Approve a request from the Cerritos Regional Chamber of Commerce for the use of the City Council Chambers on Wednesday, October 9, 2013 from 7:00 p.m. to 9:00 p.m. for the purpose of holding a candidates forum for ABC Unified School District Board candidates in the upcoming November election; and
2. For the City to cablecast the forum and waive the cablecast costs. The motion carried (5 – 0) as follows:

10D. Consideration and authorization for funding of emergency repairs to the City's water line on Del Amo Boulevard. (COUNCIL)

A staff report was given by Vince Brar, Senior Assistant City Manager.

The Mayor opened the item for public comments. Seeing none, the Mayor closed public comments.

MOTION: It was moved by Chen and seconded by Pulido to:

1. Waive reading of and adopt RESOLUTION NO. 2013-18, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS AUTHORIZING STAFF TO FOREGO THE FORMAL BIDDING PROCESS FOR EXPEDITED WATER LINE REPAIRS BECAUSE OF THE URGENT NECESSITY FOR THE PRESERVATION OF LIFE, HEALTH, OR PROPERTY; and
2. Approve the expenditure of $125,000 for the emergency repairs to the water line and valves on Del Amo Boulevard. The motion carried (5 – 0) as follows:

The Mayor reopened the public comments period.

Bhajan S. Binder, Manteca, expressed concerns regarding the statue of Gandhi in the community.

Pieter Singh, Sacramento, expressed concerns regarding the statue of Gandhi in the community.

The Mayor closed public comments.

12. City Council Communications/Committee Reports/Report on Meetings

Reports were provided by Council Members Chen, Cho, and Ray, Mayor Pro Tem Pulido and Mayor Barrows.

13. Closed Session

The Mayor announced that items 13B, 13C, and 13D would not be considered in the Closed Session and would be deferred to a future date.

Mark Steres, City Attorney, announced the closed session item to be discussed as 13A on tonight's agenda.

Report from Closed Session

Mark Steres, City Attorney, made the following report from Closed Session where the City Council members considered Item 13A only:

MOTION: It was moved by Pulido and seconded by Chen, in regards to Item 13A on the Closed Session agenda, to authorize the initiation of litigation against the State Controller's Office pending the outcome of the final report to be issued by the State Controller's Office. The motion carried (5 – 0) as follows:

ABSTAIN: None

14. ADJOURNMENT
