Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD OCTOBER 27, 2005

CALL TO ORDER

Mayor Pro Tem Paul Bowlen called the meeting to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Councilwoman Gloria Kappe offered the invocation.

PLEDGE OF ALLEGIANCE

Girl Scout Brownie Troop 1 led the assembly in the salute to the flag.

ROLL CALL

The City Clerk noted attendance of the following Members of the City Council:

Councilman Jim Edwards
Councilwoman Gloria A. Kappe
Councilwoman Laura Lee
Mayor Pro Tem Paul W. Bowlen

The absence of Mayor John Crawley was noted as he was attending parent-teacher conferences at the school at which he teaches.

PRESENTATIONS

Mayor Pro Tem Bowlen presented proclamations to the following:

Nick and Esther Adelizi in celebration of their 50th wedding anniversary on October 1, 2005;

Robert and Dora Winders in celebration of their 50th wedding anniversary on October 1, 2005;

Cecilia Halliburton for contributing in the capture and arrest of a suspect;

Representatives of Community and Safety Services and the Cerritos Sheriff’s Station proclaiming the month of October 2005 as Crime Prevention Month in the City of Cerritos; and

Russ Widman for contributing in the arrest of four home burglary suspects in the City of Cerritos.

EMPLOYEE SERVICE AWARDS

Brenda Sunio, Library Assistant, Administrative Services, was presented a Twenty Year Service Award.

PUBLIC COMMENTS AND SUGGESTIONS

Merri Wheaton, Cerritos resident, offered a prayer.

CONSENT CALENDAR ITEMS

Approval of Register of Demands

MOTION:
It was moved by Councilwoman Kappe and seconded by Councilman Edwards to approve the Register of Demands dated October 27, 2005, Checks 75551 through 75710 and Checks 75711 through 75916, in the total amount of $3,942,714.45. The motion carried, with Mayor Crawley absent.

Approval of Treasurer’s Report for periods ending August 31, 2005 and September 30, 2005

MOTION: It was moved by Councilwoman Kappe and seconded by Councilman Edwards to approve the Treasurer's Report for the periods ending August 31, 2005 and September 30, 2005. The motion carried, with Mayor Crawley absent.

Approval of Minutes

MOTION: It was moved by Councilwoman Kappe and seconded by Councilman Edwards to approve the Minutes of the October 13, 2005 Regular City Council Meeting. The motion carried, with Mayor Crawley absent.

PUBLIC HEARINGS

A development proposal by Vivek Harris, Associate Principal Designer, Ravatt Albrecht & Associates, Inc., P.O. Box 528, Santa Maria, California, 93454, on behalf of the property owner, Cerritos Medical, KLS, LLC, for the construction of a two-story medical/dental office building with a subterranean parking garage. The site is located at 13359 South Street, Cerritos, California, 90703, is zoned Community Commercial (CC), and is located within the Los Coyotes Redevelopment Project Area (APN 7028-027-001).

Precise Plan 2005-25*

*A Mitigated Negative Declaration was previously approved on February 26, 2004 for a similar building at the site, for a similar use.


Title to the foregoing item was read, the public hearing opened, and staff called upon for a report.

Current Planning Manager Hamilton reviewed the staff report dated October 27, 2005 and provided details of the project, including location of the site, aerial photograph of the site, site plans, floor plans, soil remediation of the site, building setbacks, subterranean parking garage, at-grade parking, elevations, architectural elements, and artist’s renderings.

In response to Council inquiry, staff addressed Condition of Approval *58 relative to
underground parking, groundwater and/or stormwater dewatering system requirements, and addressed parking space requirements.

Interested parties were invited to present testimony. There was no response and the public hearing was closed.

MOTION: It was moved by Councilman Edwards and seconded by Councilwoman Kappe that the City Council:

A. Receive and file the Cerritos Redevelopment Agency Conformity Report 2005-12; and

B. Approve Precise Plan 2005-25 making the findings set forth in Planning Commission Resolution No. 2005-65;

as recommended in the staff report dated October 27, 2005. The motion carried, with Mayor Crawley absent.

PUBLIC WORKS ACTIVITIES

Consideration and approval of amendments to the agreements for landscape maintenance services with TruGreen LandCare, Branch 6246; and Valley Crest Landscape Maintenance.

MOTION:
It was moved by Councilwoman Lee and seconded by Councilwoman Kappe to approve amendments to the Agreements, as contained in the staff report dated October 27, 2005, between the City of Cerritos and TruGreen LandCare, Branch 6246, and Valley Crest Landscape Maintenance. The motion carried, with Mayor Crawley absent.

NEW AND OLD BUSINESS

Receipt of the 2005 Spirit of Accessibility Award for the Cerritos on Wheels (COW) and Dial-A-Ride Services.

MOTION:
It was moved by Councilwoman Lee and seconded by Councilwoman Kappe to receive and file the agenda report dated October 27, 2005 relative to the receipt of the 2005 Spirit of Accessibility Award for the Cerritos on Wheels (COW) and Dial-A-Ride Services. The motion carried, with Mayor Crawley absent.

Review and consideration of artwork to be located in the Sculpture Garden that will be located in the Cerritos Civic Center complex in the northwest corner of 183rd Street and Bloomfield Avenue, west of the Sheriff Station.

MOTION: It was moved by Councilwoman Kappe and seconded by Councilman Edwards to concur with the recommendation of the Fine Arts and Historical Commission and approve the “The Elements” series for installation, as shown in Attachment F of the staff report dated October 27, 2005, in the Cerritos Sculpture Garden located in the Cerritos Civic Center complex on the northwest corner of 183rd Street and Bloomfield Avenue, west of the Sheriff Station, at the location specified in Attachment C of the staff report dated October 27, 2005; approve funding in the amount of $82,500 plus shipping, installation and insurance (approximately $2,500) for the purchase of the first two pieces (Earth and Water) in “The Elements” series by Jane DeDecker; and direct staff to continue working with the artist to complete Phase II (Wind and Fire) of this project for future installation in the Sculpture Garden. The motion carried, with Mayor Crawley absent.

Review and consideration of 50th anniversary parade and celebration activities.

MOTION:
It was moved by Councilman Edwards and seconded by Councilwoman Kappe to direct staff to finalize the plans to commemorate the City of Cerritos’ 50th anniversary. The motion carried, with Mayor Crawley absent.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS

Councilman Edwards commended Cecilia Halliburton and Russ Widman whom received proclamations earlier this evening for their involvement in the arrest of suspects.

Councilwoman Lee reported on her attendance at and congratulated Carver Academy on their 40th anniversary celebration.

Councilwoman Kappe reminded the community of the upcoming November 8, 2005 Special Statewide and Consolidated Elections and encouraged everyone to vote.

Mayor Pro Tem Bowlen inquired about and staff responded regarding the preparation schedule of the City’s Tournament of Roses Parade Float.

ADJOURNMENT

There being no further business to come before the City Council, the meeting adjourned at 8:15 p.m.
