Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD SEPTEMBER 8, 2011

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

Pastor William Ebling, First Baptist Church of Fullerton, provided the invocation.

3. PLEDGE OF ALLEGIANCE

Boy Scout Troop 1005 led the assembly in the salute to the flag.

4. ROLL CALL

The following Members of the City Council were in attendance:

Councilmember Bruce Barrows
Councilmember Joseph Cho, Ph.D.
Councilmember Mark Pulido
Mayor Pro Tem Jim Edwards
Mayor Carol Chen

5. PRESENTATIONS

Proclamations/Presentations were made as follows:

Proclamations were presented to the City of Cerritos Community Emergency Response Team (CERT) and Emely Merina, Community Services Supervisor (National Preparedness Month).

6. PUBLIC COMMENTS AND SUGGESTIONS

Paul Bellenbaum spoke regarding the tenant vacancies and various matters at Gridley Plaza.

CONSENT CALENDAR

7A. Approval of Register of Demands

MOTION: It was moved by Councilmember Pulido and seconded by Councilmember Barrows to approve the Register of Demands dated September 8, 2011, Checks 127829 through 128200, in the total amount of $3,688,087.54. The motion carried unanimously.

8. Approval of Treasurer’s Report for the period ending July 31, 2011

MOTION: It was moved by Councilmember Pulido and seconded by Councilmember Barrows to approve the Treasurer’s Report for the period ending July 31, 2011. The motion carried unanimously.

9A. Approval of Minutes

MOTION: It was moved by Councilmember Pulido and seconded by Councilmember Barrows to approve the Minutes of the Regular Meeting of August 25, 2011. The motion carried unanimously.

PUBLIC WORKS ACTIVITIES

10A. Review of the Los Angeles County Municipal Storm Water Permit – City of Cerritos Individual Annual Report.

A staff report was provided by Mike O’Grady, Environmental Services Manager.

MOTION: It was moved by Councilmember Barrows and seconded by Mayor Pro Tem Edwards to receive and file the Los Angeles County Municipal Storm Water Permit – City of Cerritos Individual Annual Report. The motion carried unanimously.

10B. Consideration and award of contract for emergency water utility repairs at the Los Cerritos Center.

A staff report was provided by Charles Emig, Water Superintendent.

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Edwards to:

1.) Make a finding that an emergency exists requiring the immediate repair to the valves at the Los Cerritos Center;

2.) Make a finding that staff has negotiated fair and reasonable terms for the services through an informal bid process;

3.) Find that staff has satisfied the purposes of the Bidding Statute of the Cerritos Municipal Code, and that it is reasonable and necessary to utilize an informal bid process to expedite the repair process;

4.) Appropriate sufficient funds from the City of Cerritos Water Fund to complete the proposed work; and

5.) Award a contract for emergency Water Utility repairs at the Los Cerritos Center to W. A. Rasic Construction in the amount of $25,400 and reject the other proposal.

The motion carried unanimously.

NEW AND OLD BUSINESS

11A. Request of the American Association of University Women regarding its October 17, 2011 School Board Candidate’s Forum.

A staff report was presented by Vida Barone, Interim City Clerk.

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Edwards to review the request and direct staff accordingly. The motion carried unanimously.

REPORT ON PENDING LEGISLATION

12A. Report on Pending Legislation

12B. Action to support or oppose specific legislation pending in the California Legislature or pending in the California Governor’s Office for signature.

Councilmember Pulido recused himself from the deliberation on this matter, noting his employment with the State of California. He left the dais and the Chamber for the remainder of the item.

A staff report was provided by Kathy Matsumoto, Assistant City Manager, regarding the impact to the City relative to Senate Bill 922 and Assembly Bill 710.

MOTION: It was moved by Councilmember Barrows and seconded by Councilmember Cho to direct staff to prepare letters of opposition for the Mayor’s signature to Senate Bill 922 and Assembly Bill 710. The motion carried unanimously, with Councilmember Pulido absent (recused).

At this juncture, Councilmember Pulido returned to the Chamber and dais.

13. CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Comments and reports were provided by Councilmember Cho, Councilmember Barrows, Councilmember Pulido, Mayor Pro Tem Edwards, and Mayor Chen.

CONSENSUS (Barrows): Direct staff to prepare a memorandum to be sent to all Commission and Committee appointees regarding the proper use of City resources (re: Attorney Services).

14. ADJOURNMENT

The meeting adjourned at 8:13 p.m. in memory of Rick Renaker, long-time Cerritos Commission and Committee Member.
