MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF CERRITOS
HELD JULY 13, 2005

CALL TO ORDER

Mayor John Crawley called the meeting to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Councilman Jim Edwards offered the invocation.

Councilwoman Laura Lee led the assembly in the salute to the flag.

Approval of Register of Demands

MOTION:  It was moved by Councilwoman Kappe and seconded by Councilman Edwards to approve the Register of Demands dated July 14, 2005, Checks 72413 through 72919 in the total amount of $6,175,122.53. The motion carried unanimously.

Approval of Minutes

MOTION:  Councilwoman Kappe moved to approve the minutes of the regular meeting held June 23, 2005. The motion, seconded by Councilman Edwards, carried unanimously.

Ordinance for second reading and adoption.  Reading of ordinance waived and ordinance adopted.

ORDINANCE NO. 902

AN ORDINANCE OF THE CITY OF CERRITOS AMENDING CHAPTER 9.49 OF THE CERRITOS MUNICIPAL CODE TO PROHIBIT SMOKING IN PUBLIC PARKS AND AT THE CIVIC CENTER.

MOTION:  It was moved by Councilwoman Kappe and seconded by Councilman Edward to waive reading of and adopt Ordinance No. 902.  The motion carried by the following vote:

PUBLIC HEARINGS

Agenda Item 11A

A proposal by the Olson Company, 3020 Old Ranch Parkway, Suite 400, Seal Beach, California 90740, to amend the Cerritos Municipal Code by incorporating Chapter 22.37, Area Development Plan Thirteen (ADP-13).  The proposed Area Development Plan will allow a density of ±18.00 dwelling units per acre and includes specific development standards that will apply exclusively to the project site, which measures approximately ±1.05 acres in area.  The subject site is located at 18310 Carmenita Road and 18303 Alexander Avenue and 18311 Alexander Avenue, Cerritos, California 90703, and is located in the Los Coyotes Redevelopment Project Area (APN 7023-007-025, APN 7023-007-901 and APN 7023-007-902).

Development Code Amendment 2005-5

AN ORDINANCE OF THE CITY OF CERRITOS ADDING CHAPTER 22.37, AREA DEVELOPMENT PLAN THIRTEEN (ADP-13), TO THE CERRITOS MUNICIPAL CODE. 

One Mitigated Negative Declaration was prepared for the proposed 18-unit affordable senior housing development, inclusive of all related entitlements and amendments, and was approved and certified at a public hearing before the Cerritos City Council/Redevelopment Agency on November 14, 2002.

A proposal by the Olson Company, 3020 Old Ranch Parkway, Suite 400, Seal Beach, California 90740, to amend the General Plan Map and Development Map (land use/zoning) designation of a parcel measuring approximately ±0.53 acre, located at 18310 Carmenita Road, Cerritos, California 90703; a parcel measuring approximately ±0.28 acre, located at 18303 Alexander Avenue, Cerritos, California 90703; and a parcel measuring approximately ±0.24 acre, located at 18311 Alexander Avenue, Cerritos, California 90703. The proposed amendments will change the first subject parcel’s land use designation from Community Commercial to Area Development Plan Thirteen (ADP-13) and zone classification from Neighborhood Commercial (CN) to Area Development Plan Thirteen (ADP-13) and will change the second and third subject parcels’ land use designation from Low Density Residential to Area Development Plan Thirteen (ADP-13) and zone classification from Single Family Residential (RS-6500) to Area Development Plan Thirteen (ADP-13). The subject parcels are located in the Los Coyotes Redevelopment Project Area (APN 7023-007-025, APN 7023-007-901 and APN 7023-007-902).

The subject site is located at 18310 Carmenita Road, 18303 Alexander Avenue, and 18311 Alexander Avenue and is located in the Los Coyotes Redevelopment Project Area (APN 7023-007-025, APN 7023-007-901 and APN 7023-007-902).

Cerritos Redevelopment Agency Conformity Report 2005-8
Precise Plan 2005-17

One Mitigated Negative Declaration was prepared for the proposed 18-unit affordable senior housing development, inclusive of all related entitlements and amendments, and was approved and certified at a public hearing before the Cerritos City Council/Redevelopment Agency on November 14, 2002.

Title to the foregoing items was read, the public hearings opened, and staff called upon for a report.  It was noted that the three public hearings would be held concurrently.

An overview of the proposed development code amendment, general plan amendment and development map amendment, as contained in the staff reports dated July 14, 2005, was presented by Associate Planner Lopez.

Senior Planner Cisneros reviewed Precise Plan 2005-17 and related design aspects of the proposed development, as contained in the staff report dated July 14, 2005.  She offered the following changes to the conditions of approval:

Modify Condition No. 35 *h:

Compliance with all the rules, and regulations, and requirements stipulated imposed by the City for the ownership of any of the units in this affordable senior housing project, including all affordability and senior housing requirements set forth in the Disposition and Development Agreement for the project.

Modify Condition No. 37 *

Approval of final Parcel Tract Map and Precise Plan 2005-17 shall not be effective until the ordinance re-zoning the property to Area Development Plan Thirteen (ADP-13) has become effective (thirty (30) calendar days following the adoption of the ordinance by the Cerritos City Council).

In response to City Council inquiry, staff responded as follows:  the intersection of Alexander Avenue and La Jara Street does not warrant a stop sign at this time, however, the traffic patterns at this location would be monitored; design deficiencies experienced previously, particularly with regard to water on balconies, had been addressed for this development; and that the line of sight for traffic exiting the development from  Alexander Avenue onto 183rd Street is sufficient.  The time frame for completion of the project, unit valuation, occupant application process, and one-car maximum per unit limitation were also addressed by staff.

At this juncture the Mayor opened the public hearing and invited testimony from interested parties.

Ben Besley, representing the Olson Company, 3020 Old Ranch Parkway, Suite 400, Seal Beach, California, 90740, spoke in favor of the proposal and commented on the company's design review procedure, noting that for the first year all repairs are paid for by the Olson Company.  He also addressed that there would be a shower or bath tub alternative for occupants and added that the design of the wall would preclude line-of-sight interference for traffic exiting onto 183rd Street.  Mr. Besley noted an estimated completion time frame at approximately mid-August or September of 2006 and briefly discussed the one-car parking limitation.

No one else wishing to comment, the public hearing was closed.

Precise Plan 2005-17

MOTION:  Councilwoman Kappe moved that the City Council:

A.        Approve Precise Plan 2005-17 making the findings set forth in Planning Commission Resolution No. PC 2005-45, including the modifications to conditions of approval 35 *h and *37 as noted by staff; and

B.         Receive and file Cerritos Redevelopment Agency Conformity Report 2005-8;

as recommended in the staff report dated July 14, 2005.  The motion was seconded by Mayor Pro Tem Bowlen and carried unanimously.

Tentative Tract Map 62094

One Mitigated Negative Declaration was prepared for the proposed 18-unit affordable senior housing development, inclusive of all related entitlements and amendments, and was approved and certified at a public hearing before the Cerritos City Council/Redevelopment Agency on November 14, 2002.  

Title to the foregoing item was read, the public hearing opened, and staff called upon for a report.

Director of Community Development Contreras recommended that consideration of the proposed tentative tract map be postponed indefinitely, noting that the Planning Commission had approved the tentative tract map and that the final tract map would be considered by the City Council in August 2005.  He added that approval of the final tract map would not hinder the progress of the project.

The Mayor invited interested parties to comment.  There was no response and the public hearing was closed.

MOTION:  It was moved by Councilwoman Kappe and seconded by Councilwoman Lee to postpone indefinitely consideration of Tentative Tract Map 62094.  The motion carried unanimously.

A JOINT RESOLUTION OF THE CERRITOS CITY COUNCIL AND CERRITOS REDEVELOPMENT AGENCY PURSUANT TO CALIFORNIA HEALTH AND SAFETY CODE SECTION 33445 REGARDING THE PURCHASE BY THE CERRITOS REDEVELOPMENT AGENCY OF REAL PROPERTY OWNED BY SOUTHEAST REGIONAL OCCUPATIONAL PROGRAM (SEROP) MEASURING APPROXIMATELY ±0.73 ACRE AND LOCATED AT 17423 STUDEBAKER ROAD, CERRITOS, CALIFORNIA, IN THE LOS CERRITOS REDEVELOPMENT PROJECT AREA (APN 7034-016-905 AND APN 7034-016-906).

Title to the foregoing item was read, the public hearing opened, and staff called upon for a report.

Associate Planner Lopez provided an overview of the property purchase proposal, as outlined in the staff report dated July 14, 2005, elaborated on blighted conditions on the site, and reviewed the required findings/determinations for use of Redevelopment funds for purchase of the property.

In response to Council inquiry, City Manager Gallucci discussed the appraisal negotiation process and indicated that the results of the Phase I and II study on the property found minimal contamination.

Interested parties were invited to present testimony.  There was no response and the public hearing was closed.

JOINT RESOLUTION NO. 2005-24 AND NO. CRA 2005-7

A JOINT RESOLUTION OF THE CERRITOS CITY COUNCIL AND CERRITOS REDEVELOPMENT AGENCY PURSUANT TO CALIFORNIA HEALTH AND SAFETY CODE SECTION 33445 REGARDING THE PURCHASE BY THE CERRITOS REDEVELOPMENT AGENCY OF REAL PROPERTY OWNED BY SOUTHEAST REGIONAL OCCUPATIONAL PROGRAM (SEROP) MEASURING APPROXIMATELY ±0.73 ACRE AND LOCATED AT 17423 STUDEBAKER ROAD, CERRITOS, CALIFORNIA, IN THE LOS CERRITOS REDEVELOPMENT PROJECT AREA (APN 7034-016-905 AND APN 7034-016-906).

MOTION:  It was moved by Councilwoman Lee moved to waive reading of and adopt Joint Resolution No. 2005-24 and No. CRA 2005-7.  The motion was seconded by Mayor Pro Tem Bowlen and carried unanimously.

Title to the foregoing item was read, the public hearing opened, and staff called upon for a report.

Community Development Director Contreras provided an overview of the proposed project and addressed the required findings for use of Redevelopment funds for the project.

In response to Council inquiry, Assistant City Manager/Public Works Brar briefly commented on traffic flow design safety elements of the proposal.

JOINT RESOLUTION NO. 2005-25 AND CRA NO. 2005-8

A JOINT RESOLUTION OF THE CERRITOS CITY COUNCIL AND THE CERRITOS REDEVELOPMENT AGENCY PURSUANT TO CALIFORNIA HEALTH AND SAFETY CODE SECTION 33445 REGARDING THE INSTALLATION OF A NEW TRAFFIC SIGNAL AT THE INTERSECTION OF DUMONT AVENUE AND ARTESIA BOULEVARD IN THE LOS CERRITOS REDEVELOPMENT PROJECT AREA.

MOTION:  Councilwoman Lee moved to waive reading of and adopt Joint Resolution No. 2005-25 and CRA No. 2005-8.  The motion was seconded by Councilman Edwards and carried unanimously.

PENDING LEGAL MATTERS

Resolution for Consideration

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING A PROGRAM AGREEMENT FOR SAFE ROUTES TO SCHOOL BETWEEN THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION AND THE CITY OF CERRITOS AND AUTHORIZING THE ASSISTANT CITY MANAGER/PUBLIC WORKS TO EXECUTE THE MASTER AGREEMENT FOR STATE FUNDED PROJECTS AND ALL RELATED AND FUTURE PROGRAM SUPPLEMENTS.

RESOLUTION NO. 2005-26

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS APPROVING A PROGRAM AGREEMENT FOR SAFE ROUTES TO SCHOOL BETWEEN THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION AND THE CITY OF CERRITOS AND AUTHORIZING THE ASSISTANT CITY MANAGER/PUBLIC WORKS TO EXECUTE THE MASTER AGREEMENT FOR STATE FUNDED PROJECTS AND ALL RELATED AND FUTURE PROGRAM SUPPLEMENTS.

MOTION:  It was moved by Councilwoman Kappe and seconded by Councilman Edwards to waive reading of and adopt Resolution No. 2005-26.  The motion carried unanimously.

PUBLIC WORKS ACTIVITIES 

Consideration of award of contract for the construction of the Cerritos Sculpture Garden, Project No. 10077.

MOTION:  It was moved by Councilman Edwards and seconded by Councilwoman Lee to award a contract for the construction of the Cerritos Sculpture Garden, Project No. 10077, to Park West Landscape, Inc. in the amount of $1,790,600.  The motion carried unanimously.

Consideration and approval of an amendment to an agreement between the City of Cerritos and Republic Electric for traffic signal and street lighting maintenance.

MOTION:  It was moved by Councilwoman Lee and seconded by Councilwoman Kappe to approve an amendment to the agreement, extending the existing contract between the City of Cerritos and Republic Electric for traffic signal and street lighting maintenance for a period of one year, through June 30, 2006.

Consideration and approval of an amendment and complete restatement of the Southeast Water Coalition Joint Powers Agreement.

MOTION:  Councilwoman Lee moved to approve an amendment and complete restatement of the Southeast Water Coalition Joint Powers Agreement and authorized its execution by the Mayor on behalf of the City.  The motion was seconded by Councilman Edwards and carried unanimously.

REPORT ON PENDING LEGISLATION

City Manager Gallucci reported on the status of the State budget.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS

Councilman Edwards and Councilwoman Lee commented on the recent visit of dignitaries from Sister City Banciao, China.

Councilwoman Lee noted her participation in the recent Volunteer Recognition Dinner and commended the City volunteers for their contribution to the community.

Councilwoman Kappe noted the recent passing of retired City Parks Superintendent Bob Meyer and it was noted that a tree would be planted in his memory.  She received confirmation that staff is in the process of preparing a report regarding the July 4th celebration.

Mayor Pro Tem Bowlen commented on the effort involved in attaining the rank of Eagle Scout and encouraged involvement in the Boy Scouts of America.  He referenced the recent electrical outage and suggested residents be prepared in the event of future emergencies.

Mayor Crawley commented on his participation in the Philadelphia, Pennsylvania July 4th celebration, which included a ceremony involving ringing of a Liberty Bell replica known as the Normandy Liberty Bell.  He indicated that he was one of two Mayors, the other being the Mayor of Philadelphia, to participate in the festivities and noted that he was presented with a miniature replica of the Liberty Bell from the Pennsylvania Society of the Sons of the Revolution and Color Guard.  Mayor Crawley in turn presented the Liberty Bell replica to Recreation Superintendent Mendoza.

RESTRUCTURING AND ADJUSTING CITY ATTORNEY'S COMPENSATION FOR FISCAL YEAR JULY 1, 2005 THROUGH JUNE 30, 2006.

MOTION:  It was moved by Councilman Edwards and seconded by Councilwoman Kappe to restructure and adjust the City Attorney's compensation for Fiscal Year July 1, 2005 through June 30, 2006 as follows:

Basic Retainer:

$11,500 for the first 60 hours of general municipal work, with a credit for any unused portion of the retainer to be applied against other work if in any month the general municipal work is less than 60 hours.

Litigation, 
Redevelopment
& Special Projects
& All Other Work:

Attorneys with 1-3 years' experience $225 per hour;
Attorneys with 4-5 years' experience $250 per hour;
Attorneys with 6-7 years' experience $275 per hour;
Attorneys with 8+ years' experience $295 per hour; and
Law clerks and paralegals $125 per hour.

The foregoing motion carried unanimously.

ADJOURNMENT

There being no further business to come before the City Council, the meeting was adjourned at 8:30 p.m. in memory of former Cerritos employee Bob Meyer, who recently passed away.
