Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD AUGUST 26, 2010

CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Mrs. Maria Kung with the First Evangelical Church of Cerritos offered the invocation.

PLEDGE OF ALLEGIANCE

Boy Scout Troop 1005 led the assembly in the salute to the flag.

ROLL CALL

The following Members of the City Council were in attendance:

Councilman Bruce Barrows
Councilwoman Carol Chen
Councilman Jim Edwards
Mayor Pro Tem Laura Lee
Mayor Joseph Cho, Ph.D.

PRESENTATIONS

Proclamations were presented to Apex Computer Systems, Inc., for being selected as part of the City's Business Recognition Program, and to Joseph Moon for achieving the rank of Eagle Scout.

PUBLIC COMMENTS AND SUGGESTIONS

The Mayor invited those wishing to speak during public comments and suggestions.

Edward E. Butler, Cerritos resident, spoke regarding various home service providers, solicitors, and realtors placing signs without resident's permission. He requested to establish fines for illegal placement of realtor signs.

Councilwoman Chen, commented the City does have a sign ordinance, and requested staff to contact the Real Estate Association and ask them to distribute the information regarding the City sign ordinance.

Chris Foster, Cerritos resident, invited the community to the "Tip a Cop" fundraiser to be held at Wood Ranch BBQ on Wednesday night where the Los Angeles County Sheriffs will be serving for tips that will benefit Special Olympics.

Ram Kakkar, Cerritos resident, thanked the City and Council for the completion of the hearing looping system installed in the City Council chamber, and suggested large screen close captioning as well. He spoke regarding various changes to the agenda format. He also suggested repositioning the City Logo so that it is visible in photographs taken in the chamber presentation area.

Mayor Pro Tem Lee requested staff do a study regarding positioning the City Logo so it is visible in photographs taken in the chamber presentation area.

CONSENT CALENDAR

Approval of Register of Demands

MOTION: It was moved by Councilwoman Chen and seconded by Councilman Edwards to approve the Register of Demands dated August 26, 2010, Checks 118540 through 118936, in the total amount of $6,898,078.48. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved Councilwoman Chen and seconded by Councilman Edwards to approve the Minutes of the Regular Meeting of August 12, 2010. The motion carried unanimously.

Resolution for consideration and adoption. Reading of Resolution waived and resolution adopted.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE SERVED BY THE ISSUANCE OF A OFF-SALE BEER AND WINE LICENSE FOR A CONVENIENCE SERVICE STATION OWNED BY MD CHEVRON AND LOCATED AT 11355 ARTESIA BOULEVARD, CERRITOS, CA, 90703 (APN 7034-003-050).

MOTION: It was moved by Councilwoman Chen and seconded by Councilman Edwards to
waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE SERVED BY THE ISSUANCE OF AN OFF-SALE BEER AND WINE LICENSE FOR A CONVENIENCE SERVICE STATION OWNED BY MD CHEVRON AND LOCATED AT 11355 ARTESIA BOULEVARD, CERRITOS, CA, 90703 (APN 7034-003-050), and direct staff to transmit a copy of the signed resolution to the applicant for submittal to the Alcoholic Beverage Control Board. The motion carried unanimously.

PUBLIC HEARINGS

A request by applicant Blackdot Wireless, 27271 Las Ramblas, Suite 200, Mission Viejo, California, 92691, on behalf of Clearwire, to construct a 60 foot-high monopine wireless telecommunication facility. As proposed, the monopine will contain three (3) microwave dishes, six (6) panel antennas, and one (1) global positioning antenna for wireless internet purposes. The proposed monopine will be located on an existing industrial development at 16717 Norwalk Boulevard in the City of Cerritos. The subject site is zoned industrial (M) and is located in the Los Coyotes Redevelopment Project Area (APN 7011-001-020).

Title was read to the foregoing item, the public hearing opened, and a brief staff report was presented. Interested parties were invited to present testimony.

Councilwoman Chen asked if the photo simulation presented is a final view of the property, and requested information on the Clearwire company. Current Planning Manager Lopez responded that the photo simulation presented is before the Conditions of approval, and listed the services Clearwire provides.

Don Williams, representing Clearwire Services, thanked Mr. Lopez for the presentation, and spoke regarding the company launching of the broadband, high speed 4G service, and their willingness to comply with the conditions of approval.

Sammy Loz, RF Engineer for Clearwire, commented that the facilities are safe, preliminary design and testing indicates the site meets FCC guidelines, and wattage transmission is below the maximum the FCC allows.

No one further wished to present testimony and the public hearing was closed.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards to receive and file Cerritos Redevelopment Agency Conformity Report 2010-5. Approve Wireless Telecommunication Permit 2010-3, making the findings set forth in the Cerritos Planning Commission Resolution No. PC 2010-24. The motion carried unanimously.

A request by applicant Somerset Homes, LLC, 12140 Artesia Boulevard, Artesia, California, 90701, to subdivide one (1) existing single-family residential parcel into two (2) single-family residential parcels. The subject property is located at 19412 Ely Avenue, Cerritos, California, 90703, is zoned single-family residential (RS-6500), and is located in the Los Coyotes Redevelopment Area (APN 7054-013-004).

*Pursuant to section 15315 of the California Environmental Quality Act (CEQA), this project is categorically exempt.

Title was read to the foregoing item, the public hearing was opened.

At this juncture, Councilwoman Chen recused herself from participating in this item due to a conflict of interest as she recently represented the client. She left the dais and the chamber at 7:47 p.m. A brief staff report was presented, and interested parties were invited to present testimony. No one wished to present testimony and the public hearing was closed.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards to receive and file Cerritos Redevelopment Agency Conformity Report 2010-6, and approve Tentative Parcel Map 71321, making the findings set forth in the Cerritos Planning Commission Resolution No. PC 2010-27. The motion carried with Councilwoman Chen absent.

Councilwoman Chen returned to the Council chamber and dais at 7:51 p.m.

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS FINDING THE CITY IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE 2010 CMP LOCAL DEVELOPMENT REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089.

Title was read to the foregoing item, the public hearing opened, and brief staff report presented. Interested parties were invited to present testimony. No one wished to present testimony and the public hearing was closed.

MOTION: It was moved by Councilman Barrows and seconded by Councilwoman Chen to waive further reading and adopt the captioned resolution A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS FINDING THE CITY IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE 2010 CMP LOCAL DEVELOPMENT REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089. The motion carried unanimously.

PENDING LEGISLATION

City Manager Gallucci commented that the both the City and its advocate are monitoring what is going on in Sacramento to see how it impacts California and especially the City of Cerritos.

Councilmember Barrows commented regarding AB155 by Mendoza to limit local control of decision making by cities. Noted Cerritos has been asked by the League of California Cities to pass resolution to petition the Governor to Veto the bill. Requested Council draw up a resolution.

City Attorney Steres recommended under item 11B the Council has the right to take action to oppose specific legislation pending in the Legislature or Governor's office, and that the recommend action would be for Council to draft a letter of opposition to AB155, have all Councilmember's sign it, and send it to the Governor's office.

CONSENSUS: It was the consensus of the Council to draft a letter in opposition of AB155, have all the Councilmembers sign it and forward the letter to the Governor's office.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilman Edwards reported on his attendance at various events as follows: Citywide pride dinner and thanked the residents for taking pride in beautifying their homes; attended the United States Air Force band concert.

Councilwoman Chen reported she attended nine events in the past two weeks, and requested Council agendize consideration and discussion of digital art for the Cerritos Auto square art piece. In response to Mayor Cho, Assistant City Manager Matsumoto stated that the Commission was looking at alternate locations and other forms of art, but that digital art had not been considered and is newer technology.

CONSENSUS: At the recommendation of Councilwoman Chen, it was the consensus of the Council to agendize the consideration and discussion of digital art as a form of art for the Cerritos Auto Square art piece, as well as discussion of terms of display, location, maintenance, and cost.

Councilwoman Chen acknowledged e-mails received in recognition of Water Department employee Joel Beam assisting a resident with fixing a leak, and resident Danielle Alvarado, stated that staff has done a great job to accommodate children with disabilities who require special attention. Councilwoman Chen also invited residents to an event "Coffee with Captain Joe" at the Senior Center to be held on August 30, at 10 a.m. to 12 p.m.

Councilman Barrows commented on the LA Times article relating to non-profit organizations
not reporting money received, and requested Cerritos check for this reporting. City Manager Gallucci responded that a report is in progress. Councilman Barrows reported on his involvement with the Orangeline Development Authority and indicated the project is moving ahead. Noted that the City is a finalist for the National League of Cities 2010 award for Municipal excellence in conjunction with our partnership with the Cerritos Towne Center.

Mayor Pro Tem Lee reported her attendance at various events as follows: The Vietnam moving wall in the City of Norwalk. Stated she had previously asked staff to bring back information on whether the City has applied for this program, that the City should take a look into applying as it may take a few years to get it She was honored to be invited to the 79th U.S. Army reserve support activation ceremony in the City of Los Alamitos, and in May she gave a speech regarding Asian Heritage Month and which was noted in the brochure.

Mayor Cho commented on his attendance at various events as follows: City Wide Pride award banquet; U.S. Air force band performance; mentioned the next free performance by the L.A. Philharmonic; Cerritos Senior Center summer social; the Vincent 60th Wedding anniversary, Congratulated Mr. and Mrs. Vincent for their long marriage. Reported the City has received it's third Playful U.S. City award and is nominated as a finalist for the Municipal excellence award, and 2010 most business friendly city. Attended two grand opening ceremonies; Recognized 1st CEB Meritorious Marine Corporal Omar Sanchez; Invited residents to the 1st CEB Carwash, on Saturday, August 28; Stated that August 19, the last combat troops first strike brigade left Iraq, and their mission is officially ended, expressed wishes that all young soldiers will come home safely.

Councilman Barrows also mentioned that tonight is his 38th Wedding anniversary and thanked his wife for her ongoing support.

ADJOURNMENT

The meeting adjourned at 8:30 p.m., in memory of four thousand four hundred and fifteen American service men and women who lost their lives in the Iraq freedom mission over the past seven and one half years, and those lost their lives in combat in Afghanistan.
