Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD SEPTEMBER 28, 2006



CALL TO ORDER

Mayor Paul Bowlen called the meeting to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Pastor Bill Ebling of First Baptist Church of Downey offered the invocation.

PLEDGE OF ALLEGIANCE

Councilman Jim Edwards led the assembly in the salute to the flag.

ROLL CALL

The City Clerk noted attendance of the following Members of the City Council:

Councilman John F. Crawley
Councilman Jim Edwards
Councilwoman Gloria A. Kappe
Mayor Pro Tem Laura Lee
Mayor Paul W. Bowlen

PUBLIC COMMENTS AND SUGGESTIONS

Merri Wheaton, Cerritos resident, offered a prayer.

CONSENT CALENDAR ITEMS

At the request of Councilman Crawley and with the concurrence of the Councilmembers, Item 10A, second reading of Ordinance No. 915, was removed from the Consent Calendar.

Approval of Register of Demands

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Kappe to approve the Register of Demands dated September 28, 2006, Checks 84612 through Checks 84695 and Checks 84696 through 84887, in the total amount of $6,217,572.02. The motion carried unanimously.

Approval of Treasurer’s Report for the period ending July 31, 2006

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Kappe to approve the Treasurer’s Report for the period ending July 31, 2006. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Kappe to approve the Minutes of the September 14, 2006 Regular City Council Meeting. The motion carried unanimously.

Ordinances for second reading and adoption. Reading of ordinances waived and ordinances adopted.

ORDINANCE NO. 917

AN ORDINANCE OF THE CITY OF CERRITOS ADDING CHAPTER 1.18 TO THE CERRITOS MUNICIPAL CODE REGARDING THE CITY SEAL AND CITY LOGOS.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Kappe to waive reading of and adopt Ordinance No. 917. The motion carried by the following vote:

AYES: Councilmembers - Crawley, Edwards, Kappe, Lee, Bowlen
NOES: Councilmembers - None
ABSENT: Councilmembers - None
ABSTAIN: Councilmembers - None

Miscellaneous

Report to the City Council/Redevelopment Agency/Public Financing Authority regarding biennial review of Conflict of Interest Codes.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Kappe to receive and file the report regarding biennial review of Conflict of Interest Codes dated September 28, 2006. The motion carried unanimously.

Ordinances for second reading and adoption. Reading of ordinances waived and ordinances adopted.

ORDINANCE NO. 915

AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 10.12 OF TITLE 10 OF THE CERRITOS MUNICIPAL CODE TO PROHIBIT STREET PARKING ON DESIGNATED DAYS FOR STREET SWEEPING.

MOTION: It was moved by Councilwoman Kappe and seconded by Councilman Edwards to waive reading of and adopt Ordinance No. 915. The motion carried by the following vote:

AYES: Councilmembers - Edwards, Kappe, Lee, Bowlen
NOES: Councilmembers - Crawley
ABSENT: Councilmembers - None
ABSTAIN: Councilmembers - None

Councilman Crawley opined that street sweeping both sides of the street on the same day would create parking problems.

PUBLIC HEARINGS


Consideration to waive reading of and introduce AN ORDINANCE OF THE CITY OF CERRITOS AMENDING TITLE 22 OF THE CERRITOS MUNICIPAL CODE AS IT RELATES TO THE REGULATION OF WALLS AND FENCES.

Negative Declaration
Development Code Amendment 2006-6


Title to the foregoing item was read, the public hearing opened, and staff called upon for a report.

Advance Planning/Redevelopment Manager Lopez presented an overview of the staff reported dated September 28, 2006. He addressed the provisions of the proposed ordinance and block wall standards; noted that a Negative Declaration was prepared in accordance with the California Environmental Quality Act; and indicated that the Planning Commission recommended approval of the proposed ordinance.

Interested parties were invited to present testimony. No one wished to address the City Council on this matter and the public hearing was closed.

MOTION: It was moved by Councilman Edwards and seconded by Councilwoman Kappe that the City Council:

  1. Certify and approve the Negative Declaration for Development Code Amendment 2006-6, which was completed in accordance with the California Environmental Quality Act (CEQA); and
     

  2. Direct staff to file a Notice of Determination in accordance with Section 3.5 of the Environmental Impact Report Guidelines of the City of Cerritos;

as recommended in the staff report dated September 28, 2006. The motion unanimously carried.

ORDINANCE NO. 918

AN ORDINANCE OF THE CITY OF CERRITOS AMENDING TITLE 22 OF THE CERRITOS MUNICIPAL CODE AS IT RELATES TO THE REGULATION OF WALLS AND FENCES.

MOTION: It was moved by Councilman Edwards and seconded by Councilwoman Kappe to waive reading of and introduce Ordinance No. 918. The motion carried by the following vote:

AYES: Councilmembers - Crawley, Edwards, Kappe, Lee, Bowlen
NOES: Councilmembers - None
ABSENT: Councilmembers - None
ABSTAIN: Councilmembers - None


NEW AND OLD BUSINESS

Consideration of a request of the American Association of University Women regarding its February 6, 2007 City Council Candidate Forum.

MOTION: It was moved by Councilwoman Kappe and seconded by Councilman Edwards to authorize the La Palma-Cerritos Branch of the American Association of University Women to use the Council Chambers on Tuesday, February 6, 2007, from 6:00 p.m. to 9:30 p.m., for the purpose of holding a forum for Cerritos City Council candidates in the upcoming March 6, 2007 General Municipal Election, with the City absorbing the costs associated with cable casting the event. The motion carried, with Mayor Bowlen dissenting.

Consideration and award of Bid No. 1037-07, purchase of one new 3/4 ton pickup truck.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Kappe to award Bid No. 1037-07 for the purchase of one new 3/4 ton pickup truck to Villa Ford in the amount of $21,851.21. The motion unanimously carried.

Consideration and award of a professional services agreement for environmental consulting services for projects related to the proposed multi-family, affordable housing development located at 16700 Norwalk Boulevard (APN 7012-001-900) and the proposed office building located at 12616 183rd Street (APN 7030-002-902).

MOTION: It was moved by Councilwoman Kappe and seconded by Councilman Edwards to award a professional services contract for the preparation of the environmental assessment for projects related to the proposed multi-family, affordable housing development located at 16700 Norwalk Boulevard (APN 7012-001-900) and the proposed office building located at 12616 183rd Street (APN 7030-002-902) to The Planning Center in an amount not to exceed $49,605. The motion unanimously carried.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS/REPORT ON MEETINGS

Councilman Edwards reported on his attendance at the Sky Knight 40th anniversary celebration held on September 19, 2006 at the Long Beach Airport.

Councilman Crawley reported on his attendance at the Harvest Home Awards Dinner held on September 24, 2006 at the Prince Seafood Restaurant in Cerritos.

Mayor Pro Tem Lee reported on her attendance at the International Symposium on Development of Small and Medium Sized Cities held on September 23-24, 2006 in China.

Mayor Bowlen reported on his attendance at the Sky Knight 40th anniversary celebration; and announced that Cerritos resident Kelly Inouye-Perez was named UCLA’s Head Softball Coach. He also referenced public comments made by Ester Pulido at a previous Council meeting regarding the contributions of the Philippine Scouts in World War II and request for a plaque in their honor placed in the vicinity of the Cerritos Veterans Memorial, and suggested the matter be placed on the next agenda.

CONSENSUS: It was the consensus of the City Council to place the matter of recognizing the Philippine Scouts on a plaque in the vicinity of the Cerritos Veterans Memorial on the next agenda.

ADJOURNMENT

There being no further business to come before the City Council, the meeting adjourned at 7:25 p.m.
