Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD APRIL 24, 2008

CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Councilwoman Lee offered the invocation.

PLEDGE OF ALLEGIANCE

Crystal Ryan of Girl Scout, Brownie, Daisy and Junior Troop 767 led the assembly in the salute to the flag.

ROLL CALL

The following Members of the City Council were in attendance:

PRESENTATIONS

The following proclamations were presented:  John Latino for being named the 2008 honoree of the First Annual Par for Parkinson's Charity Golf Tournament; Southern California Philippine-US Veterans Association proclaiming March 20, 2008 as Welcome Home Vietnam Veterans Day; American Cancer Society Relay for Life Paint Our Town Purple Day on May 1, 2008; Nalesh Aneja for attaining the rank of Eagle Scout; Cerritos High School Song Team for placing first at the United Spirit Association Cheerleading National Championships; and Cerritos High School Model United Nations Team's Award of Excellence in Committee and Research and Preparation at the 34th Annual National High School Model United Nations Conference.

PUBLIC COMMENTS AND SUGGESTIONS

There were no public comments.

CONSENT CALENDAR

Approval of Register of Demands

MOTION:  It was moved by Councilwoman Lee and seconded by Councilman Cho to approve the Register of Demands dated April 24, 2008, Checks 99070 through 99381 in the total amount of $5,821,445.63.  The motion carried unanimously.

Approval of Minutes

MOTION:  It was moved by Councilwoman Lee and seconded by Councilman Cho to approve the minutes of the Regular Meeting of April 10, 2008.  The motion carried unanimously.

Ordinances for second reading and adoption.  Reading of ordinances waived and ordinances adopted.

ORDINANCE NO. 937 – AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 5.04 OF THE CERRITOS MUNICIPAL CODE AS IT RELATES TO BUSINESS LICENSE ISSUANCE AND DENIAL.

MOTION:  It was moved by Councilwoman Lee and seconded by Councilman Cho to waive reading of and adopt Ordinance No. 937 entitled AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 5.04 OF THE CERRITOS MUNICIPAL CODE AS IT RELATES TO BUSINESS LICENSE ISSUANCE AND DENIAL.

The motion carried by the following vote:

AYES:          Councilmembers        -     Cho, Lee, Barrows, Edwards

NOES:          Councilmembers        -     None

ABSENT:     Councilmembers        -     None

ABSTAIN:    Councilmembers        -     None

ORDINANCE NO. 938 – AN ORDINANCE OF THE CITY OF CERRITOS AMENDING VARIOUS SECTIONS OF THE CERRITOS MUNICIPAL CODE AS IT RELATES TO CONSTRUCTION TIME LIMITS.

MOTION:  It was moved by Councilwoman Lee and seconded by Councilman Cho to waive reading of and adopt Ordinance No. 938 entitled AN ORDINANCE OF THE CITY OF CERRITOS AMENDING VARIOUS SECTIONS OF THE CERRITOS MUNICIPAL CODE AS IT RELATES TO CONSTRUCTION TIME LIMITS.

The motion carried by the following vote:

AYES:          Councilmembers        -     Cho, Lee, Barrows, Edwards

NOES:          Councilmembers        -     None

ABSENT:     Councilmembers        -     None

ABSTAIN:    Councilmembers        -     None

PUBLIC HEARINGS

A request by PS Business Parks, L.P., 2599 East 28th Street, Suite 204, Signal Hill, California, 90755, for a time extension to complete certain required property improvements related to Condition of Approval Number 54 of Conditional Use Permit 2007-2.  The subject property is located at 14020 Bolsa Lane, Cerritos, CA, 90703, zoned Industrial (M) (APN 7022-023-009).

Title was read to the foregoing item, the public hearing opened, and staff called upon for a report.

A review of the staff report dated April 24, 2008 was provided by Current Planning Manager Hamilton.

Interested parties were invited to present testimony.  There was no response and the public hearing was closed.

MOTION:  It was moved by Councilwoman Lee and seconded by Mayor Pro Tem Barrows to approve a three (3) month time extension, expiring June 27, 2008, of Conditional Use Permit 2007-2 to allow for the completion of property improvements related to Condition of Approval Number 54, and making the findings set forth in Cerritos Planning Commission Resolution No. PC 2008-13.  The motion carried unanimously.

PENDING LEGAL MATTERS

Resolution for consideration

Consideration of proposed amendment to the joint exercise of powers agreement of the Gateway Cities Council of Governments.

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING THE AMENDED JOINT EXERCISE OF POWERS AGREEMENT OF THE GATEWAY CITIES COUNCIL OF GOVERNMENTS.

MOTION:  It was moved by Mayor Pro Tem Barrows and seconded by Councilman Cho to waive reading of and adopt Resolution No. 2008-13 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING THE AMENDED JOINT EXERCISE OF POWERS AGREEMENT OF THE GATEWAY CITIES COUNCIL OF GOVERNMENTS.  The motion carried unanimously.

PUBLIC WORKS ACTIVITIES

Consideration and award of contract for the construction of South Street improvements from Gridley Road to Studebaker Road, Bid No. 1070-08, Project No. 13070.

MOTION:  It was moved by Councilwoman Lee and seconded by Councilman Cho to award a contract in the amount of $261,724 for the construction of South Street improvements from Gridley Road to Studebaker Road, Bid No. 1070-08, Project No. 13070, to the apparent low bidder, Griffith Company, and reject all other bids.  The motion carried unanimously.

Approval of Quitclaim Deed (Partial Quitclaim of Easement) for landscape, sidewalk and public utility purposes for the property located at 12800 Center Court Drive (APN 7030-011-913).

MOTION:  It was moved by Councilman Cho and seconded by Mayor Edwards to approve, execute and authorize recordation of a Quitclaim Deed (Partial Quitclaim of Easement) for landscape, sidewalk and public utility purposes for the property located at 12800 Center Court Drive (APN 7030-011-913), subject to final approval of the City Engineer.  The motion carried unanimously.

NEW AND OLD BUSINESS

Review and consideration of a policy for accepting donated artwork/ collectibles for public display in the City of Cerritos.

Paul Bellenbaum, Cerritos resident, suggested donation of chromium parts from discarded washing machines to Cerritos College as sculpture material, and it was noted by staff that the College would be contacted.

MOTION:  It was moved by Mayor Pro Tem Barrows and seconded by Councilman Cho to approve the Policy for Accepting Donated Artwork/Collectibles for Public Display in the City of Cerritos as outlined in the staff report dated April 24, 2008 and as modified to change the word shall to may on item 7 under the Procedures in Accepting a Donation of Public Artwork/Collectibles category.  The motion carried unanimously.

REPORT ON PENDING LEGISLATION

City Manager Gallucci reported on the status of Assembly Bill 2000 regarding roll-over of units that are greater than the Regional Housing Needs Assessment allocation.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilman Cho reported on his attendance at a Consolidated Youth Services Network meeting.  He discussed his recent observations with regard to trash/green waste/recyclables barrels, noted that green waste and recyclables barrels awaiting pick-up service were fewer in number and most were half full, and he suggested staff evaluate and report back in three months regarding the possibility of the pick-up of green waste and recyclables every other week rather than on a weekly basis in order to save money associated with gas, trucks and staffing.

Councilwoman Lee concurred, noting that her recyclables barrel is not placed for pick-up every week and an abbreviated pick-up schedule could save residents money and save on natural resources.  She also reported on her attendance at the Tracy High School Career Day.

Mayor Pro Tem Barrows commented on the potential hardship of picking-up green waste every other week on those with more landscaping or larger lots; reported on the Tracy High School Career Day; and reported on his attendance at a recent Orange Line Development Authority meeting.

Mayor Edwards commented on the upcoming Community Spring Festival and Friends of Cerritos Center for the Performing Arts Gala; and reported on his attendance this past week at the League of California Cities Annual Legislative Days event in Sacramento.

ADJOURNMENT

The meeting adjourned at 8:05 p.m. in memory of Ray Knabe, father of Los Angeles County Supervisor and former Cerritos Mayor/Councilman Don Knabe; former Artesia Mayor/Councilman Walter Mullikin; and Cerritos residents Arlow Feltman, Joyson Szu and Kristy Pesanti, all of whom recently passed away.
