Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD JANUARY 11, 2007



CALL TO ORDER

Mayor Paul Bowlen called the meeting to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Pastor Bill Ebling of First Baptist Church of Fullerton offered the invocation.

PLEDGE OF ALLEGIANCE

Councilman John Crawley  led the assembly in the salute to the flag.

ROLL CALL

The City Clerk noted attendance of the following Members of the City Council:

PUBLIC COMMENTS AND SUGGESTIONS

Merri Wheaton, Cerritos resident, offered a prayer.

Gavin Riley, Cerritos resident, retired ABC Unified School District teacher and teacher’s union representative, supported the proposed housing development concept at Norwalk Boulevard and 166th Street. He discussed concerns regarding residents pressured to support certain candidates in the recent ABC School Board election and expressed concern that similar campaign strategies would be used in the upcoming City Council election. Mr. Riley read an excerpt of a letter from the United Homeowners’ Alliance regarding supporting candidates in the upcoming City Council election; opined that the United Homeowners’ Alliance is not meeting state reporting requirements and suggested that the City Attorney file a complaint with the Fair Political Practices Commission concerning their behavior and fundraising efforts; and encouraged candidates for the upcoming City Council election disregard the January 8, 2007 letter from the United Homeowners’ Alliance demanding to know their position on certain issues.

Paul Bellenbaum, Cerritos resident, inquired about State plans regarding the sewer system for human waste disposal.

CONSENT CALENDAR ITEMS

Approval of Register of Demands

MOTION: It was moved by Councilwoman Kappe and seconded by Councilman Edwards to approve the Register of Demands dated January 11, 2007, Checks 86932 through 87119, Checks 87120 through 87297, Checks 87298 through 87441 and Checks 87442 through 87496, in the total amount of $23,709,940.38. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved by Councilwoman Kappe and seconded by Councilman Edwards to approve the Minutes of the December 14, 2006 Regular City Council Meeting. The motion carried unanimously.

Ordinance for second reading and adoption. Reading of ordinance waived and ordinance adopted.

ORDINANCE NO. 920

AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 6.20, PROPERTY MAINTENANCE, OF THE CERRITOS MUNICIPAL CODE DEFINING THE TERM “SCREENED” TO MEAN LOCATED BEHIND A LEGALLY PERMITTED OPAQUE WALL, FENCE, GATE OR HEDGE OF AT LEAST SIX (6) FEET IN HEIGHT WHEN PERTAINING TO THE STORAGE OF VEHICLES, INCLUDING RECREATIONAL VEHICLES, ON PROPERTY ZONED RESIDENTIAL.

MOTION: It was moved by Councilwoman Kappe and seconded by Councilman Edwards to waive reading of and adopt Ordinance No. 920. The motion carried by the following vote:

PENDING LEGAL MATTERS

Resolution for consideration

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS TO ESTABLISH AND RECOGNIZE JANUARY 13 AS “KOREAN AMERICAN DAY.”

RESOLUTION NO. 2007-1

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS TO ESTABLISH AND RECOGNIZE JANUARY 13 AS “KOREAN AMERICAN DAY.”

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards to adopt Resolution No. 2007-1. The motion carried unanimously.

PUBLIC WORKS ACTIVITIES

Consideration and award of contract for the purchase and installation of an internally illuminated sign for the south tower of the Cerritos Library, Project No. 12083.

MOTION: It was moved by Councilman Edwards and seconded by Councilwoman Kappe to make the following findings with regard to Project No. 12083: that TFN Architectural Signage, based upon their previous experience is uniquely qualified to provide the necessary materials and services specially suited for the manufacture and installation of an internally illuminated sign at the Cerritos Library; that staff has negotiated fair and reasonable terms for the products and services; and that staff has satisfied the purposes of the bidding statute of the Cerritos Municipal Code, and that by saving time, money and ensuring product consistency, it is in the best interest of the City to dispense with the bid process for the purchase and installation of an internally illuminated Library sign; and award a contract to TFN Architectural Signage for the purchase and installation of an internally illuminated sign for the south tower of the Cerritos Library in an amount not to exceed $80,879. The motion carried unanimously.

NEW AND OLD BUSINESS

Consideration of the Annual Report of the Cerritos Redevelopment Agency for Fiscal Year 2005-2006.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Edwards to receive and file the Annual Report of the Cerritos Redevelopment Agency; and direct staff to transmit a copy of the December 14, 2006 staff report entitled Consideration of the Annual Report of the Cerritos Redevelopment Agency for Fiscal Year 2005-2006, and the Cerritos Redevelopment Agency Annual Financial Report for Fiscal Year 2005-2006 as required to the State of California Department of Housing and Community Development. The motion carried unanimously.

Consideration and award of Bid No. 1050-07, purchase of two new pickup trucks.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Kappe to award Bid No. 1050-07 for the purchase of two new pickup trucks to Raceway Ford in the amount of $54,819.06. The motion carried unanimously.

REPORT ON PENDING LEGISLATION

City Manager Gallucci reported on his recent trip to Sacramento to discuss legislative activities regarding housing issues.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilmembers wished everyone a happy new year; and commented on the City’s float entry in the 2007 Tournament of Roses Parade winning the Bob Hope Humor Award.

Councilman Crawley, Councilman Edwards and Councilwoman Kappe reported on attendance at the California Contract Cities Association 40th Annual Sacramento Legislative Orientation Tour held in Sacramento, California, January 8-10, 2007.

Mayor Bowlen expressed appreciation to Recreation Services Superintendent Mendoza for his service to the City of Cerritos and extended best wishes in his new job; and commented on the various homes in the community not having visible addresses and inquired about and staff responded regarding painting home addresses on City curbs.

CLOSED SESSION

City Attorney Steres announced the following Closed Session items:

The City Council convened in Closed Session at 7:33 p.m. The meeting reconvened at 8:20 p.m., with all City Councilmembers in attendance.

Consideration of salary and compensation adjustments for City Charter Employees

City Council action reported from Closed Session included an adjustment to the City Clerk’s compensation of a five percent (5%) cost of living adjustment, retroactive to July 1, 2006.

ADJOURNMENT

There being no further business to come before the City Council, the meeting adjourned at 8:20 p.m. in memory of Wittman Elementary School Teacher Cindy Anderson and Gilbert “Randy” Penland, spouse of Cerritos employee Filomena Penland, both of whom recently passed away.
