Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD JULY 22, 2010

CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Reverend Dr. Brian Suk-Boo Lee with the Artesia-Cerritos United Methodist Church offered the invocation.

PLEDGE OF ALLEGIANCE

Boy Scout Troop 72 led the assembly in the salute to the flag.

ROLL CALL

The following Members of the City Council were in attendance:

Councilman Bruce Barrows
Councilwoman Carol Chen
Councilman Jim Edwards
Mayor Pro Tem Laura Lee
Mayor Joseph Cho, Ph.D.

PRESENTATIONS

The following proclamations were presented: Macerich in recognition of the Los Cerritos Center being selected as part of the City’s Business Recognition Program; a plaque was presented to Assistant City Clerk Irene Maxon, upon the occasion of her upcoming retirement; and Sahil Shah, Andrew Cho, Philip Hwang, Brian Lee and Geonwu Grant Suk in recognition of achieving their rank of Eagle Scout.

PUBLIC COMMENTS AND SUGGESTIONS

The Mayor invited those wishing to speak during public comments and suggestions.

Vivy Chao, representing the office of Assemblymember Tony Mendoza, shared details regarding an upcoming “Foreclosure Prevention Workshop” in the City of Norwalk and a Labor Day barbeque on September 11, in the City of Cerritos.

Ram Kakkar, resident, spoke about the pros, cons, and procedures related to the camera enforcement of red-light traffic signal violations.

Paul Bellenbaum, resident, spoke about the success of the City’s Fourth of July activities. He expressed concerns related to an advertising on a flagpole at Gridley Plaza. City Manager Gallucci responded that the matter has been referred to the City’s Code Enforcement staff.

CONSENT CALENDAR

Approval of Register of Demands

MOTION: It was moved by Councilman Barrows and seconded by Councilman Edwards to approve the Register of Demands dated July 22, 2010, Checks 117813 through 118164, in the total amount of $7,717,147.78. The motion carried unanimously.

Approval of Treasurer's Report for the period ending May 31, 2010

MOTION: It was moved by Councilman Barrows and seconded by Councilman Edwards to approve the Treasurer's Report for the period ending May 31, 2010. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved Councilman Barrows and seconded by Councilman Edwards to approve the Minutes of the Regular Meeting of July 8, 2010. The motion carried unanimously.

PUBLIC HEARINGS

Consideration to waive reading of and adopt AN URGENCY ORDINANCE OF THE CITY OF CERRITOS ESTABLISHING A MORATORIUM TO PROHIBIT THE LOCATION OF HEALTH STUDIOS OR COMPARABLE USES AND FACILITIES IN ALL ZONES AND PROHIBIT THE ISSUANCE OF BUILDING PERMITS AND OTHER LAND USE ENTITLEMENTS.

(Recommendation to postpone the public hearing indefinitely and direct staff to re-notice the item at a later date as appropriate.)

Title was read to the foregoing item, the public hearing opened, and brief staff report presented.

Interested parties were invited to present testimony. No one wished to present testimony and the public hearing was closed.

MOTION: It was moved by Councilwoman Chen and seconded by Councilman Barrows to postpone the public hearing indefinitely to consider an urgency ordinance entitled AN URGENCY ORDINANCE OF THE CITY OF CERRITOS ESTABLISHING A MORATORIUM TO PROHIBIT THE LOCATION OF HEALTH STUDIOS OR COMPARABLE USES AND FACILITIES IN ALL ZONES AND PROHIBIT THE ISSUANCE OF BUILDING PERMITS AND OTHER LAND USE ENTITLEMENTS and direct staff to re-notice the item at a later date as appropriate. The motion carried unanimously.

PUBLIC WORKS ACTIVITIES

Consideration and review of the Southern California Edison SmartConnect electric meter program.

Ben Harvey, Regional Manager – Local Public Affairs, Southern California Edison, addressed the City Council with a PowerPoint Presentation.

Discussion was held between the Council and Mr. Harvey regarding the process for installing the meters and in what languages the door hangers were printed.

Following discussion, resident Ram Kakkar commented on the efficacy of the program for the residents.

Assistant City Manager Brar noted the program is supervised and approved by the California Public Utilities Commission, that the City will benefit by starting this program with the “second generation” of equipment and technology, and that the intent of the program is to provide informational tools to the resident to promote energy savings.

MOTION: It was moved by Councilwoman Chen and seconded by Mayor Pro Tem Lee to receive and file the report entitled Consideration and review of the Southern California Edison SmartConnect electric meter program dated July 22, 2010. The motion carried unanimously.

NEW AND OLD BUSINESS

Consideration and review of an on-line version of the Cerritos residential color palette on the City's website.

Current Planning Manager Lopez gave a PowerPoint Presentation to demonstrate the proposed on-line version of the Cerritos Residential Color Palette Program.

Discussion was held between the Council and staff regarding the color swatches, color paint palettes and the possibility of downloading the photo shop program on-line.

Ram Kakkar expressed concern that the current “no-fee” permit would eventually turn into a fee-based permit. He suggested that an alternate mechanism be used to grant permission for certain color palettes and inquired as to the extent to which the color palette will be applied to architectural design features.

Paul Bellenbaum inquired as to whether certain colors will be included in the City’s palette.

MOTION: It was moved by Councilman Edwards and seconded by Mayor Pro Tem Lee to direct staff to launch the on-line color palette web page as outlined in the staff report dated July 22, 2010. The motion carried unanimously.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilwoman Chen reported on her attendance at various events as follows: 1st CEB Meritorious Marine’s Recognition, Friends of the Library Volunteer Recognition Brunch, Joint Power Insurance Authority’s Annual Meeting, a trip to Washington, D.C. as part of the Asian Pacific Advisory Council for Congressional District 40, and met with the Ambassador of Korea and the Ambassador of Taiwan.

Councilman Barrows reported on his attendance at various events as follows: Library Volunteer Recognition Brunch and SCAG Legislative Committee meeting.

Councilman Edwards reported on his attendance at various events as follows: Library Volunteer Recognition Brunch and Volunteer Recognition Dinner and wished his wife a happy 43rd wedding anniversary.

Mayor Pro Tem Lee reported on her attendance at various events as follows: Library Volunteer Recognition Program and Volunteer Recognition Dinner; the Southern California Cup Tai Chi Chuan Competition in Hacienda Heights. She also mentioned the upcoming Thai dance performance and Classical Musical to be held in the Skyline Room.

Mayor Cho reported on his attendance at various events as follows: Landmark Square Grand Opening celebration, press conference regarding the light fixture replacement program, and 2010 Volunteer Recognition Dinner and Library Volunteer Recognition Brunch.

CLOSED SESSION

The City Council convened in Closed Session at 8:51 p.m. The meeting reconvened at 10:05 p.m. with all Councilmembers present.

Personnel matters pursuant to CALIFORNIA Government Code Section 54957.6: CONFERENCE WITH LABOR NEGOTIATORS

Agency Negotiators: Denise Manoogian, Patricia Leyva and Charles Goldstein.

Employee Organization: AFSCME, Local 619

MOTION:  It was moved by Councilwoman Chen and seconded by Councilman Edwards to authorize labor negotiators authority to continue negotiating and to keep the Council informed of progress as it relates to said negotiations. The motion carried unanimously.

ADJOURNMENT

The meeting adjourned at 10:05 p.m.
