Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD MARCH 22, 2012

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

Brother Delwin K. McCarthy with the Church of Jesus Christ of Latter Day Saints provided the invocation.

3. PLEDGE OF ALLEGIANCE

Boy Scout Troop 394 led the assembly in the salute to the flag.

4. ROLL CALL

The following members of the City Council were in attendance:

Councilmember Joseph Cho, Ph.D.
Councilmember Mark Pulido
Mayor Pro Tem Bruce Barrows
Mayor Jim Edwards

5. PRESENTATIONS

Proclamations/Presentations were made as follows: Diane Padleford-Young accepted for A.J. Padelford & Son, Inc. spotlighted as part of the City's Business Recognition Program, Matthew John Igñacio, and Maxim Eshkenazy for their efforts in organizing the Philippine Typhoon Relief Concert, The Colburn School Chamber Orchestra for their participation in the Philippine Typhoon Relief Concert, and to Katherine Chu and Cerritos parents and children in honor of World Autism Awareness Day.

6. PUBLIC COMMENTS AND SUGGESTIONS

Chris Foster, resident, expressed his appreciation to the Council for their effort in highlighting Autism awareness this evening.

CONSENT CALENDAR

7A. Approval of Register of Demands

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to approve the Register of Demands dated March 22, 2012, Checks 132248 through 132607, in the total amount of $9,169,624.07. The motion carried unanimously.

8. Approval of Treasurer's Report for the period ending February 29, 2012.

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to approve the Treasurer's Report for the period ending February 29, 2012. The motion carried unanimously.

9. Approval of Minutes

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to approve the Minutes of the Regular Meeting of March 8, 2012. The motion carried unanimously.

10. Ordinances for second reading and adoption. Reading of ordinances waived and ordinances adopted.

10A. ORDINANCE NO. 965 - AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 22.30, OPEN SPACE (OS), OF THE CERRITOS MUNICIPAL CODE BY ADDING MUSEUMS AS A PERMITTED USE.

MOTION:
It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to waive reading of and adopt Ordinance No. 965 entitled AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 22.30, OPEN SPACE (OS), OF THE CERRITOS MUNICIPAL CODE BY ADDING MUSEUMS AS A PERMITTED USE. The motion carried unanimously.

10B. ORDINANCE NO. 966 - AN ORDINANCE OF THE CITY OF CERRITOS AMENDING THE CERRITOS DEVELOPMENT MAP BY CHANGING THE ZONE CLASSIFICATION OF APPROXIMATELY ±1.98 ACRES OF LAND, LOCATED AT 12616 E. 183RD STREET, CERRITOS, CALIFORNIA 90703 (APN 7030-002-902), FROM COMMERCIAL OFFICE PROFESSIONAL (COP) TO OPEN SPACE (OS).

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to waive reading of and adopt Ordinance No. 966 entitled AN ORDINANCE OF THE CITY OF CERRITOS AMENDING THE CERRITOS DEVELOPMENT MAP BY CHANGING THE ZONE CLASSIFICATION OF APPROXIMATELY ±1.98 ACRES OF LAND, LOCATED AT 12616 E. 183RD STREET, CERRITOS, CALIFORNIA 90703 (APN 7030-002-902), FROM COMMERCIAL OFFICE PROFESSIONAL (COP) TO OPEN SPACE (OS). The motion carried unanimously.

10C. ORDINANCE NO. 967 - AN ORDINANCE OF THE CITY OF CERRITOS AMENDING THE CERRITOS MUNICIPAL CODE BY ADDING CHAPTER 22.39, AREA DEVELOPMENT PLAN FIFTEEN (ADP-15), TO ESTABLISH SPECIFIC DEVELOPMENT STANDARDS FOR A VACANT PARCEL LOCATED AT 17501 STUDEBAKER ROAD, CERRITOS, CALIFORNIA 90703 (APN 7034-016-910).

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to waive reading of and adopt Ordinance No. 967 entitled AN ORDINANCE OF THE CITY OF CERRITOS AMENDING THE CERRITOS MUNICIPAL CODE BY ADDING CHAPTER 22.39, AREA DEVELOPMENT PLAN FIFTEEN (ADP-15), TO ESTABLISH SPECIFIC DEVELOPMENT STANDARDS FOR A VACANT PARCEL LOCATED AT 17501 STUDEBAKER ROAD, CERRITOS, CALIFORNIA 90703 (APN 7034-016-910). 10D. ORDINANCE NO. 968 - AN ORDINANCE OF THE CITY OF CERRITOS AMENDING THE CERRITOS DEVELOPMENT MAP BY CHANGING THE ZONE CLASSIFICATION OF APPROXIMATELY ±1.07 ACRES OF LAND, LOCATED AT 17501 STUDEBAKER ROAD, CERRITOS, CALIFORNIA 90703 (APN 7034-016-910), FROM OPEN SPACE (OS) TO AREA DEVELOPMENT PLAN FIFTEEN (ADP-15).

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to waive reading of and adopt Ordinance No. 968 entitled AN ORDINANCE OF THE CITY OF CERRITOS AMENDING THE CERRITOS DEVELOPMENT MAP BY CHANGING THE ZONE CLASSIFICATION OF APPROXIMATELY ±1.07 ACRES OF LAND, LOCATED AT 17501 STUDEBAKER ROAD, CERRITOS, CALIFORNIA 90703 (APN 7034-016-910), FROM OPEN SPACE (OS) TO AREA DEVELOPMENT PLAN FIFTEEN (ADP-15). The motion carried unanimously.

11. Miscellaneous

11A. Consideration and award of Bid No. 1133-12, Cerritos Center for the Performing Arts Mailing List Acquisition Services.

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to award Bid No. 1133-12 to Towne Inc. of Santa Ana for the Cerritos Center for the Performing Arts Mailing List Acquisition Services. The motion carried unanimously.

11B. Consideration and award of Bid No. 1137-12, Printing of the Cerritos Center for the Performing Arts 2012-2013 Season Brochures.

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to award Bid No. 1137-12 to Southwest Offset Printing in the amount of $130,301.63 for the printing of the Cerritos Center for the Performing Arts 2012-2013 Season Brochures. The motion carried unanimously.

END OF CONSENT CALENDAR

PENDING LEGAL MATTERS

12A. Consideration to waive reading of and introduce an ordinance prohibiting registered sex offenders in city parks.

A report was presented by Director of Community Safety, Greg Berg.

Mayor Edwards, Mayor Pro Tem Barrows, Councilmember Cho, Councilmember Chen, and Councilmember Pulido all commented regarding: incorporating both ordinances into one, required registration for offenders, ability to enforce the ordinance, include the Library in the ordinance, include other Cerritos facilities, and what type of ordinances surrounding cities have in reference to sex offenders and libraries.

City Attorney Steres commented there have been no legal challenges on either ordinance, and recommended adopting the broader of the two Ordinances.

Mayor Edwards opened the item for public comments. There were no responses and public comments were closed.

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to table the item to a later date, and come back to Council with a more comprehensive and broader ordinance to include the Library, public buildings and open space areas. The motion carried unanimously.

NEW AND OLD BUSINESS

13A. Appointments to the Oversight board of the Successor Agency to the City of Cerritos Redevelopment Agency.

A report was presented by Management Analyst Ryan Carey.

Mayor Edwards opened the item for public comments. There were no responses and public comments were closed.

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to approve the appointment of Mayor Edwards, and City Manager Gallucci as the Oversight board members, and at the suggestion of City Manager Gallucci, Director of Community Development, Torrey Contreras, as the alternate. The motion carried unanimously.

13B. Consideration of City Council Committee Assignments.

A report was given by Mayor Jim Edwards.

Mayor Edwards opened the item for public comments.

There were no responses and public comments were closed.

MOTION: It was moved by Councilmember Pulido, and seconded by Mayor Pro Tem Barrows to approve the Mayors proposed City Council Committee Assignments. The motion carried unanimously.

PUBLIC WORKS ACTIVITIES

14A. Consideration and award of a design services contract for Cerritos Park East Restroom Rehabilitation, 13234 E. 166th Street, Cerritos, California 90703 (APN 7008-001-900).

A report was presented by Assistant City Engineer Kanna Vancheswaran.

Mayor Edwards opened the item for public comments. There were no responses and public comments were closed.

MOTION: It was moved by Councilmember Pulido and seconded by Councilwoman Chen to approve to award a design services contract for Cerritos Park East Restroom Rehabilitation to CWI AIA, Inc., in the amount of $31,400. The motion carried unanimously.

14B. Consideration and award of contract for the Construction of Street Improvements in Residential Streets, Project No. 14088-12, Bid No. 1139-12.

A report and PowerPoint were presented by Assistant City Engineer Kanna Vancheswaran.

Mayor Edwards opened the item for public comments.

Gary Hall, resident, spoke regarding standing water in the Marquardt area.

Kanna Vancheswaran commented that smooth flowing gutters are addressed in this project.

Paul Bellanbaum, resident, commented regarding the Ashworth water tables.

Mayor Edwards closed public comments.

MOTION: It was moved by Mayor Pro Tem Barrows and seconded by Councilmember Pulido to award a contract for the Construction of Street Improvements in Residential Streets, Project No. 14088-12, Bid No. 1139-12, in the amount of $189,120.00. The motion carried unanimously.

PUBLIC COMMENTS AND SUGGESTIONS (re-opened)

Mayor Edwards re-opened the public comments portion of the meeting.

Su Fu spoke regarding street sweeping and associated signage.

15. Report on Pending Legislation

At this juncture, Councilmember Pulido recused himself due to a conflict of interest, left the dais and chamber.

A report was presented by Assistant City Manager Matsumoto regarding SB 986 (DUTTON) covering redevelopment and unexpended bond proceeds, and SB 1585 (PEREZ) regarding repayment of loans by redevelopment agencies.

15B. Action to support or oppose specific legislation pending in the State or Federal Legislature or pending in the California Governor's office for signature.

CONSENSUS (EDWARDS): To support SB 986, its author, representatives, other cities, lobbyists, send a letter of support, and continue to monitor the status of SB 1585.

Councilmember Pulido returned to the chamber and dais.

16. City Council Communications/Committee Reports/Report on Meetings.

Reports were provided by Councilmembers Cho, Councilwoman Chen, Councilmember Pulido, Mayor Pro Tem Barrows, and Mayor Edwards.

17. ADJOURNMENT

The meeting was adjourned at 8:37 p.m.
