Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE CERRITOS CITY COUNCIL AND THE SUCCESSOR AGENCY TO THE CERRITOS REDEVELOPMENT AGENCY HELD ON MAY 9, 2013

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

The invocation was provided by Dr. Delwin McCarthy, with the Church of Jesus Christ of Latter Day Saints.

3. PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was led by Girl Scout Troop 1433.

4. ROLL CALL

The following members of the City Council/Successor Agency were in attendance:

6. PUBLIC COMMENTS AND SUGGESTIONS

Ralph Westfall, resident, expressed concerns with financial losses at the Cerritos Center for the Performing Arts and requested that financial information be posted to the City website.

Chit Yokoyama, resident, expressed concerns regarding the non-reappointment of Frank Yokoyama to the Planning Commission.

Ndeep Bashen, resident, expressed concerns regarding the non-reappointment of Frank Yokoyama to the Planning Commission.

Nikki Noushkam, resident, expressed concerns regarding the non-reappointment of Frank Yokoyama to the Planning Commission.

Dan Nino, resident, expressed concerns regarding the non-reappointment of Frank Yokoyama to the Planning Commission.

Byron Costa, Seal Beach, spoke regarding alleged harassment by Sheriff's in Cerritos.

Bill Rabbe, former Cerritos educator, expressed concerns regarding the non-reappointment of Frank Yokoyama to the Planning Commission.

Pete Benzon, resident, expressed concerns regarding the non-reappointment of Frank Yokoyama to the Planning Commission.

Paul Bellenbaum, former resident, inquired regarding an ongoing arson investigation.

CONSENT CALENDAR

7. Approval of Register of Demands

7A. City of Cerritos dated May 9, 2013 (COUNCIL)

MOTION: It was moved by Ray and seconded by Chen to approve the Register of Demands dated May 9, 2013 in the total amount of $6,593,797.23. The motion carried (5 – 0) as follows:

AYES: Chen, Cho, Ray, Pulido, Barrows
NOES: None
ABSENT: None
ABSTAIN: None

7B. Successor Agency dated May 9, 2013 (SUCCESSOR AGENCY)

MOTION: It was moved by Ray and seconded by Chen to approve the Register of Demands dated May 9, 2013 in the total amount of $3,597,096.86. The motion carried (5 – 0) as follows:

AYES: Chen, Cho, Ray, Pulido, Barrows
NOES: None
ABSENT: None
ABSTAIN: None

8. Approval of Treasurer's Report for the period ending March 31, 2013 (COUNCIL/SUCCESSOR AGENCY)

MOTION: It was moved by Ray and seconded by Chen to approve the Treasurer's Report for the period ending March 31, 2013. The motion carried (5 – 0) as follows:

AYES: Chen, Cho, Ray, Pulido, Barrows
NOES: None
ABSENT: None
ABSTAIN: None

9. Approval of Minutes

9A. City Council/Successor Agency Regular Meeting of April 25, 2013. (COUNCIL/SUCCESSOR AGENCY)

MOTION: It was moved by Ray and seconded by Chen to approve the City Council/Successor Agency Regular Meeting Minutes of April 25, 2013, as revised. The motion carried (5 – 0) as follows:

AYES: Chen, Cho, Ray, Pulido, Barrows
NOES: None
ABSENT: None
ABSTAIN: None

10. PUBLIC HEARINGS

10A. An informational report to the City Council regarding a proposed adult residential care facility for three (3) disabled persons at an existing single-family residence located at 16643 Estella Avenue. The subject property is zoned Single-Family Residential (RS-6500) (APN 7016-012-038). (COUNCIL)

A staff report was given by Robert A. Lopez, Current Planning Manager. A PowerPoint Presentation was displayed.

The Mayor opened the public hearing and public comments.

Richard Stile, Estella Street resident, expressed concerns regarding the safety of other residents in the area near the project.

Colleen Mauk, Harbor Regional Center, identified herself and affirmed she would assist anyone with inquiries regarding the Center's services.

Paul Bellenbaum, former resident, commented on temporary facilities for social services in the community.

The Mayor closed public comments and the public hearing.

MOTION: It was moved by Ray and seconded by Pulido to receive and file the report. The motion carried (5 – 0) as follows:

11. NEW AND OLD BUSINESS

11A. Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS AUTHORIZING THE ALLOCATION OF FISCAL YEAR 2013-2014 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS TO IMPROVE ACCESSIBILITY TO PLAYGROUND EQUIPMENT AT HERITAGE PARK, CERRITOS REGIONAL SPORTS COMPLEX, GONSALVES PARK AND FRIENDSHIP PARK. (COUNCIL)

A staff report was given by Eduardo Vega, Associate Planner.

MOTION: It was moved by Pulido and seconded by Chen to waive reading of and adopt Resolution No. 2013-9, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS AUTHORIZING THE ALLOCATION OF FISCAL YEAR 2013-2014 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS TO IMPROVE ACCESSIBILITY TO PLAYGROUND EQUIPMENT AT HERITAGE PARK, CERRITOS REGIONAL SPORTS COMPLEX, GONSALVES PARK AND FRIENDSHIP PARK.

The motion carried (5 – 0) as follows:

12B1. Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS TO SUPPORT SB 33 (WOLK) TO AMEND, REPEAL AND ADD CERTAIN SECTIONS TO THE GOVERNMENT CODE SECTION 53395.ET SEQ. RELATING TO INFRASTRUCTURE FINANCING DISTRICTS. (COUNCIL)

A staff report was given Kathy Matsumoto, Assistant City Manager.

MOTION: It was moved by Barrows and seconded by Cho to continue this item until additional research can be conducted. The motion carried (5 – 0) as follows:

13. City Council Communications/Committee Reports/Report on Meetings

Reports were provided by Council Members Cho, Chen, and Ray, Mayor Pro Tem Pulido and Mayor Barrows.

CONSENSUS (Pulido): Directed staff to incorporate City historical events into planning for upcoming Community Spring Festivals.

14. Closed Session

14A. PERSONNEL MATTERS PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 54957.6: CONFERENCE WITH LABOR NEGOTIATORS

The City Council did not meet in Closed Session nor discuss item 14A regarding personnel matters.
