Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE CERRITOS CITY COUNCIL AND THE SUCCESSOR AGENCY TO THE CERRITOS REDEVELOPMENT AGENCY AND A SPECIAL MEETING OF THE CERRITOS PUBLIC FINANCING AUTHORITY HELD ON JANUARY 10, 2013

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

The invocation was provided by Delwin McCarthy, Church of Jesus Christ of Latter Day Saints.

3. PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was led by Boy Scout Troop 394.

4. ROLL CALL

The following members of the City Council/Successor Agency/Board were in attendance:

CONSENT CALENDAR

7. Approval of Register of Demands

7A. City of Cerritos dated January 10, 2013 (COUNCIL)

MOTION: It was moved by Pulido and seconded by Barrows to approve the Register of Demands dated January 10, 2013 in the total amount of $4,542,836.42. The motion carried unanimously.

7B. Successor Agency dated January 10, 2013 (SUCCESSOR AGENCY)

MOTION: It was moved by Pulido and seconded by Barrows to approve the Register of Demands dated January 10, 2013 in the total amount of $10,386,094.01. The motion carried unanimously.

8. Approval of Minutes

8A. City Council/Successor Agency Regular Meeting and Cerritos Public Financing Authority Special Meeting of December 13, 2012 (COUNCIL/SUCCESSOR AGENCY/FINANCING AUTHORITY)

MOTION: It was moved by Pulido and seconded by Barrows to approve the City Council/Successor Agency Regular Meeting and Cerritos Public Financing Authority Special Meeting Minutes of December 13, 2012. The motion carried unanimously.

9. PUBLIC HEARINGS

9A. A proposal by Select Comfort Corporation on behalf of the property owner to remodel the interior and exterior of the existing commercial building and to refurbish the existing landscape on the property located at 11400 South Street, Cerritos, California, 90703. The subject property is zoned Regional Commercial (CR) (APN 7039-021-017). (COUNCIL)

A staff report was given by Sandy Cisneros, Senior Planner. A PowerPoint Presentation was displayed.

The Mayor opened the public hearing and public comments.

Robert Neimann, one of the owners of the subject property, spoke in support of the proposed tenant.

The Mayor closed public comments and the public hearing.

MOTION: It was moved by Chen and seconded by Pulido to approve Precise Plan 78-13(A)(2012) Amendment, making the findings set forth in Cerritos Planning Commission Resolution No. 2012-35. The motion carried unanimously.

10. NEW AND OLD BUSINESS

10A. Consideration and approval of a tri-party completion agreement between the Successor Agency to the Cerritos Redevelopment Agency, Great American Insurance Company and Sea West Enterprises, Inc. with respect to the Cerritos Sheriff's Station expansion, Project No. 72103, Bid No. 1081-09, for the correction of exterior stone veneer panels, in satisfaction of Performance Bond No. 5457192. (SUCCESSOR AGENCY)

A staff report was given by Kanna Vancheswaran, Assistant City Engineer.

MOTION: It was moved by Barrows and seconded by Pulido to ratify and approve a Tri-Party Agreement between the Successor Agency to the Cerritos Redevelopment Agency, Great American Insurance Company and Sea West Enterprises, Inc. with respect to the Cerritos Sheriff's Station Expansion, Project No. 72103, Bid No. 1081-09, for the correction of exterior stone veneer panels, in satisfaction of Performance Bond No. 5457192. The motion carried unanimously.

10B. Consideration of the City of Cerritos' Comprehensive Annual Financial Report for fiscal year 2011-12.

Consideration of the former Cerritos Redevelopment Agency's basic financial statements for the seven months ended January 31, 2012.

Consideration of the Successor Agency to the Cerritos Redevelopment Agency's basic financial statements for the five months ended June 30, 2012. (COUNCIL/SUCCESSOR AGENCY)

A staff report was given by Nita McKay, Finance Manager.

Paul Bellenbaum, resident, inquired as to any existing debt on the construction of the Cerritos Library.

MOTION: It was moved by Barrows and seconded by Chen that the:

1. Cerritos City Council receive and file the Fiscal year 2011-12 City of Cerritos Comprehensive Annual Financial Report (COUNCIL);
2. Cerritos City Council receive and file the Cerritos Redevelopment Agency Basic Financial Statements for the Seven Months Ended January 31, 2012;
3. Successor Agency to the Cerritos Redevelopment Agency receive and file the Basic Financial Statements for the Five Months Ended June 30, 2012 for the Successor Agency to the Cerritos Redevelopment Agency. The motion carried unanimously.

11. Legislative Items

11A. Report on Pending Legislation

Art Gallucci, City Manager, provided a report on potential legislation regarding "No/Low" tax cities.

CONSENSUS (Chen): Directed staff to prepare a letter of opposition from the Council, as well as have staff attend an upcoming Los Angeles County Board of Supervisors hearing on stormwater runoff scheduled for Tuesday, January 15, 2013.

11B. Action to support or oppose specific legislation pending in the California Legislature or pending in the California Governor's Office for signature.

None.

12. City Council Communications/Committee Reports/Report on Meetings

Reports were provided by Councilmembers Pulido, Cho, and Chen, Mayor Pro Tem Barrows and Mayor Edwards.

13. ADJOURNMENT

The meeting adjourned at 8:11 p.m.
