Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD JUNE 23, 2011

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

Pastor William Ebling, American Baptist Church, provided the invocation.

3. PLEDGE OF ALLEGIANCE

Mayor Pro Tem Edwards led the assembly in the salute to the flag.

4. ROLL CALL

The following Members of the City Council were in attendance:

5. PRESENTATIONS

Proclamations/Presentations were made as follows:

Proclamations presented to the following organization and individuals: CareMore (Business Recognition Program), Rosalina and Johnny Cosico (50th wedding anniversary), Christopher Guan (Eagle Scout), and Samuel Lee (Eagle Scout).

6. PUBLIC COMMENTS AND SUGGESTIONS

Ron Jung spoke in support of raising awareness for fundraising for the Leukemia and Lymphoma Society.

CONSENT CALENDAR

7A. Approval of Register of Demands

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Edwards to approve the Register of Demands dated June 23, 2011, Checks 125931 through 126216 in the total amount of $2,930,699.00. The motion carried unanimously.

8A. Approval of Minutes

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Edwards to approve the Minutes of the Joint Special Meeting of June 7, 2011. The motion carried unanimously.

8B. Approval of Minutes

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Edwards to approve the Minutes of the Regular Meeting of June 9, 2011. The motion carried unanimously.

9A. AN ORDINANCE OF THE CITY OF CERRITOS ADOPTING BY REFERENCE THE LOS ANGELES COUNTY RESIDENTIAL CODE AND AMENDING TITLE 15, BUILDINGS AND CONSTRUCTION, OF THE CERRITOS MUNICIPAL CODE IN ACCORDANCE WITH THIS ADOPTION.

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Edwards to adopt upon second reading, Ordinance No. 961 AN ORDINANCE OF THE CITY OF CERRITOS ADOPTING BY REFERENCE THE LOS ANGELES COUNTY RESIDENTIAL CODE AND AMENDING TITLE 15, BUILDINGS AND CONSTRUCTION, OF THE CERRITOS MUNICIPAL CODE IN ACCORDANCE WITH THIS ADOPTION. The motion carried unanimously.

PUBLIC HEARINGS

10A. A public hearing to receive comments on the resolution of the City Council of the City of Cerritos adopting the 2010 Urban Water Management Plan pursuant to California Water Code 10610 to 10657.

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS ADOPTING THE 2010 URBAN WATER MANAGEMENT PLAN PURSUANT TO CALIFORNIA WATER CODE 10610 TO 10657

Senior Assistant City Manager, Vince Brar, presented the staff report. Michael Swann, Psomas, outlined a PowerPoint Presentation which offered the salient points of the 2010 Urban Water Management Plan.

Mayor Chen opened the public hearing.

Noting that there was no individual who wanted to provide public testimony, Mayor Chen closed the public hearing.

MOTION: It was moved by Councilmember Barrows and seconded by Councilmember Cho to waive reading of and adopt Resolution No. 2011-22, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS ADOPTING THE 2010 URBAN WATER MANAGEMENT PLAN PURSUANT TO CALIFORNIA WATER CODE 10610 TO 10657, with the amendments to the attachments to reflect the words "as considered by the City Council." The motion carried unanimously.

10B. Consideration of the Combined Financial Program for the City of Cerritos and Cerritos Redevelopment Agency for Fiscal Year 2011-2012.

Consideration to waive reading of and adopt A JOINT RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS AND THE CERRITOS REDEVELOPMENT AGENCY APPROVING AND ADOPTING THE ANNUAL BUDGET FOR THE FISCAL YEAR 2011-2012, APPROPRIATING THE FUNDS NECESSARY TO MEET THE EXPENDITURES SET FORTH THEREIN, AND APPROVING THE CITY OF CERRITOS'/CERRITOS REDEVELOPMENT AGENCY'S INVESTMENT POLICY FOR THE FISCAL YEAR 2011-2012.

Budget Manager, Geri DeMasi, presented the staff report.

Staff responded to inquiries made by Councilmember Pulido on the following topics: when the tree trimming budget (Public Works) will be made "whole," professional legal services and consulting, legal services contract management, and the projections of revenue for the red light camera.

MOTION: A motion made by Councilmember Pulido to revisit all Professional Services Contracts and seek reductions for at least ten (10) to twenty (20) percent with each outside vendor. The motion failed due to lack of a second.

MOTION: A motion made by Councilmember Pulido to discontinue the red light cameras and report back with a traffic safety analysis. The motion failed due to a lack of a second.

CONSENSUS (Pulido): Directed staff to return with a report regarding the red light cameras and their efficiency.

Staff responded to inquiries made by Councilmember Cho on the following topic: budget "trailer" bills.

Staff responded to inquiries from Mayor Chen on the following topics: tree trimming schedules and "call-ins."

Mayor Chen opened the public hearing.

Noting that there was no individual who wanted to provide public testimony, Mayor Chen closed the public hearing.

MOTION: It was moved by Mayor Pro Tem Edwards and seconded by Councilmember Barrows to waive reading of and adopt Resolution No. 2011-23 and CRA Resolution No. 2011-5, A JOINT RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS AND THE CERRITOS REDEVELOPMENT AGENCY APPROVING AND ADOPTING THE ANNUAL BUDGET FOR THE FISCAL YEAR 2011-2012, APPROPRIATING THE FUNDS NECESSARY TO MEET THE EXPENDITURES SET FORTH THEREIN, AND APPROVING THE CITY OF CERRITOS'/CERRITOS REDEVELOPMENT AGENCY'S INVESTMENT POLICY FOR THE FISCAL YEAR 2011-2012. SECTIONS 33445 AND 33679 AND AUTHORIZING THE CERRITOS REDEVELOPMENT AGENCY TO FUND PORTIONS OF THE CITY OF CERRITOS/CERRITOS REDEVELOPMENT AGENCY CAPITAL IMPROVEMENT PROGRAM FOR FISCAL YEAR 2011-2012.

Redevelopment/Economic Development Administrator, Metre Anthony, presented the staff report.

Mayor Chen opened the public hearing.

Noting that there was no individual who wanted to provide public testimony, Mayor Chen closed the public hearing.

MOTION: It was moved by Councilmember Barrows and seconded by Mayor Pro Tem Edwards to waive reading of and adopt Resolution No. 2011-24 and CRA Resolution No. 2011-6, A JOINT AGENCY RESOLUTION OF THE CERRITOS CITY COUNCIL AND CERRITOS REDEVELOPMENT AGENCY APPROVING A REPORT PURSUANT TO CALIFORNIA HEALTH AND SAFETY CODE SECTIONS 33445 AND 33679 AND AUTHORIZING THE CERRITOS REDEVELOPMENT AGENCY TO FUND PORTIONS OF THE CITY OF CERRITOS/CERRITOS REDEVELOPMENT AGENCY CAPITAL IMPROVEMENT PROGRAM FOR FISCAL YEAR 2011-2012. The motion carried unanimously.

10D. Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS, CALIFORNIA, APPROVING THE AGREEMENT BETWEEN THE CITY OF CERRITOS AND THE CITY OF LA MIRADA, CALIFORNIA, REGARDING THE EXCHANGE OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS FOR GENERAL FUNDS FOR THE FISCAL YEAR 2011-2012.

Redevelopment/Economic Development Administrator, Metre Anthony, presented the staff report.

MOTION: It was moved by Councilmember Barrows and seconded by Mayor Pro Tem Edwards to authorize the City Manager to execute any and all documents necessary to complete the exchange of the City of Cerritos FY 2010-2011 Fund allocation for not less than 70 cents on the dollar in General Fund monies, and waive reading of and adopt Resolution No. 2011-25, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS, CALIFORNIA, APPROVING THE AGREEMENT BETWEEN THE CITY OF CERRITOS AND THE CITY OF LA MIRADA, CALIFORNIA, REGARDING THE EXCHANGE OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS FOR GENERAL FUNDS FOR THE FISCAL YEAR 2011-2012. The motion carried unanimously.

PUBLIC WORKS ACTIVITIES

11A. Consideration to waive reading of and adopt A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF CERRITOS IN SUPPORT OF AN ACTION TAKEN BY THE LEAGUE OF CALIFORNIA CITIES, LOS ANGELES DIVISION, SUPPORTING REASONABLE, PRACTICABLE AND ECONOMICALLY ACHIEVABLE STORM WATER NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT REQUIREMENTS AND TOTAL MAXIMUM DAILY LOAD REQUIREMENTS THROUGH THE USE OF PROGRESSIVE AND ADAPTIVE BEST MANAGEMENT PRACTICES.

Environmental Services Manager, Mike O'Grady, presented the staff report.

MOTION: It was moved by Councilmember Barrows and seconded by Councilmember Cho to waive reading of and adopt Resolution No. 2011-26, A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF CERRITOS IN SUPPORT OF AN ACTION TAKEN BY THE LEAGUE OF CALIFORNIA CITIES, LOS ANGELES DIVISION, SUPPORTING REASONABLE, PRACTICABLE AND ECONOMICALLY ACHIEVABLE STORM WATER NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT REQUIREMENTS AND TOTAL MAXIMUM DAILY LOAD REQUIREMENTS THROUGH THE USE OF PROGRESSIVE AND ADAPTIVE BEST MANAGEMENT PRACTICES. The motion carried unanimously.

11B. Consideration and award of contract for traffic signal and street lighting maintenance services for the City of Cerritos.

Director of Public Works, Hal Arbogast, presented the staff report.

MOTION: It was moved by Councilmember Barrows and seconded by Councilmember Pulido to award a contract for Traffic Signal and Street Lighting Maintenance Services for the City of Cerritos to Econolite Traffic Engineering and Maintenance, Inc. The motion carried unanimously.

11C. Consideration of a traffic control signal agreement between the cities of Bellflower, Cerritos, and Lakewood for traffic signal operation, maintenance and repair at the intersection of Palo Verde Avenue and Allington/183rd Street.

Assistant City Engineer, Kanna Vancheswaran, presented the staff report.

MOTION: It was moved by Councilmember Barrows and seconded by Mayor Pro Tem Edwards to approve a cooperative Agreement between the City of Cerritos and the cities of Lakewood and Bellflower for traffic signal operation, maintenance and repair at the intersection of Palo Verde Avenue and Allington/183rd Street. The motion carried unanimously.

11D. Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING AN APPLICATION FOR LOS ANGELES COUNTY REGIONAL PARK AND OPEN SPACE DISTRICT FOR FOURTH SUPERVISORIAL DISTRICT FUNDING FOR CAPITAL IMPROVEMENTS AT CERRITOS PARK EAST.

MOTION: It was moved by Mayor Pro Tem Edwards and seconded by Councilmember Pulido to waive reading of and adopt Resolution No. 2011-27, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING AN APPLICATION FOR LOS ANGELES COUNTY REGIONAL PARK AND OPEN SPACE DISTRICT FOR FOURTH SUPERVISORIAL DISTRICT FUNDING FOR CAPITAL IMPROVEMENTS AT CERRITOS PARK EAST. The motion carried unanimously.

12. NEW AND OLD BUSINESS

12A. Consideration and review of an amendment to the existing Granicus agreement for additional functionality and customer service related to agenda and records management.

MOTION: It was moved by Councilmember Barrows and seconded by Councilmember Pulido to authorize staff to enter into the First Amendment to the Granicus Services Agreement between Granicus, Inc. and the City of Cerritos to transition to the Open Platform, Government Transparency, and Meeting Efficiency Suites and authorize a one-time expenditure of $21,152.19, and maintenance costs of $1,369.50 per month ($684.75 for the first six months). The motion passed unanimously.

12B. Consideration and review of the First Draft Assembly, Senate, State Board of Equalization and Congressional District Maps proposed by the Citizens Redistricting Commission in Accordance with Proposition 11 (2008) and Proposition 20 (2010) as it Relates to the City of Cerritos.

Matt Kauble shared information regarding the recent regional redistricting meetings.

Council discussion ensued regarding the disadvantages of including the City of Cerritos in the districts with Orange County.

MOTION: It was moved by Councilmember Barrows and seconded by Councilmember Pulido to direct staff to draft a position to request the Citizens Redistricting Commission that the California State Assembly District position remain in Los Angeles County. The motion passed by the following roll call vote:

AYES: Barrows, Edwards, Pulido, Chen
NOES: Cho
ABSENT: None.
ABSTAIN: None.

MOTION: It was moved by Councilmember Barrows and seconded by Councilmember Pulido to direct staff to draft a position to request the Citizens Redistricting Commission that the California State Assembly District to include Cerritos, Artesia, Bellflower, Hawaiian Gardens, Lakewood, Norwalk and Paramount: The motion passed unanimously.

MOTION: It was moved by Councilmember Barrows and seconded by Councilmember Pulido to direct staff to draft a position to request the Citizens Redistricting Commission that the California State Senate District to include Cerritos, Artesia, Avalon, Bellflower, Downey, Hawaiian Gardens, Lakewood, Long Beach, Norwalk, Paramount and Signal Hill: The motion passed unanimously.

Councilmember Pulido recused himself from the following discussion, motion, and vote. He then left the dais and the Council Chamber.

Without objection, the Mayor moved to direct staff to draft a position to request the Citizens Redistricting Commission for the Congressional District include Cerritos, Artesia, Bell Gardens, Bellflower, Downey, La Mirada, Montebello, Norwalk, Pico Rivera, Santa Fe Springs, and Whittier.

12C. Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS IN OPPOSITION TO SB 931 (VARGAS) AS IT RELATES TO THE PUBLIC EMPLOYEE ORGANIZATIONS AND PROPOSES TO PROHIBIT PUBLIC AGENCIES FROM USING PUBLIC FUNDS TO PAY FOR EXTERNAL CONSULTANTS OR LEGAL ADVISERS TO COUNSEL EMPLOYER.

Assistant City Manager, Kathy Matsumoto, provided a staff report.

MOTION: It was moved by Councilmember Barrows and seconded by Mayor Pro Tem Edwards to waive reading of and adopt Resolution No. 2011-27, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS IN OPPOSITION TO SB 931 (VARGAS) AS IT RELATES TO THE PUBLIC EMPLOYEE ORGANIZATIONS AND PROPOSES TO PROHIBIT PUBLIC AGENCIES FROM USING PUBLIC FUNDS TO PAY FOR EXTERNAL CONSULTANTS OR LEGAL ADVISERS TO COUNSEL EMPLOYER. The motion passed by the following roll call vote:

AYES: Barrows, Cho, Edwards, Chen
NOES: None.
ABSENT: Pulido (Recused)
ABSTAIN: None.

At this juncture Councilmember Pulido returned to the dais.

13. REPORT ON PENDING LEGISLATION

City Manager Gallucci noted that there may be two changes in the State budget regarding Redevelopment Agencies and will provide any updates to the Council.

14. CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Comments were provided by Councilmember Cho, Councilmember Pulido, Councilmember Barrows, Mayor Pro Tem Edwards, and Mayor Chen.

CONSENSUS (Pulido): Directed staff to place an update on the City's Labor Negotiation Process in an upcoming Closed Session.

CONSENSUS (Barrows): Directed legal staff to ensure that the City is following appropriate procedures in determining the adjudicated newspaper.

CONSENSUS (Barrows): Directed staff to research the feasibility of adding a column to the demand run that would provide a year-to-date aggregate of how much each vendor has been paid.

15. ADJOURNMENT

The meeting adjourned in memory of Chizuko Uyeda the mother of Fine Arts and Historical Commissioner Elayne Shiohama at 11:07 p.m.
