Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD MAY 26, 2011

1. CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

2. INVOCATION

Pastor Carl Bernal with St. John Lutheran Church provided the invocation.

3. PLEDGE OF ALLEGIANCE

Girl Scout Junior and Cadet Troop 863 led the assembly in the salute to the flag.

4. ROLL CALL

The following Members of the City Council were in attendance:

Councilmember Bruce Barrows
Councilmember Joseph Cho, Ph.D.
Councilmember Mark Pulido
Mayor Pro Tem Jim Edwards
Mayor Carol Chen

5. PRESENTATIONS

Proclamations/Presentations were made as follows:

Plaques presented to outgoing Commission/Committee members. Proclamations were presented to Chuan-Ling Liu (90th birthday), Jersey Gold Dairy (Business Recognition Program), Wittmann Elementary School (2011 Cerritos City Wide Pride Program), and the Cerritos High School Model United Nations Team (37th Annual National High School Model United Nations Conference Award of Excellence).

6. PUBLIC COMMENTS AND SUGGESTIONS

Levi Javier, resident, suggested implementing photovoltaic technology at the major retail centers in Cerritos and requested that the appropriate party install a drainage system on the portion of the bike path that is subject to “pooling” water.

Ram Kakkar, resident, expressed his concerns regarding the on-going collective bargaining process.

CONSENT CALENDAR

7A. Approval of Register of Demands

MOTION: It was moved by Mayor Pro Tem Edwards and seconded by Councilmember Barrows to approve the Register of Demands dated May 26, 2011, Checks 125238 through 125506 in the total amount of $5,746,212.42. The motion carried unanimously.

8A. Approval of Minutes

MOTION: It was moved by Mayor Pro Tem Edwards and seconded by Councilmember Edwards to approve the Minutes of the Special Meeting of May 9, 2011.

9A. Ordinance for second reading and adoption. (Full reading of ordinance waived at ordinance introduction)

ORDINANCE NO. 960 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CERRITOS AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF CERRITOS AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES’ RETIREMENT SYSTEM.

This item was pulled from the Consent Calendar for separate consideration by Councilmember Pulido.

MOTION: It was moved by Councilmember Barrows and seconded by Mayor Pro Tem Edwards to waive reading and adopt ORDINANCE NO. 960 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CERRITOS AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF CERRITOS AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES’ RETIREMENT SYSTEM. The item was adopted pursuant to the following roll call vote:

AYES: 3 Barrows, Edwards, Chen
NOES: 2 Cho, Pulido
ABSENT: 0 None
ABSTAIN: 0 None

PUBLIC WORKS ACTIVITIES

10A. Consideration and award of a contract for the installation of playground surfacing at Gridley Park and replacement of perimeter windscreens at Cerritos High School tennis courts, Project No. 10105, Bid No. 1116-11.

Kanna Vancheswaran, Assistant City Engineer, provided a report and PowerPoint Presentation.

MOTION: It was moved by Councilmember Barrows and seconded by Councilmember Pulido to award Bid No. 1116-11, a contract to install playground surfacing at Gridley Park and replace the perimeter windscreens at Cerritos High School to the apparent low bidder Creative Contractors in the amount of $78,315.66, and to reject all other bids. The motion carried unanimously.

10B. Consideration and award of contract for sidewalk, curb, gutter and wheelchair ramp repairs in the City of Cerritos, Project No. 13086, Bid No. 1117-11.

Kanna Vancheswaran, Assistant City Engineer, provided a report.

MOTION: It was moved by Mayor Pro Tem Edwards and seconded by Councilmember Cho to award Bid No. 1117-11, a contract for sidewalk, curb, gutter, and wheelchair ramp repairs in the City of Cerritos, Project No. 13086 to the apparent low bidder CJ Construction in the amount of $32,086.60 and to reject all other bids and authorize staff to negotiate a change order with CJ Construction to provide for additional sidewalk, curb, gutter, and wheelchair ramp repairs in the amount not to exceed the available funding. The motion carried unanimously.

10C. Consideration and review of the City of Cerritos 2010 Consumer Confidence Report.

Charles Emig, Water Superintendent, provided a report.

Paul Bellenbaum, resident, inquired as to various aspects of the water well system.

MOTION: It was moved by Mayor Pro Tem Edwards and seconded by Councilmember Cho to receive and file the City of Cerritos 2010 Consumer Confidence Report. The motion carried unanimously.

10D. A presentation by the County Sanitation District of Los Angeles County to review the Gridley Road Interceptor Sewer Project across portions of 166th Street, Gridley Road, Artesia Boulevard, 183rd Street and Pioneer Boulevard.

Kanna Vancheswaran, Assistant City Engineer, provided a report and PowerPoint Presentation. Stan Pegadiotes, Project Engineer of the Los Angeles County Sanitation Districts, provided an overview report of the Gridley Road Interceptor Sewer Project.

MOTION: It was moved by Councilmember Pulido and seconded by Mayor Pro Tem Edwards to receive and file the report regarding the County Sanitation District of Los Angeles County to review the Gridley Road interceptor sewer project across portions of 166th Street, Gridley Road, Artesia Boulevard, 183rd Street and Pioneer Boulevard. The motion carried unanimously.

NEW AND OLD BUSINESS

11A. Consideration and review of a Professional Services Agreement by and between Mobilitie, LLC, the City of Cerritos, and the Planning Center, for environmental review services in connection with a proposed T-Mobile Wireless Telecommunication Permit (WTP) application, with the full cost of the Professional Services to be paid by the applicant.

Councilmember Pulido recused himself from participating in this item and noted that his residence is within 500 feet of the project area. Councilmember Pulido left the dais and exited the Council Chamber.

Robert A. Lopez, Current Planning Manager, provided a staff report.

MOTION: It was moved by Councilmember Barrows and seconded by Mayor Pro Tem Edwards to authorize the City Manager to execute on behalf of the City with Mobilitie, LLC, and The Planning Center, substantially in the form attached with the report, for environmental review services. The motion passed pursuant to the following vote:

AYES: 4 Barrows, Cho, Edwards, Chen
NOES: 0 None
ABSENT: 0 Pulido (Recused)
ABSTAIN: 0 None

12. REPORT ON PENDING LEGISLATION

Consensus (Barrows): Directed staff to bring certain pieces of legislation that impact local governments back for the Council’s consideration at the next meeting.

13. CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilmembers Barrows, Cho, Pulido, Mayor Pro Tem Edwards, and Mayor Chen provided reports on their recent conference attendance and community meetings.

Consensus (Pulido): Directed staff to place information regarding the upcoming June 7, 2011 Budget Study Session on the City’s homepage.

14A. CLOSED SESSION

CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION. Significant exposure to litigation pursuant to subdivision (b) of Section 54956.9. Number of potential cases: One (1)

Mark Steres, City Attorney, announced the above referenced matter and the City Council recessed to Closed Session.

The City Council reconvened to Open Session and City Attorney Steres reported that the City Council took no reportable action.

15. ADJOURNMENT

The meeting adjourned at 9:15 p.m.
