Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD JULY 13, 2006



CALL TO ORDER

Mayor Paul Bowlen called the meeting to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Mayor Pro Tem Laura Lee offered the invocation.

PLEDGE OF ALLEGIANCE

Councilman John Crawley led the assembly in the salute to the flag.

ROLL CALL

The City Clerk noted attendance of the following Members of the City Council:

PRESENTATIONS

Mayor Bowlen presented a proclamation to the Cerritos Girls Softball 8-and-under All Star Team for winning five consecutive All Star tournaments, including the Penasquitos Summer Classic, the Laguna Niguel Sea Country Classic, the Cerritos All Star Tournament, the Chino Hills Summer Classic, and the Los Angeles/South Bay District.

PUBLIC COMMENTS AND SUGGESTIONS

Sheila Tahada, Cerritos resident, suggested the Council notify residents of the City's recycling program.

CONSENT CALENDAR ITEMS

Approval of Register of Demands

MOTION: It was moved by Councilman Crawley and seconded by Councilwoman Kappe to approve the Register of Demands dated July 13, 2006, Checks 82367 through 82553, 82554 through 82731, 82732 through 82824, and 82825 through 82930, in the total amount of $4,396,294.96. The motion carried unanimously.

Approval of Treasurer's Report for period ending May 31, 2006

MOTION: It was moved by Councilman Crawley and seconded by Councilwoman Kappe to approve the Treasurer's Report for the period ending May 31, 2006. The motion carried unanimously.
CONSENT CALENDAR ITEMS (continued)

Approval of Minutes

MOTION: It was moved by Councilman Crawley and seconded by Councilwoman Kappe to approve the Minutes of the June 22, 2006 Regular City Council Meeting. The motion carried unanimously.

PUBLIC HEARINGS

A proposal by the City of Cerritos to demolish the pump house for Municipal Water Well C-1, an existing water pumping station located at 12701 Artesia Boulevard, Cerritos, California, 90703, and to replace it with the construction of an upgraded 1,700 square foot water pumping station. The subject site is zoned Open Space and is located in the Los Coyotes Redevelopment Area
(APN 7030-001-900).

Title to above-noted hearing was read and the public hearing opened.

Water Superintendent Holdren provided background information regarding the existing water pumping station and production capacity. He reviewed the details of the proposed project as outlined in the staff report dated July 13, 2006, noting the proposal was in conformance with security vulnerability assessment findings. Elevations and renderings of the proposed pump house were also reviewed by Mr. Holdren.

Interested parties were invited to address the Council on this matter. There was no response and the public hearing was closed.

MOTION: It was moved by Councilman Edwards and seconded by Councilwoman Kappe to receive and file Cerritos Redevelopment Conformity Report 2006-3.

RESOLUTION NO. 2006-22

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING THE MITIGATED NEGATIVE DECLARATION FOR PUBLIC REFERRAL PROJECT 2006-1.

MOTION: It was moved by Councilman Edwards and seconded by Councilwoman Kappe to waive reading of and adopt Resolution No. 2006-22. The motion carried unanimously.

RESOLUTION NO. 2006-23

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING PUBLIC REFERRAL PROJECT 2006-1.

MOTION: It was moved by Councilman Edwards and seconded by Councilwoman Kappe to waive reading of and adopt Resolution No. 2006-23. The motion carried unanimously.

The applicant, Pacific Industrial/Bendetti Company, 1176 Main Street, Suite 100, Irvine, California, 92614, on behalf of the property owner, George E. Atkinson III, is requesting approval of a conditional use permit for an existing developed property zoned (M) Industrial, located at 13903, 13905, 13907, 13909, 13911, 13913, 13915, 13919 and 13921 Artesia Boulevard, Cerritos, California, 90703 (APN 7003-004-013).

Title to above-noted hearing was read and the public hearing opened.

Current Planning Manager Hamilton reported that a new tenant had requested a business license for this industrial use, which prompted the proposed conditional use permit application. She added that staff has evaluated the permit for reasonable compliance with existing standards, since the use was initially granted prior to the conditional use permit requirement. Ms. Hamilton reviewed land use statistics, existing site conditions and proposed changes including relocation of trash receptacles, increased landscaping, screening of visible rooftop equipment, and a courtesy inspection by Building and Safety to insure that all safety codes are met. In response to Council inquiry, Ms. Hamilton commented on the conditional use process as it relates to changes in ownership of property and/or changes in use.

Interested parties were invited to address the Council on this matter.

Henrik Vartanian, architect representing the applicant, 8201 East Florence Avenue, Downey, spoke in favor of the application and indicated agreement with all of the conditions. He offered to answer any questions of the Council.

There were no other speakers and the public hearing was closed.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilman Crawley that the City Council:

A. Approve the Negative Declaration related to Conditional Use Permit 2006-1, making the findings outlined in Cerritos Planning Commission Resolution No. PC 2006-33; and

B. Approve Conditional Use Permit 2006-1, making the findings contained in Cerritos Planning Commission Resolution No. PC 2006-34;

as recommended in the staff report dated July 13, 2006. The motion carried unanimously.

NEW AND OLD BUSINESS

Consideration and award of Bid No. 1025-06, printing of the Cerritos Center for the Performing Arts onstage programs.

MOTION: It was moved by Councilwoman Kappe and seconded by Councilman Crawley to award Bid No. 1025-06 for the printing of the Cerritos Center for the Performing Arts onstage programs to Apollo Graphics in the amount of $74,487.41. The motion carried unanimously.

Consideration and award of Bid No. 1027-07, printing of the Cerritos Center for the Performing Arts 2006-2007 first, second and third seasonal calendars.

MOTION: It was moved by Mayor Pro Tem Lee and seconded by Councilwoman Kappe to award Bid No. 1027-07 for the printing of the Cerritos Center for the Performing Arts 2006-2007 first, second and third seasonal calendars to Colorgraphics, Inc. in the amount of $142,353.42. The motion carried unanimously.

REPORT ON PENDING LEGISLATION

City Manager Gallucci commented on the City's recycling program.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS

The City Council commended staff for a successful July 4th Let Freedom Ring Celebration at its new location at the Civic Center.

Mayor Pro Tem Lee read a letter from a Whitney student commending the City for making Cerritos a safe and enjoyable place to live, and she reported on students who visited Cerritos from Zhenzhou, China, who were very impressed with the City.

In response to an inquiry of Councilman Crawley, Community and Safety Services Director Berg commented on the apprehension of crime suspects in a grocery store and residential robberies.

Mayor Bowlen announced that hazardous waste could be disposed of on July 22 from 9:00 a.m. to 3:00 p.m. at Cerritos College or Corby & South in Artesia.

ADJOURNMENT

There being no further business to come before the City Council, the meeting adjourned at 8:00 p.m. in memory of Cerritos resident John Hendrix and Joshua “Sasha” Young, son of Cerritos employee Alma Griffin, both of whom recently passed away.
