Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD NOVEMBER 8, 2010

CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Councilman Edwards offered the invocation.

PLEDGE OF ALLEGIANCE

Girl Scout Troop 2153 led the assembly in the salute to the flag.

ROLL CALL

The following Members of the City Council were in attendance:

Councilman Bruce Barrows
Councilwoman Carol Chen
Councilman Jim Edwards
Mayor Pro Tem Laura Lee
Mayor Joseph Cho, Ph.D.

PRESENTATIONS

A proclamation was presented to Antidote International, a humanitarian club founded by students at Cerritos High School.

PUBLIC COMMENTS AND SUGGESTIONS

Joyce Moore, Cerritos resident, thanked the Councilmembers who responded to concerns regarding the senior water aerobics class and expressed her support for a mutually beneficial resolution.

Paul Bellenbaum, Cerritos resident, spoke regarding the recent statewide election and Veterans Day.

City Manager Art Gallucci provided a brief report regarding the status of the senior water aerobics class.

CONSENT CALENDAR

Approval of Register of Demands

MOTION: It was moved by Councilman Edwards and seconded by Mayor Pro Tem Lee to approve the Register of Demands dated November 8, 2010, Checks 120424 through 120727, in the total amount of $15,408,878.98. The motion carried unanimously.

Approval of Treasurer's Report for the period ending September 30, 2010

MOTION: It was moved by Councilman Edwards and seconded by Mayor Pro Tem Lee to approve the Treasurer's Report for the period ending September 30, 2010. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved by Councilman Edwards and seconded by Mayor Pro Tem Lee to approve the Minutes of the Special Meeting of October 25, 2010, as corrected. The motion carried unanimously.

PENDING LEGAL MATTERS

Consideration to waive reading of and adopt a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS ESTABLISHING A RESOURCE ADEQUACY PROGRAM FOR THE CITY OF CERRITOS ELECTRIC UTILITY IN FURTHERANCE OF RESOLUTION NO. 2006-1 AND AUTHORIZING THE TAKING OF CERTAIN OTHER ACTIONS IN CONNECTION THEREWITH.

A brief report was provided by Vince Brar, Senior Assistant City Manager.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Chen to waive reading of and adopt Resolution No. 2010-21, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS ESTABLISHING A RESOURCE ADEQUACY PROGRAM FOR THE CITY OF CERRITOS ELECTRIC UTILITY IN FURTHERANCE OF RESOLUTION NO. 2006-1 AND AUTHORIZING THE TAKING OF CERTAIN OTHER ACTIONS IN CONNECTION THEREWITH. The motion carried unanimously.

PUBLIC WORKS ACTIVITIES

Consideration and approval of a Utility Agreement with the California Department of Transportation establishing the liability for the costs related to the relocation of a water main on Valley View Avenue in connection with the I-5 Corridor Improvement Project within the City of Cerritos.

A brief report was provided by Kanna Vancheswaran, Assistant City Engineer.

Discussion ensued regarding the City's ability to seek reimbursement from the State for the interest on the money paid "up-front" (by the City) and any additional staff costs related to the project.

MOTION: It was moved by Councilman Barrows and seconded by Mayor Pro Tem Lee to approve a Utility Agreement with the California Department of Transportation establishing the liability for the costs related to the relocation of a water main on Valley View Avenue in connection with the I-5 Corridor Improvement Project within the City of Cerritos.

Consideration and award of contract for the design of a Valley View Avenue Water Utility Relocation Project in connection with the I-5 Corridor Improvement Project within the City of Cerritos.

A brief report was provided by Kanna Vancheswaran, Assistant City Engineer.

MOTION: It was moved by Councilman Barrows and seconded by Mayor Pro Tem Lee to: 1) designate the water utility relocation project as a new Capital Improvement Project to be completed within the fiscal year 2010-2011 City of Cerritos Combined Financial Program, 2) allocate the funds necessary to complete the design portion of the project (reimbursable by Caltrans); and, 3) award a contract for the design of the water utility relocation project to Psomas Engineering in the amount of $55,937.

NEW AND OLD BUSINESS

Consideration and review of a report on designs and materials for a photo backdrop for the Cerritos City Council Chambers.

A brief report and PowerPoint Presentation was provided by Annie Hylton, City and Theater Marketing Manager.

MOTION: It was moved by Councilman Edwards and seconded by Councilman Barrows to direct staff to order and install photo option E (as presented in the agenda report) on professional canvass material, at a cost of approximately $681. Motion carried (4 – 1) via the following roll call vote:

ROLL CALL VOTE: AYE: Barrows, Edwards, Lee, Cho
NOES: Chen (preferred Option A)

Consideration and review of a proposal to set minimum valuation for the placement of public artwork as required by Chapter 22.94 of the Cerritos Municipal Code, relating to the Art in Public Places Program.

A brief report was provided by Kathy Matsumoto, Assistant City Manager.

A motion made by Councilman Barrows and seconded by Councilwoman Chen to establish a $25,000 minimum valuation for artwork to be placed on private property did not pass (2 – 3) pursuant to the following roll call vote: AYES: Barrows, Chen, NOES: Edwards, Lee, Cho.

MOTION: It was moved by Councilman Barrows and seconded by Councilwoman Chen to receive and file the report with no change to be made to Chapter 22.94 of the Cerritos Municipal Code as it relates to the Art in Public Places Program. The motion carried unanimously.

Consideration and review of a report on the withdrawal of the low bidder from Bid No. 1103-11, printing of the 2011 Cerritos Community Calendar and re-award of the contract to the next lowest bidder.

A brief report was provided by Annie Hylton, City and Theater Marketing Manager.

MOTION: It was moved by Councilwoman Chen and seconded by Councilman Edwards to confirm and ratify the award of Bid No. 1103-11, printing of the 2011 Cerritos Community Calendar, to Meridian Graphics in the amount of $25,820.88. The motion carried unanimously.

Consideration and review of a request for a City Estoppel Certificate in connection with refinancing of a corporate credit facility by Sunstone Hotel Partnership, LLC, the parent of Sunstone Center Court, LLC, owner of the Sheraton Cerritos Hotel, and inclusion of Sunstone Center Court, LLC, as a guarantor of that credit facility.

A brief report was provided by Ryan Carey, Management Analyst.

Todd Hersperger, representing Sunstone Hotel Investors, Inc., responded to Councilmember inquiries.

MOTION: It was moved by Councilman Barrows and seconded by Councilwoman Chen to authorize the City Manager to execute the Estoppel Certificate and Consent substantially in the form submitted in connection with this agenda report, with the provision that City staff will meet with the developer to ensure that the item does not have a material impact on the City, and to present the information via written memorandum to the Council prior to execution of the Estoppel Certificate and Consent. The motion carried unanimously.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilwoman Chen reported on the following items: Caucus held by the Joint Powers Insurance Authority regarding Risk Management and the upcoming Veteran's Day Ceremony.

Councilman Barrows reported on the following items: Southern California Association of Governments "Compass Blueprint" grant, grant opportunities through the Urban Land Institute, the City of Los Angeles "30/10" initiative, "adaptive needs" Halloween event at Cerritos Park East, Christmas Tree Lighting Ceremony on November 22, 2010, and the street surface solar panel technology.

Councilman Edwards reported on the following items: Chamber luncheon focusing on educational opportunities at Cerritos College, Veteran's Ceremony in the City of Artesia, and the upcoming City of Cerritos' Veterans Day Ceremony.

Mayor Cho reported on the following items: Halloween Festival, Artesia Veterans Day Ceremony, Korean War Veteran's Luncheon, meeting with Japanese students who visited City Hall, Meritorious Marine PFC Chris Smith, the passing of Proposition 22 to protect municipal funds, the upcoming Cerritos Veterans Day Ceremony, the Annual Holiday Boutique at the Cerritos Senior Center, and the November 22 Cerritos Annual Christmas Tree Lighting.
