Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD MAY 24, 2012

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

The invocation was provided by Dr. Brian Suk-Boo Lee, Artesia-Cerritos United Methodist Church.

3. PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was led by Boy Scout Pack 81.

4. ROLL CALL

The following members of the City Council were in attendance:

Councilmember Joseph Cho, Ph.D.
Councilmember Mark Pulido
Mayor Pro Tem Bruce Barrows
Mayor Jim Edwards

5. PRESENTATIONS

Proclamations were presented to; B & B Stables (Business Spotlight), Wittmann Elementary School (2012 Cerritos City Wide Pride Program), and the Cerritos High School Model United Nations Team (38th Annual National High School Model United Nations Conference).

6. PUBLIC COMMENTS AND SUGGESTIONS

CONSENT CALENDAR

7. Approval of Register of Demands

7A. City of Cerritos dated May 24, 2012 (COUNCIL)

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Barrows to approve the Register of Demands dated May 24, 2012, Checks 133620 through 133911, in the total amount of $4,578,084.49. The motion carried unanimously.

8. Approval of Minutes

8A. City Council Regular Meeting of May 10, 2012

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Barrows to approve the City Council Regular Meeting Minutes of May 10, 2012. The motion carried unanimously.

9. Ordinance for second reading and adoption. Reading of ordinance waived at introduction.

9A. ORDINANCE NO. 970 - AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 2.16 OF THE CERRITOS MUNICIPAL CODE TO CHANGE THE REGULAR CERRITOS PLANNING COMMISSION MEETING FREQUENCY FROM TWO MEETINGS PER MONTH TO ONE MEETING PER MONTH WITH A SECOND MONTHLY MEETING ADDED ON AN AS-NEEDED BASIS. (COUNCIL)

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Barrows to waive reading of and adopt Ordinance No. 970, AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 2.16 OF THE CERRITOS MUNICIPAL CODE TO CHANGE THE REGULAR CERRITOS PLANNING COMMISSION MEETING FREQUENCY FROM TWO MEETINGS PER MONTH TO ONE MEETING PER MONTH WITH A SECOND MONTHLY MEETING ADDED ON AN AS-NEEDED BASIS. The motion carried unanimously.

10. PUBLIC HEARINGS

10A. An appeal of an action of the Cerritos Planning Commission approving a residential development proposal by the property owner to construct a first-floor addition and a new second floor to an existing, one-story residence at 12320 Elgers Street, Cerritos, California, 90703. The subject property is zoned single-family residential (RS-5000) (APN 7025-025-033). (COUNCIL)

Precise Plan 2012-3*

*Pursuant to Section 15301 of the California Environmental Quality Act (CEQA), this project is categorically exempt.

A staff report was presented by Robert A. Lopez, Current Planning Manager. A PowerPoint Presentation was displayed.

The Mayor opened the public hearing and public comments.

The appellant, Tippie Helliwell, explained her opposition to the proposed remodel and presented photographs to the Council.

The Mayor closed public comments and the public hearing.

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Chen to deny the appeal of Precise Plan 2012-3 and uphold the approval of the project by the Planning Commission (a residential development proposal by the property owner to construct a first-floor addition and a new second floor to an existing, one-story residence at 12320 Elgers Street, Cerritos, California, 90703). The motion carried unanimously.

11. PUBLIC WORKS ACTIVITIES

11A. Consideration and award of contract for ongoing electrical maintenance for the City of Cerritos. (COUNCIL)

A staff report was presented by Hal Arbogast, Director of Public Works.

Paul Bellenbaum, resident, inquired if any of the proposed contractors had their place of business located in Cerritos.

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to award contracts for ongoing electrical maintenance for the City of Cerritos to Harry W. Dantema of Cerritos, Sutton Electric of Mission Viejo, and Service 1st Contractors of Costa Mesa. The motion carried unanimously.

12. NEW AND OLD BUSINESS

12A. A request by applicant Conant Properties V, L.P., 20322 Southwest Acacia Street, Suite 100, Newport Beach, California, 92660, for a time extension to previously approved Conditional Use Permit 2011-6 for an automobile reconditioning facility, which will include minor auto mechanical repair and detailing operations to prepare pre-owned automobiles for off-site sale in the Cerritos Auto Square. The property is located at 17720 Studebaker Road, Cerritos, California 90703, and is zoned Industrial/Commercial (MC) (APN 7034-016-037). (COUNCIL)

A staff report was provided by Robert A. Lopez, Current Planning Manager.

MOTION: It was moved by Councilmember Chen and seconded by Mayor Pro Tem Barrows to approve an 18-month time extension, ending on June 8, 2013, for Conditional Use Permit 2011-6, making the findings set forth in Resolution No. PC 2012-19. The motion carried unanimously.

12B. Consideration and award of contract for maintenance and re-patination of certain artwork located in the Cerritos Civic Center, generally located on the Northwest Corner of Bloomfield Avenue and 183rd Street (APN 7025-028-906 and 7025-028-908). (COUNCIL)

A staff report was provided by Kathy Matsumoto, Assistant City Manager. A PowerPoint Presentation was displayed.

Ram Kakkar, resident, commented on the dolphin sculpture located outside of City Hall.

Paul Bellenbaum, resident, commented on the length of time before the sculpture would require additional maintenance.

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Chen to:

1. Find that contracting with National Sculptors' Build is in the best interest of the City, that dispensing with the bidding process satisfies the purposes of the purchasing ordinance of the Cerritos Municipal Code, and that it is reasonable and necessary to sole source the repatination of Amaryllis and the Dolphins; and
2. Authorize the City Manager to execute a contract with National Sculptors' Guild for the proposed services in the amount of $19,000 for the Amaryllis sculptures and $9,750 for the Dolphins Sculptures subject to the approval of the City Council, and
3. Authorize the expenditure of $5,000 to provide for the added costs per the bids for the City to support these projects. The motion carried unanimously.
