Cerritos City Council Meeting Minutes

MINUTES OF A SPECIAL MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD JULY 24, 2006



CALL TO ORDER

Mayor Paul Bowlen called the meeting to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Pastor Suk-Boo Lee of Artesia-Cerritos United Methodist Church in Artesia offered the invocation.

PLEDGE OF ALLEGIANCE

Councilman Jim Edwards led the assembly in the salute to the flag.

ROLL CALL

The City Clerk noted attendance of the following Members of the City Council:

PRESENTATIONS

Mayor Bowlen presented a proclamation to Jennifer Lee for her outstanding achievement in receiving the Girl Scout Gold Award.

EMPLOYEE SERVICE AWARDS

Catherine Baital, Department Secretary, Cerritos Center for the Performing Arts, was presented a Twenty-Five Year Service Award.

PUBLIC COMMENTS AND SUGGESTIONS

Mayor Bowlen invited comments from those who wished to address the City Council on other than agenda items. There was no response and the public comments and suggestions portion of the meeting was closed.

CONSENT CALENDAR ITEMS

Approval of Register of Demands

MOTION: It was moved by Councilman Crawley and seconded by Councilwoman Kappe to approve the Register of Demands dated July 24, 2006, Checks 82931 through 82974 and Checks 82975 through 83163, in the total amount of $6,604,977.71. The motion carried unanimously.

Approval of Minutes

MOTION: It was moved by Councilman Crawley and seconded by Councilwoman Kappe to approve the Minutes of the July 13, 2006 Regular City Council Meeting. The motion carried unanimously.

PENDING LEGAL MATTERS

Resolution for consideration

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS ADOPTING PROCEDURES FOR THE PROVISIONS OF WATER AND SEWER UTILITY SERVICES TO FUTURE DEVELOPMENTS THAT INCLUDE HOUSING UNITS AFFORDABLE TO LOWER INCOME HOUSEHOLDS IN ACCORDANCE WITH SB 1087, AN AMENDMENT TO SECTION 65589.7 OF THE CALIFORNIA GOVERNMENT CODE AND SECTION 10631.1 OF THE CALIFORNIA WATER CODE.

RESOLUTION NO. 2006-24

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS ADOPTING PROCEDURES FOR THE PROVISIONS OF WATER AND SEWER UTILITY SERVICES TO FUTURE DEVELOPMENTS THAT INCLUDE HOUSING UNITS AFFORDABLE TO LOWER INCOME HOUSEHOLDS IN ACCORDANCE WITH SB 1087, AN AMENDMENT TO SECTION 65589.7 OF THE CALIFORNIA GOVERNMENT CODE AND SECTION 10631.1 OF THE CALIFORNIA WATER CODE.


MOTION: It was moved by Councilman Crawley and seconded by Councilwoman Kappe to waive reading of and adopt Resolution No. 2006-24. The motion carried unanimously.

NEW AND OLD BUSINESS

Consideration of a proposal to enter into an agreement with ABC Unified School District for the construction of a multi-family affordable housing development and a neighborhood park located at 16700 Norwalk Boulevard in Cerritos (APN 7012-001-900).

Community Development Director Contreras presented an overview of the proposal as outlined in the staff report dated July 24, 2006.

Discussion ensued regarding the following: Regional Housing Needs Assessment (RHNA)
housing requirements; redevelopment set-aside fund requirements for affordable housing; income qualification requirements and annual income verification for leasing of apartment units; potential profit from apartment rentals; potential residency eligibility and preference of school district and City employees, including part-time employees;
racial/ethnic composition requirement for affordable rental housing; breakdown of one and two bedroom apartment units; costs to maintain the proposed park; dedication of the proposed park to the City; onsite property management for apartment complex; maximum tenant occupancy per apartment unit; senior housing development restrictions; current negotiations regarding relocation costs for the central kitchen; leasing of City/Agency-owned property at market for school district administrative offices; the completion of a traffic study for the proposed project; and the benefits of the proposed project for the City and school district, and eligible teachers and City staff.

Interested parties were invited to present testimony. No one wished to address the City Council.

Discussion continued regarding the costs to retrofit and reconstruct the proposed building for school district administrative offices and related parking requirements and alternative parking arrangements; and the holding of future public hearings regarding the proposed project.

MOTION: It was moved by Councilman Crawley and seconded by Councilman Edwards to authorize the City Manager/Executive Director, or his designee, to negotiate with representatives of the ABC Unified School District to develop a Disposition and Development Agreement for review and approval by the City Council/Redevelopment Agency and District Board; and authorize staff to retain professional services relating to the project, including, but not limited to: the design and development of the proposed housing development, the associated public park, and the office building; the preparation of documents and exhibits needed for the approval of applicable entitlements; and the preparation of an environmental assessment. The motion carried unanimously.

REPORT ON PENDING LEGISLATION

City Manager Gallucci provided an update on the State’s energy crisis and encouraged energy conservation to prevent rolling blackouts.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS

Councilmembers commended the Property Preservation Commission, judges and staff on the success of the City Wide Pride awards banquet, and congratulated award winners.

Mayor Bowlen commended the Let Freedom Ring Committee on the success of July 4th Let Freedom Ring Celebration held at the Cerritos Civic Center.

ADJOURNMENT

There being no further business to come before the City Council, the meeting adjourned at 8:40 p.m.
