Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD OCTOBER 14, 2010

CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Pastor William Ebling, Pastor, American Baptist Church offered the invocation.

PLEDGE OF ALLEGIANCE

Girl Scout Troop 678 led the assembly in the salute to the flag.

ROLL CALL

The following Members of the City Council were in attendance:

Mayor Joseph Cho, Ph.D.

PRESENTATIONS

The following proclamations were presented: County of Los Angeles Fire Department Assistant Fire Chief Gerald Heinzel, Battalion Chief Bruce Dean, Station 30, Station 35 and La Fonda Riggins, Community Service Representative in honor of October being Fire Prevention Month. Bing C. Cariño, for his service as president of the Southern California Philippine – U.S. Veterans Association from 2009 to 2010.

PUBLIC COMMENTS AND SUGGESTIONS

The Mayor invited those wishing to speak during public comments and suggestions.

Principal Wilson of Cerritos Elementary School invited all to the upcoming Pancake Breakfast Fundraiser. Estelle Sato and Michelle Ondo, representatives of the school Foundation, also extended a welcome and invitation for the community to attend the event.

Ram Kakkar spoke regarding the Senior Health and Wellness Fair and inquired about responses to his suggestions regarding the agenda.

Councilmember Barrows commented that the City's Study Session on the proposed Protocol Manual will include discussion on public comments.

John Nieto, introduced members of the AFSCME union, and commented on the City's current negotiation process with its bargaining units.

Kari Franco, a Cerritos Senior Center employee, provided her comments on the current negotiation process with its bargaining units.

Sharon Wood, a City employee, provided her perspective on her interaction with City management.

Rogan Girard, representing the City's negotiating team, provided information regarding the Cerritos Performing Arts Center and a request for minimum staffing.

Zeke Marquez, a City employee, expressed his disappointment in the City's current negotiation process with its bargaining units.

Sally Ramirez, AFSCME Union representative, commented on the City's current negotiation process.

City Manager Art Gallucci provided his comments on the City's current economic status and how that impacts the City's negotiation process. He also noted that the City did not ask for any items such as reductions in insurance, salary, or benefits, or request any furlough or lay-off days from employees.

CONSENT CALENDAR

Approval of Register of Demands

MOTION: It was moved by Councilman Edwards and seconded by Mayor Pro Tem Lee to approve the Register of Demands dated October 14, 2010, Checks 119548 through 120135 in the total amount of $10,611,620.55. The motion carried unanimously.

Approval of Treasurer's Report for the period ending August 31, 2010

MOTION: It was moved by Councilman Edwards and seconded by Mayor Pro Tem Lee to approve the Treasurer's Report for the period ending August 31, 2010. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved by Councilman Edwards and seconded by Mayor Pro Tem Lee to approve the Minutes of the Regular Meeting of September 23, 2010. The motion carried unanimously.

PUBLIC HEARINGS

A REQUEST BY APPLICANT CHOU JAN LI OF LEMON TREE SPA, LLC FOR APPROVAL OF A CONDITIONAL USE PERMIT TO OPERATE A MASSAGE ESTABLISHMENT. THE SUBJECT PROPERTY IS LOCATED AT 11325 183RD STREET, CERRITOS, CALIFORNIA, 90703, IS ZONED REGIONAL COMMERCIAL (CR), AND IS LOCATED IN THE LOS CERRITOS REDEVELOPMENT PROJECT AREA (APN 7034-015-032).

*PURSUANT TO SECTION 15301 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA), THIS PROJECT IS CATEGORICALLY EXEMPT.

Title was read to the foregoing item, the public hearing opened, and brief staff report presented by staff member Sandy Cisneros. A PowerPoint Presentation was displayed.

Council made various inquires and staff provided responses related to signage, the permitting process for massage establishments, the certification requirements for massage technicians, and the review of massage technicians.
Councilmember Chen requested additional language that would require the establishment to notify the City when attrition occurs in the approved massage technicians.

Interested parties were invited to present testimony. No one wished to present testimony and the public hearing was closed.

The City Attorney affirmed that Condition No. 65 will be modified with language that requires the owner to provide the City with the appropriate certification whenever new employees are hired.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards that the City Council:

A. Receive and file Cerritos Redevelopment Agency Conformity Report 2010-8;

B. Approve Conditional Use Permit 2010-5, making the findings set forth in Cerritos Planning Commission Resolution No. PC 2010-35;

as amended by changes to Condition No. 65 in the staff report dated October 14, 2010.
The motion carried unanimously.

A REQUEST BY APPLICANT ARISARA WIANGSAENG OF BAMBOO HEALTH SPA FOR APPROVAL OF A CONDITIONAL USE PERMIT TO OPERATE A MASSAGE ESTABLISHMENT. THE SUBJECT PROPERTY IS LOCATED AT 11452 SOUTH STREET, CERRITOS, CALIFORNIA, 90703, IS ZONED REGIONAL COMMERCIAL (CR), AND IS LOCATED IN THE LOS CERRITOS REDEVELOPMENT PROJECT AREA (APN 7039 021-050).

Title was read to the foregoing item, the public hearing opened, and brief staff report presented by staff member Sandy Cisneros. A PowerPoint Presentation was displayed.

The Mayor commented on email correspondence related to this matter provided by an outside party to the members of the City Council. The City Attorney explained the difference between licensing and zoning requirements pursuant to the Municipal Code. Tonight's matter does not relate to licensing and the email correspondence was related to a licensing matter. He further clarified that tonight's matter was in respect to zoning.

Interested parties were invited to present testimony.

Ram Kakkar inquired as to whether the City has adequate resources to conduct investigations of massage establishments. Torrey Contreras, Director of Community Development, clarified the City's comprehensive massage establishment ordinance and the depth of the screening process.

Richard Turner, representing the applicant, responded to inquiries from the Council. He affirmed that the applicant purchased the business and all new staff was hired.
The City Attorney suggested an amendment to condition 60. He added the clause "within five days within the date of hire" at the end of the last sentence.

The Mayor closed the public hearing.

MOTION: Councilmember Chen made a motion, and Mayor Cho seconded, a motion to continue this matter to the next Regular Council meeting Monday, October 25, 2010. The motion carried pursuant to the following roll call vote:

PENDING LEGAL MATTERS

A brief staff report was provided by Vida Barone, City Clerk, on all three resolutions.

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION ON TUESDAY, MARCH 8, 2011 FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE CHARTER.

MOTION: It was moved by Mayor Pro Tem Lee, and seconded by Councilman Edwards, that the City Council waive reading of and adopt Resolution No. 2010-18 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION ON TUESDAY, MARCH 8, 2011, FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE CHARTER. The motion carried unanimously.

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO RENDER SPECIFIED SERVICES TO THE CITY RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY ON TUESDAY, MARCH 8, 2011.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards that the City Council waive reading of and adopt Resolution No. 2010-19 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO RENDER SPECIFIED SERVICES TO THE CITY RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY ON TUESDAY, MARCH 8, 2011. The motion carried unanimously.

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATE'S STATEMENTS SUBMITTED TO THE VOTERS AT AN ELECTION TO BE HELD ON TUESDAY, MARCH 8, 2011.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards that the City Council waive reading of and adopt Resolution No. 2010-20 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATE'S STATEMENTS SUBMITTED TO THE VOTERS AT AN ELECTION TO BE HELD ON TUESDAY, MARCH 8, 2011. The motion carried unanimously.

PUBLIC WORKS ACTIVITIES

REVIEW AND APPROVAL OF A MEMORANDUM OF AGREEMENT WITH THE LOS ANGELES GATEWAY REGION INTEGRATED REGIONAL WATER MANAGEMENT JOINT POWERS AUTHORITY FOR IMPLEMENTATION OF THE LOS CERRITOS CHANNEL TOTAL MAXIMUM DAILY LOAD FOR METALS

Staff member Michael O'Grady provided the staff report.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Chen that the Cerritos City Council enter into the Memorandum of Agreement with the Los Angeles Gateway Region Integrated Regional Water Management Joint Powers Authority for Implementation of the Los Cerritos Channel Total Maximum Daily Load for metals. The motion carried unanimously.

NEW AND OLD BUSINESS

REVIEW AND CONSIDERATION OF A LICENSE AGREEMENT WITH GOOGLE INC. FOR THE INCORPORATION OF CERRITOS ON WHEELS (COW) ROUTE AND SCHEDULE INFORMATION INTO THE GOOGLE TRANSIT SERVICE.

Robert Lopez, Advanced Planning Manager, provided the staff report.

MOTION: It was moved by Councilman Barrows and seconded by Councilman Edwards to authorize the City Manager to execute a license agreement on behalf of the City with Google Inc., for the incorporation of Cerritos On Wheels (COW) information into the Google Transit service. The motion carried unanimously.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilman Edwards commented on various activities throughout the City and the heroic efforts by members of the 1st CEB Marines in addressing a recent public safety incident.

Councilwoman Chen congratulated Councilmember Edwards for receiving the Human Services Association awards and other award recipients, and reported on her attendance at various community events. She also requested that the meeting be adjourned in memory of Teresa Fuentes, long-time Cerritos resident and community activist.

Councilman Barrows acknowledged the contributions of Teresa Fuentes and the Fuentes family, he reported on his attendance at various community events, congratulated Councilmember Edwards on his recent award, and noted the City is a finalist as the "Most Business-friendly City."

Mayor Pro Tem Lee congratulated Councilmember Edwards for his Human Spirit Award and commented on the service of the 1st CEB volunteers and staff member Kathy Matsumoto.

Mayor Cho noted that he was in Korea for the past two weeks for a book signing event. He commented on recent articles about Cerritos in local media and proclamations provided to the three 1st CEB Marines. He also commented on the loss of Theresa Fuentes and former City employee Joan Harvey Biegel.

ADJOURNMENT

The meeting adjourned at 9:13 p.m. in memory of Theresa Fuentes and Joan Harvey Biegel.
