Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD SEPTEMBER 27, 2007

CALL TO ORDER

The meeting was called to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Pastor Chong-Yoon Yi of Living Water Mission Church offered the invocation.

PLEDGE OF ALLEGIANCE

Girl Scout, Brownie, Daisy, and Junior Troop 767 led the assembly in the salute to the flag.

ROLL CALL

The City Clerk noted attendance of the following Members of the City Council:

Councilman Bruce W. Barrows

Councilman Joseph Cho, Ph.D.

Councilman John F. Crawley

Mayor Pro Tem Jim Edwards

PRESENTATIONS

A proclamation was presented to Fire Chief Angel Montoya for his service to the City and in recognition of his promotion and re-assignment.  Fire Chief Montoya introduced newly promoted Assistant Fire Chief David Richardson who began his assignment at Fire Station 30 on September 17.  Gahr High School Math Department Chair Diane Lau was also presented with a proclamation for Gahr High School's creation of the Linda Morrison Memorial Scholarship.

PUBLIC COMMENTS AND SUGGESTIONS

Bob Houska, Cerritos resident, addressed remarks that were made regarding his comments at a Gadabouts luncheon concerning his disappointment that Councilmembers were not in attendance.

Chris Tierheimer, Cerritos resident, indicated he was not affiliated with B&B stables or the Ride Your Horse! therapeutic riding program's request for a covered horse arena, which was discussed at the last City Council meeting.  He commented on the benefits of such a program for the community, noting that this program should be a fiscal priority and opportunities for contributions from others should be explored.

Chris Fuentes, Cerritos resident, noted that he visited the therapeutic riding program and reiterated the comments of the previous speaker.  He apprised the Council of California Arts Day on October 5 and suggested a display of public art in conjunction with Arts Day for next year.

Gloria and Mario Kasilag, Cerritos residents, suggested the City approve the use of artificial grass for landscaping in front yards, noting that artificial grass conserves water and is low-maintenance.

Mayor Pro Tem Edwards apologized for any miscommunication related to Mr. Houska's comments and conveyed that the Mayor was not in attendance at the Gadabouts luncheon due to the passing of her brother and sister.

CONSENT CALENDAR ITEMS

Approval of Register of Demands

MOTION:  It was moved by Councilman Crawley and seconded by Mayor Pro Tem Edwards to approve the Register of Demands dated September 27, 2007, Checks 93715 through 94117, in the total amount of $4,465,713.14.  The motion carried unanimously.

Approval of Treasurer’s Report for the period ending August 31, 2007

MOTION:  It was moved by Councilman Crawley and seconded by Mayor Pro Tem Edwards to approve the Treasurer’s Report for the period ending August 31, 2007.  The motion carried unanimously.

Approval of Minutes

MOTION:  It was moved by Councilman Crawley and seconded by Mayor Pro Tem Edwards to approve the Minutes of the September 13, 2007 Regular City Council Meeting.  The motion carried unanimously.

PUBLIC HEARINGS

The applicant, PS Business Parks, L.P., 2599 East 28th Street, Suite 204, Signal Hill, California, 90755, is requesting approval of a conditional use permit to render the existing industrial building at 14020 Bolsa Lane, Cerritos, California, 90703, zoned Industrial (M), into reasonable compliance with the Cerritos Municipal Code (APN 7022-023-009).

Negative Declaration

Conditional Use Permit 2007-2

Title was read to the foregoing item, the public hearing opened, and staff was called upon for a report.

An overview of the proposal, as outlined in the staff report dated September 27, 2007, was provided by staff.

Interested parties were invited to address the City Council on this matter.  There were no speakers and the public hearing was closed.

MOTION:  It was moved by Councilman Barrows and seconded by Councilman Crawley that the City Council:

A.        Receive, file, certify, and approve the Negative Declaration, making the findings set forth in Cerritos Planning Commission Resolution No. PC 2007-37; and

B.         Approve Conditional Use Permit 2007-2, making the findings set forth in Planning Commission Resolution No. PC 2007-38;

as recommended in the staff report dated September 27, 2007.  The motion carried unanimously.

PUBLIC WORKS ACTIVITIES

Consideration and award of contract for construction of street improvements in residential streets, Bid No. 1055-08, Project No. 14088-07-I.

MOTION:  It was moved by Mayor Pro Tem Edwards and seconded by Councilman Cho to award a contract in the amount of $324,963.23 for the construction of street improvements in residential streets, Project No. 14088-07-I, Bid No. 1055-08, to Ruiz Engineering, and to reject all other bids; and authorize staff to negotiate additional pavement projects in an amount not to exceed $175,000.  The motion carried unanimously.

Consideration and award of contract for construction of street and water improvements in Pioneer Boulevard from Del Amo Boulevard to 195th Street, Bid No. 1057-08, Projects No. 17128/17197.

MOTION:  It was moved by Councilman Barrows and seconded by Councilman Cho to authorize the appropriation of $893,009 from the Water Fund to fund a portion of Project 17197, water improvements in Pioneer Boulevard related to the C-5 water well project; and to award a contract for the construction of street and water improvements in Pioneer Boulevard from Del Amo Boulevard to 195th Street, Bid No. 1057-08, Projects No. 17128/17197, to Sully-Miller Contracting Co., in the amount of $1,507,833, and to reject all other bids.  The motion carried unanimously.

Consideration and award of contract for citywide sidewalk, curb and gutter repairs in the City of Cerritos, Bid No. 1058-08.

MOTION:  It was moved by Mayor Pro Tem Edwards and seconded by Councilman Cho to award a contract for citywide sidewalk, curb and gutter repairs in the amount of $331,350, including Additive Alternates A, B and C, to C.J. Concrete Construction, Inc., and to reject all other bids.  The motion carried unanimously.

Consideration and award of contract for inspection services in conjunction with citywide sidewalk, curb and gutter repairs contract, Bid No. 1058-08.

MOTION:  It was moved by Councilman Barrows and seconded by Councilman Cho to award a contract to Koury Engineering & Testing, Inc. to perform the required inspection services for citywide sidewalk, curb and gutter repairs in the City of Cerritos for an amount not to exceed $37,125.  The motion carried unanimously.

NEW AND OLD BUSINESS

Review and approval of expenditure of Supplemental Law Enforcement Services Funds in accordance with State grant monies established by SB 823 (Poochigian) of 2002 for fiscal year 2006-2007.

MOTION:  It was moved by Mayor Pro Tem Edwards and seconded by Councilman Crawley to acknowledge the expenses of the 2006-2007 Supplemental Law Enforcement Services Fund; and authorize the City Manager to sign the Certified Expenditure Report and submit the document to the County's Chief Administrative Officer.  The motion carried unanimously.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

MOTION:  It was moved by Councilman Cho and seconded by Councilman Barrows to direct staff to report back to the City Council next month on the matter of the six-month trial policy for Dial-A-Ride.  The motion carried unanimously.

At the request of Councilman Cho, the City Manager provided a report on the status of the affordable senior housing project in conjunction with the Redevelopment Agency and the ABC Unified School District.

Councilman Edwards expressed pride for the Gahr High School creation of the Linda Morrison Memorial Scholarship and commented on his attendance at the Summer Swim Spectacular at the Swim Center.

ADJOURNMENT

There being no further business to come before the City Council, the meeting adjourned at 8:00 p.m.
