Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE CERRITOS CITY COUNCIL AND THE SUCCESSOR AGENCY TO THE CERRITOS REDEVELOPMENT AGENCY HELD ON APRIL 11, 2013

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

The invocation was provided by Councilmember George Ray.

3. PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was led by Mayor Pro-Tem Pulido.

4. ROLL CALL

The following members of the City Council/Successor Agency were in attendance:

6. PUBLIC COMMENTS AND SUGGESTIONS

Katherine Chu, resident, spoke regarding autism awareness.

Cindy Yen Chen, resident, thanked the Council for the reappointment to the Parks and Recreation Commission and expressed concerns regarding the Council's actions related to Mayor Pro Tem Pulido's nominee to the Planning Commission.

Levi Javier, resident, expressed concerns regarding the Council's actions related to Mayor Pro Tem Pulido's nominee to the Planning Commission.

Pete Benzon, resident, expressed concerns regarding the Council's actions related to Mayor Pro Tem Pulido's nominee to the Planning Commission.

Carmelita Lampino, resident, thanked the Council for her reappointment to the Let Freedom Ring Committee and expressed concerns regarding the Council's actions related to Mayor Pro Tem Pulido's nominee to the Planning Commission.

At 7:48 p.m., Mayor Pro Tem Pulido left the dais and the Chamber

Brenda Spence, representing Joy Pre School, expressed concerns regarding human resources concerns at a local non-profit organization.

Chris Foster, resident, introduced a student, Justin, who participates in the Adaptive Recreation Program and commented on the Adaptive Recreation Program.

7. Approval of Register of Demands

7A. City of Cerritos dated April 11, 2013 (COUNCIL)

MOTION: It was moved by Chen and seconded by Cho to approve the Register of Demands dated April 11, 2013 in the total amount of $8,694,758.47. The motion carried (4 – 0) as follows:

7B. City of Cerritos dated April 11, 2013 (SUCCESSOR AGENCY)

MOTION: It was moved by Chen and seconded by Cho to approve the Register of Demands dated April 11, 2013 in the total amount of $71,000.00. The motion carried (4 – 0) as follows:

9B. City Council/Successor Agency Special Meeting of March 26, 2013 (COUNCIL)

MOTION: It was moved by Chen and seconded by Cho to approve the City Council Special Meeting Minutes of March 26, 2013. The motion carried (4 – 0) as follows:

10. Ordinance for second reading and adoption. Reading of ordinance waived at introduction.

10A. AN ORDINANCE OF THE CITY OF CERRITOS DETERMINING AND DECLARING PRIMA FACIE SPEED LIMITS ON CERTAIN STREETS IN THE CITY OF CERRITOS AND AMENDING CHAPTER 10.04 OF THE CERRITOS MUNICIPAL CODE. (COUNCIL)

MOTION: It was moved by Chen and seconded by Cho to approve Ordinance No. 974, AN ORDINANCE OF THE CITY OF CERRITOS DETERMINING AND DECLARING PRIMA FACIE SPEED LIMITS ON CERTAIN STREETS IN THE CITY OF CERRITOS AND AMENDING CHAPTER 10.04 OF THE CERRITOS MUNICIPAL CODE. The motion carried (4 – 0) as follows:

11. PUBLIC HEARINGS

11A. Consideration and review of a proposal by Southern California Edison to expand a substation in Cerritos and install new equipment at various locations within public right-of-ways throughout the City. (COUNCIL)

A staff report was given by Kanna Vancheswaran, Assistant City Engineer. Representatives from Southern California Edison narrated and displayed a PowerPoint Presentation.

The Mayor opened public comments and the public hearing.

Levi Javier, resident, inquired as to whether CEQA guidelines were required on this project.

Paul Bellenbaum, resident, inquired as to who will be funding the Southern California Edison project.

MOTION: It was moved by Ray and seconded by Cho to receive and file the report. The motion carried (4 – 0) as follows:

12. NEW AND OLD BUSINESS

12A. Review and consideration of a proposal to enter into a non-binding letter of intent with the Cerritos Auto Dealer's Association for the contribution of funds to facilitate the renovation and upgrade of the Cerritos Auto Square Freeway Sign located at 18800 Studebaker Road (APN 7038-013-015). (COUNCIL)

A staff report was given by Ryan Carey, Management Analyst. A PowerPoint Presentation was displayed.

Dave Conant, resident of Newport Beach, representing the Auto Square Dealer's Association spoke in support of the Letter of Intent and made suggestions as to the City's contribution toward the sign.

Gerad Valencia, resident, expressed concerns with the City's use percentage for the proposed renovated and upgraded Cerritos Auto Square freeway sign.

MOTION: It was moved by Cho and seconded by Chen to:

1. Approve the Letter of Intent as drafted; and
2. Authorize the City Manager, or his designee, to further negotiate with representatives of the Cerritos Auto Square Dealer's Association to develop a formal agreement for the City's contribution for the upgrade and renovation of Auto Square Freeway Sign for review and approval by the City Council. The motion carried (4 – 0) as follows:

MOTION: It was moved by Ray and seconded by Chen to honor the existing negotiation with the newest auto dealer regarding the Art in Public Places Program and require that any further new projects in the Auto Mall would be required to contribute to the Art in Public Places fund until the fund was repayed. The motion carried (4 – 0) as follows:

12B. Consideration and review of City Protocol Manual. (COUNCIL/SUCCESSOR AGENCY)

A staff report was given by Vida Barone, City Clerk.

MOTION: It was moved by Barrows and seconded by Ray to approve the Protocol Manual with the approved changes and include the appropriate Attorney advice language. The motion carried (4 – 0) as follows:

13. Legislative Items

13A. Report on Pending Legislation

None.

13B. Action to support or oppose specific legislation pending in the California Legislature or pending in the California Governor's Office for signature.

13B1. Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS TO OPPOSE AB 162 (HOLDEN) TO ADD SECTION 65964.5 TO THE GOVERNMENT CODE RELATING TO TELECOMMUNICATIONS FACILITIES. (COUNCIL)

MOTION: It was moved by Barrows and seconded by Chen to:

1. Approve Resolution No. 2013-7, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS TO OPPOSE AB 162 (HOLDEN) TO ADD SECTION 65964.5 TO THE GOVERNMENT CODE RELATING TO TELECOMMUNICATIONS FACILITIES.
2. Direct staff to transmit copies of said resolution to the Assembly Local Government Committee, Assemblymember Holden, Assemblymember Garcia, Senator Ron Calderon, League of California Cities, California Contract Cities, gateway Cities Council of Governments and Gonsalves & Son. The motion carried (4 – 0) as follows:
