Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE CERRITOS CITY COUNCIL AND THE SUCCESSOR AGENCY TO THE CERRITOS REDEVELOPMENT AGENCY HELD ON AUGUST 22, 2013

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

The invocation was provided by former Mayor/Councilmember Jim Edwards

3. PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was led by Boy Scout Troop 693.

4. ROLL CALL

The following members of the City Council/Successor Agency were in attendance:

1st Combat Engineer Battalion (CEB) Adoption Committee (framed photograph of 1st Marine Division Headquarters in Camp Pendleton from the 1st CEB).

5B. Consideration of appointments to Commissions, Committees, and Boards.

MOTION: It was moved by Ray and seconded by Pulido to approve the appointment of Philip Hickok to the Property Preservation Commission. The motion carried (5 – 0) as follows:

Matthew Gomez, representing Ronald Calderon, introduced himself to the Council and the community.

7. Approval of Register of Demands

7A. City of Cerritos dated August 22, 2013. (COUNCIL)

MOTION: It was moved by Pulido and seconded by Cho to approve the Register of Demands dated August 22, 2013 in the total amount of $1,903,310.65. The motion carried (5 – 0) as follows:

8. Approval of Minutes

8A. City Council/Successor Agency Regular Meeting of August 8, 2013. (COUNCIL/SUCCESSOR AGENCY)

MOTION: It was moved by Pulido and seconded by Cho to approve the City Council/Successor Agency Regular Meeting Minutes of August 8, 2013. The motion carried (5 – 0) as follows:

9. PUBLIC HEARINGS

9A. Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS FINDING THE CITY IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE 2013 CMP LOCAL DEVELOPMENT REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089. (COUNCIL)

A staff report was given by Rebecca Scott, Management Analyst.

The Mayor opened the item for public comments. Seeing none, the Mayor closed public comments.

MOTION: It was moved by Ray and seconded by Pulido to waive further reading of and adopt Resolution No. 2013-16, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS FINDING THE CITY IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE 2013 CMP LOCAL DEVELOPMENT REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089. The motion carried (5 – 0) as follows:

10. NEW AND OLD BUSINESS

10A. Consideration and award of a contract for Cerritos Library exterior painting, Project No. 12086, Bid No. 1161-14. (COUNCIL)

A staff report was given by Hal Arbogast, Director of Public Works.

The Mayor opened the item for public comments. Seeing none, the Mayor closed public comments.

MOTION: It was moved by Chen and seconded by Pulido to award a contract in the amount of $38,700 to Cinbad Industry, Inc. for Cerritos Library Exterior Painting, Project No. 12086, Bid No. 1161-14, and reject all other bids. The motion carried (5 – 0) as follows:

ABSTAIN: None

10B. Review of the 2014 City Council/Successor Agency meeting dates and possible rescheduling of dates conflicting with holidays and/or other events. (COUNCIL)

MOTION: It was moved by Pulido and seconded by Cho to approve the following modifications to the 2014 City Council/Successor Agency meeting dates:

10C. Consideration and request for support of Groundwater Storage Program. (COUNCIL)

A staff report was given by Vince Brar, Senior Assistant City Manager.

Patty Quilzapa, representing the City's special counsel Aleshire & Wynder, was introduced and provided an overview of the groundwater storage litigation and various related legal matters.

The Mayor opened the item for public comments.

Paul Bellenbaum inquired as to the status of water storage in Cerritos.

The Mayor closed public comments.

MOTION: It was moved by Cho and seconded by Ray that the City Council:
1. Support moving forward with the proposed 2013 Third Amended Judgment for Groundwater Storage in the Central Basin; and
2. Authorize the Mayor to execute the letter supporting the proposed Third Amendment to Judgment in Central Basin in a form acceptable to the City Attorney; and
3. Authorize counsel to file the necessary documents to seek court approval of the proposed Third Amended Judgment; and
4. Direct staff to return with a separate report regarding a potential feasibility study regarding the ability to "inject" water. The motion carried (5 – 0) as follows:

11. Legislative Items

11A. Report on Pending Legislation

None.
