Cerritos City Council Meeting Minutes

MINUTES OF A SPECIAL MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD JUNE 9, 2009

CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Councilwoman Chen offered the invocation.

PLEDGE OF ALLEGIANCE

Mayor Pro Tem Cho led the assembly in the salute to the flag.

ROLL CALL

The following Members of the City Council were in attendance:

Councilwoman Carol Chen
Councilman Jim Edwards
Councilwoman Laura Lee
Mayor Pro Tem Joseph Cho, Ph.D.
Mayor Bruce W. Barrows

PRESENTATIONS

A plaque was presented to George Ray in appreciation of his service to the City as a Fine Arts and Historical Commissioner; and proclamations were presented to the following:  Chieh Tsai Peng in celebration of his 100th birthday; Jennifer MacDuff, Richard Martinez and Robert Vazquez for administering life-saving aid to fellow Run-Power Walk participant David Nakamura; Carmenita Middle School for being named a 2009 California Distinguished School; and the musical group SaxAppeal for their musical contributions to the community.

PUBLIC COMMENTS AND SUGGESTIONS

Lori Kim, representing Assemblymember Tony Mendoza's office, invited the community to the Senior Scam Stopper presentation at the Cerritos Senior Center on Friday, June 12, 2009 from 10:00 a.m. to Noon and to the State Budget Challenge presentation at the Norwalk Sports Complex on Friday, June 12, 2009 beginning at 4:00 p.m.

Abraham Aryadad, Cerritos resident, requested an exception to the overnight parking permit procedure, noting his situation is unique. 

Following a brief discussion, it was noted that staff would meet with Mr. Aryadad regarding this request.

CONSENT CALENDAR

Approval of Register of Demands

MOTION:  It was moved by Councilman Edwards and seconded by Mayor Pro Tem Cho to approve the Register of Demands dated June 9, 2009, Checks 108947 through 109184, in the total amount of $8,455,173.36.  The motion carried unanimously.

Approval of Minutes

MOTION:  It was moved by Councilman Edwards and seconded by Mayor Pro Tem Cho to approve the Minutes of the Special Meeting of May 26, 2009.  The motion carried unanimously.

NEW AND OLD BUSINESS

Consideration and award of contract for City/Agency annual financial auditing services.

There were no public comments regarding this matter.

MOTION:  It was moved by Councilwoman Chen and seconded by Councilwoman Lee to continue consideration and award of contract for City/Agency annual financial auditing services to the June 25, 2009 City Council meeting.  The motion carried unanimously.

Agenda Items 9B and 9C were considered concurrently.

Consideration of joining the pending legal action by the California Contract Cities Association against the County of Los Angeles regarding Liability Trust Fund recovery.

Consideration of a one-year extension to the municipal law enforcement services agreement with the County of Los Angeles.

City Manager Gallucci presented an overview of the staff reports dated June 9, 2009 and responded to Council inquiries regarding Liability Trust Fund recovery and options available to the City.

Paul Bellenbaum, Cerritos resident, requested and received confirmation that the City of Hawaiian Gardens contracts with the Los Angeles County Sheriff's Department for law enforcement services.

MOTION:  It was moved by Mayor Pro Tem Cho and seconded by Councilman Edwards to approve the City's participation in the California Contract Cities Association's lawsuit against the County of Los Angeles regarding Liability Trust Fund recovery unless a compromise agreement can be reached prior to June 15, 2009, as recommended in the staff report dated June 9, 2009.  The motion carried unanimously.

MOTION:  It was moved by Mayor Pro Tem Cho and seconded by Councilman Edwards to approve a one-year extension to the City's municipal law enforcement services agreement with the County of Los Angeles, as recommended in the staff report dated June 9, 2009.  The motion carried unanimously.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilwoman Lee commented on her attendance at the Family Arts Festival.

Councilwoman Chen addressed her attendance at the California Joint Powers Insurance Authority conference; the Tetzlaff Middle School 3rd Annual Red Carpet Media Event; and the Family Arts Festival.

Councilman Edwards commended those who rendered aid to David Nakamura as mentioned earlier during the presentations portion of the meeting as well as to the members of the musical group SaxAppeal; noted he spoke to the Cerritos Center for the Performing Arts Ambassadors; and commented on his attendance at the Family Arts Festival.

Mayor Pro Tem Cho addressed his attendance at the Carver Academy Enrichment Cluster, Tetzlaff Middle School 3rd Annual Red Carpet Media Event, ABC Adult School International Day, Los Angeles County Water Summit, Los Angeles Sanitation District Ocean Inspection Tour, and Family Arts Festival.  He commented on the current process of placing Council-requested items on the agenda by consensus of the Council, noting other city practices to place an item on the agenda through the Mayor, at the request of two councilmembers and at the request of one councilmember.

MOTION:  It was then moved by Mayor Pro Tem Cho and seconded by Councilwoman Lee to place on a future Council agenda the matter of lowering the threshold needed for agenda items requests from the Council.

At the request of the Council, City Attorney Steres indicated that the current process is not a requirement of the City Charter.

MOTION FAILS:  The foregoing motion failed with Councilmembers Chen and Edwards and Mayor Barrows dissenting.

Mayor Barrows reported on his attendance at the Family Arts Festival and the League of California Cities Finances Conference in San Diego.

CLOSED SESSION

The City Council convened in Closed Session at 8:10 p.m.

The meeting adjourned at 9:25 p.m. in memory of long-time Cerritos resident Ruth Mary Murray, who recently passed away.
