Cerritos City Council Meeting Minutes

MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF CERRITOS
HELD AUGUST 11, 2005

CALL TO ORDER

Mayor John Crawley called the meeting to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Councilwoman Laura Lee offered the invocation.

PLEDGE OF ALLEGIANCE

Councilman Jim Edwards led the assembly in the salute to the flag.

ROLL CALL

The City Clerk noted attendance of the following Members of the City Council:

PRESENTATIONS

Kenneth Chan of the Chinese Historical Society presented the City Council with the organization’s book “Portraits of Pride.”

PUBLIC COMMENTS AND SUGGESTIONS

Wendy Huang, member of Toastmasters International Club 3828, presented an overview of the organization and invited the community to the club’s meetings held on Wednesdays, 7:30 p.m., at Cerritos at Avalon.

CONSIDERATION OF APPOINTMENTS TO VACANCIES ON VARIOUS COMMISSIONS, BOARDS AND COMMITTEES

Consideration of appointment to the Economic Development Commission.

Mayor Crawley presented the qualifications of Grace Hu for appointment to the Economic Development Commission.

MOTION:  It was moved by Mayor Crawley and seconded by Mayor Pro Tem Bowlen to appoint Grace Hu to the Economic Development Commission, with a term expiring March 31, 2007.  The motion unanimously carried.

The City Clerk then administered the oath of allegiance to Ms. Hu.

CONSENT CALENDAR ITEMS

Approval of Register of Demands

MOTION:  It was moved by Councilman Edwards and seconded by Councilwoman Lee to approve the Register of Demands dated August 11, 2005, Checks 73251 through 73433 and Checks 73434 through 73646, in the total amount of $4,290,856.23. The motion carried unanimously.

Approval of Minutes

MOTION:  It was moved by Councilman Edwards and seconded by Councilwoman Lee to approve the Minutes of the July 25, 2005 Special City Council Meeting. The motion carried unanimously.

Ordinances for second reading and adoption.  Reading of ordinances waived and ordinances adopted.

ORDINANCE NO. 903

AN ORDINANCE OF THE CITY OF CERRITOS ADDING CHAPTER 22.37, AREA DEVELOPMENT  PLAN THIRTEEN (ADP-13), TO THE CERRITOS MUNICIPAL  CODE.

MOTION:  It was moved by Councilman Edwards and seconded by Councilwoman Lee to waive reading of and adopt Ordinance No. 903.  The motion carried by the following vote:

AYES: Councilmembers – Edwards, Kappe, Lee, Bowlen, Crawley
NOES: Councilmembers – None
ABSENT: Councilmembers – None
ABSTAIN: Councilmembers - None
 

ORDINANCE NO. 904

AN ORDINANCE OF THE CITY OF CERRITOS AMENDING THE CERRITOS DEVELOPMENT MAP BY CHANGING THE ZONE CLASSIFICATION OF APPROXIMATELY ±0.53 ACRE OF LAND, LOCATED SOUTHEAST OF 183RD STREET AND CARMENITA ROAD (APN 7023-007-025) AND WITHIN THE LOS COYOTES REDEVELOPMENT PROJECT AREA, FROM NEIGHBORHOOD COMMERCIAL (CN) TO AREA DEVELOPMENT PLAN THIRTEEN (ADP-13), AND APPROXIMATELY ±0.52 ACRE OF LAND, LOCATED   SOUTHWEST OF 183RD

STREET AND ALEXANDER AVENUE (APN 7023-007-901 AND APN 7023-007-902) AND WITHIN  THE LOS COYOTES REDEVELOPMENT PROJECT AREA, FROM SINGLE FAMILY RESIDENTIAL (RS-6500) TO AREA DEVELOPMENT PLAN THIRTEEN (ADP-13).

MOTION:  It was moved by Councilman Edwards and seconded by Councilwoman Lee to waive reading of and adopt Ordinance No. 904.  The motion carried by the following vote:

PUBLIC HEARINGS

Consideration to waive reading of and introduce AN ORDINANCE OF THE CITY OF CERRITOS AMENDING SECTION 22.22.700 OF THE CERRITOS MUNCIPAL CODE REFINING EXISTING REGULATIONS PERTAINING TO FRONT YARD LANDSCAPING ON SINGLE-FAMILY RESIDENTIAL PROPERTIES.

Development Code Amendment 2005-6*

*Pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA), this project is exempt from CEQA review.

Title to the foregoing item was read, the public hearing opened, and staff called upon for a report.

Advance Planning Manager/Redevelopment Manager Lopez provided an overview of the proposed ordinance refining existing regulations pertaining to front yard landscaping on single-family residential properties as outlined in the staff report dated August 11, 2005.
He reported that property owners have extended existing driveways for additional parking and do not maintain the required front yard landscaping, and stated that the proposed ordinance will clarify the forty-percent front yard landscape requirement as well as the landscape requirement in the three-foot driveway setback area. He noted that the Planning Commission recommended approval of the proposed ordinance.

In response to Council inquiry, Mr. Lopez indicated that the proposed ordinance would be retroactively implemented and property owners who are not in compliance would be given notice with sufficient opportunity to comply with the provisions of the ordinance; and that the property owners may apply for the residential loan assistance program to bring the property into compliance. He also addressed parking requirements and noted that property owners may apply for an on-street parking permit for additional parking needs.

Interested parties were invited to present testimony. There was no response and the public hearing was closed.
 

ORDINANCE NO. 905

AN ORDINANCE OF THE CITY OF CERRITOS AMENDING SECTION 22.22.700 OF THE CERRITOS MUNCIPAL CODE REFINING EXISTING REGULATIONS PERTAINING TO FRONT YARD LANDSCAPING ON SINGLE-FAMILY RESIDENTIAL PROPERTIES.

MOTION:  It was moved by Councilwoman Kappe and seconded by Councilman Edwards to waive reading of and introduce Ordinance No. 905.  The motion carried by the following vote:

AYES: Councilmembers - Edwards, Kappe, Lee, Bowlen, Crawley

Resolutions for consideration

Consideration of adoption of the Fiscal Year 2005-2006 appropriation limit.

Consideration to waive reading of and adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING AND ADOPTING THE ANNUAL APPROPRIATION LIMIT FOR FISCAL YEAR 2005-2006.

RESOLUTION NO. 2005-28

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING AND ADOPTING THE ANNUAL APPROPRIATION LIMIT FOR FISCAL YEAR 2005-2006.

MOTION:  It was moved by Mayor Pro Tem Bowlen and seconded by Councilwoman Kappe to waive reading of and adopt Resolution No. 2005-28.  The motion unanimously carried.

Consideration to waive reading of and adopt A RESOLUTION OF THE CERRITOS CITY COUNCIL SETTING FORTH ITS INTENTION TO CONSIDER THE TRANSFER OF A CABLE FRANCHISE FROM KNOLOGY BROADBAND OF CALIFORNIA, INC. TO WAVEDIVISION HOLDINGS, LLC AND ITS INTENTION TO RENEW AND GRANT A CABLE FRANCHISE TO WAVEDIVISION HOLDINGS, LLC; AND SETTING A PUBLIC HEARING FOR AUGUST 25, 2005.

RESOLUTION NO. 2005-29

A RESOLUTION OF THE CERRITOS CITY COUNCIL SETTING FORTH ITS INTENTION TO CONSIDER THE TRANSFER OF A CABLE FRANCHISE FROM KNOLOGY BROADBAND OF CALIFORNIA, INC. TO WAVEDIVISION HOLDINGS, LLC AND ITS INTENTION TO RENEW AND GRANT A CABLE FRANCHISE TO WAVEDIVISION HOLDINGS, LLC; AND SETTING A PUBLIC HEARING FOR AUGUST 25, 2005.

MOTION:  It was moved by Councilman Edwards and seconded by Councilwoman Lee to waive reading of and adopt Resolution No. 2005-29.  The motion unanimously carried.

NEW AND OLD BUSINESS

Review of 2006 City Council/Redevelopment Agency meeting dates and possible rescheduling of dates conflicting with holidays and/or other events.

MOTION:  It was moved by Councilwoman Lee and seconded by Councilwoman Kappe to cancel the January 12, 2006 City Council/Redevelopment Agency meeting and reschedule it to January 9, 2006.  The motion carried unanimously.

MOTION:  It was moved by Councilwoman Kappe and seconded by Councilwoman Lee to cancel the January 26, 2006 City Council/Redevelopment Agency meeting and reschedule it to January 23, 2006.  The motion carried unanimously.

MOTION:  It was moved by Mayor Pro Tem Bowlen and seconded by Councilwoman Kappe to make no changes to the April 27, 2006 City Council/Redevelopment Agency meeting date.  The motion carried unanimously.

MOTION:  It was moved by Councilwoman Lee and seconded by Councilwoman Kappe to cancel the July 27, 2006 City Council/Redevelopment Agency meeting and reschedule it to July 24, 2006.  The motion carried unanimously.

MOTION:  It was moved by Councilman Edwards and seconded by Councilwoman Lee to cancel the November 23, 2006 City Council/Redevelopment Agency meeting and reschedule it to November 20, 2006.  The motion carried unanimously.

MOTION:  It was moved by Councilwoman Kappe and seconded by Councilman Edwards to cancel the December 28, 2006 City Council/Redevelopment Agency meeting.  The motion carried unanimously.

Consideration of catering and concession services at the Cerritos Center for the Performing Arts.

MOTION:  It was moved by Councilwoman Kappe and seconded by Councilman Edwards to approve staff selection of The Patina Group as the preferred caterer and concessionaire at the Cerritos Center for the Performing Arts subject to the terms and conditions of the contract as negotiated by staff.  The motion unanimously carried.

PUBLIC HEARINGS (reconsider)

ORDINANCE NO. 905

AN ORDINANCE OF THE CITY OF CERRITOS AMENDING SECTION 22.22.700 OF THE CERRITOS MUNCIPAL CODE REFINING EXISTING REGULATIONS PERTAINING TO FRONT YARD LANDSCAPING ON SINGLE-FAMILY RESIDENTIAL PROPERTIES.

MOTION TO RECONSIDER:  It was moved by Councilwoman Lee and seconded by Mayor Crawley to reconsider the introduction of Ordinance No. 905 entitled, An ordinance of the City of Cerritos amending Section 22.22.700 of the Cerritos Municipal Code refining existing regulations pertaining to front yard landscaping on single-family residential properties, and re-open the public hearing.  The motion carried unanimously.

Discussion ensued regarding the costs to bring a property into compliance with the ordinance; enforcement of the ordinance; garages being utilized for storage instead of parking; the ability for property owners to apply for on-street parking permits for additional parking; and the five-year grandfather period provided to property owners to comply with other code violations. 

Assistant City Attorney Steres addressed the provisions of the existing ordinance and the purpose of the proposed ordinance to define the use of the driveway setback area.

Following additional discussion, it was suggested the ordinance be referred back to the Planning Commission for further review.

MOTION:  It was moved by Councilwoman Lee and seconded by Mayor Pro Tem Bowlen to refer Ordinance No. 905 to the Planning Commission for further review and report back to the City Council.  The motion carried unanimously.

REPORT ON PENDING LEGISLATION

City Manager Gallucci reported on the status of the vehicle license fee payment from the State of California.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS

City Councilmembers reported on their attendance at the memorial service for Community Safety Committee Member Elliot Gray who recently passed away, reflected on his contributions to the community, expressed condolences to his family and requested that the meeting be adjourned in his memory.

Mayor Pro Tem Bowlen suggested landscaping improvements at vacated railway right-of-ways.

Councilman Edwards reported on his attendance at the Mayors and Council Members Academy in Monterey and the Youth Soccer Awards Night.

Councilwoman Lee also reported on her attendance at the Youth Soccer Awards Night and the Indian National Independence Day Celebration.

ADJOURNMENT

There being no further business to come before the City Council, the meeting was adjourned at 7:52 p.m. in memory of Community Safety Committee Member Elliot Gray who recently passed away.
